OMCA GUILD TRAVEL RELEASE/ACKNOWLEDGEMENT OF ASSUMPTION OF THE RISK

TERMS OF REGISTRATION

Name: (“Participant”) has agreed to participate in the Oakland Museum of California (“OMCA”) Art, History, or Natural Sciences Guild trip to

(“Guild Trip”) on . OMCA’s highest priority is to provide a safe and enjoyable environment for everyone that joins the Guild Trip. In consideration for OMCA allowing this participation, Participant acknowledges and agrees to the following:

INFORMED CONSENT

Participant understands and acknowledges there are certain risks inherent in participating in the Guild Trip. Participant acknowledges that OMCA cannot ensure the safety of Participant or guarantee that the equipment, premises and/or activities encountered while on the Guild Trip or in transit to and from the Guild Trip are entirely free of hazards or risks. Risks may include but are not limited to physical or mental injury, illness, harm, loss, paralysis, and death, and/or damage, or loss of personal property. Participant understands this is not a complete description of all risks and that other unknown or unforeseeable hazards and risks of harm may occur. Participant expressly assumes all these risks, foreseeable or not, and waives any and all claims that Participant may have against OMCA in the event of any injury, illness, harm, death, damage or other loss arising from the Guild Trip to the fullest extent permitted by law.

HEALTH RESTRICTIONS & DISABILITIES

Participant represents that he/she has no known health restrictions that might jeopardize his or her safety or health, and/or the safety or health of others during the Guild Trip. OMCA does not discriminate on the basis of disability, medical condition, genetic information, or any other prohibited basis. Participants requiring the assistance of an attendant because of a disability or medical condition must provide their own attendant and register him/her as a participant for the Guild Trip and pay all costs associated with the attendant’s participation in the Guild Trip. OMCA reserves the right to prohibit any individual from participation in a particular Guild Trip if the individual’s disability or medical condition cannot be reasonably accommodated. Finally, Participant represents that all relevant allergies and needs for accommodation that would or could affect the Participant’s participation in the Guild Trip are identified below.

CODE OF CONDUCT AGREEMENT

Participant acknowledges that every participant is responsible for his or her own conduct at all times during the Guild Trip. Participant agrees to demonstrate appropriate conduct towards all of the participants, staff and places he/she visits on the Guild Trip and to follow all program rules and the rules in effect at any of the locations being visited. Participant understands that appropriate conduct prohibits causing injury or harm to other participants, harassment, hazing, bullying, inappropriate or abusive language, damaging or destroying property. OMCA does not in any way accept responsibility for the health, welfare and/or conduct of any Participant.

The Trip Leader reserves the right to exclude any Participant from all or any part of the Guild Trip, who the Trip Leader believes, in his or her sole discretion, violates appropriate conduct, presents a health or safety concern or medical risk that cannot be reasonably accommodated, is disruptive, or otherwise conducts him/herself in a manner detrimental to OMCA and/or other participants. If Participant is excluded from participation or otherwise departs a Guild Trip early for any reason, Participant is responsible for any and all costs associated with an early departure, including but not limited to medical evacuation, travel, and compensation and expenses for any person or persons accompanying Participant.

MEDICAL ATTENTION

Participant agrees that in the event of an accident, injury, and/or medical emergency, OMCA and its agents or employees are hereby authorized to consent to and obtain for Participant whatever emergency medical treatment, surgery, or dental care is considered necessary. Participant understands this is not an affirmative duty or undertaking on the part of OMCA. Participant understands OMCA will attempt to contact the person listed as Participant’s emergency contact by telephone, as soon as practicable, should an accident, injury and/or medical emergency arise. In the event OMCA is unable to receive instructions for Participant’s care from Participant or Participant’s emergency contact, full authorization is given to any licensed physician and/or surgeon for the provision of medical treatment, including the administration of drugs or medication, and the performance of surgical treatment, for the relief of pain and/or preservation of life, health and/or well-being. Participant will be responsible for any medical costs

incurred for Participant. Participant agrees to pay such medical costs whether or not they are insured.

RELEASE AND WAIVER

Participant hereby releases and forever discharges OMCA and the Guild, their predecessors and successors in interest, assigns, affiliates, subsidiaries, insurers, officers, directors, agents, representatives, attorneys, employees, partners, contractors, vendors, joint venturers, volunteers, and trustees from any and all claims, demands, causes of action, obligations, damages, and liabilities of any nature whatsoever, whether legal or equitable, whether or not known, suspected or claimed, arising out of or relating to the Participant’s participation in the Guild Trip, to the fullest extent permitted by law. Without limiting the scope of the foregoing, this release applies to any damage, injury or loss to any person or property that results from the ordinary negligence of OMCA or any of the other parties released herein this Agreement. Participant agrees to defend, indemnify and hold harmless OMCA and the other parties released from all claims, demands, causes of action, obligations, damages, and liabilities made by any third party arising out of or relating to the Participant’s participation in the Guild Trip. Participant agrees to pay all fees, damages, and costs, including attorneys’ fees that OMCA or other parties released may incur in the enforcement of this Agreement. Pursuant to California Civil Code section 1668, this release does not apply to claims for gross negligence, or intentional acts or omissions, fraud, or violation of statutory rights.

SECTION 1542 WAIVER

The purpose of the above release and waiver is to enable Participant to participate in a Guild Trip which involves certain inherent risks. Because neither OMCA nor the Participant can know what specific injury or harm may arise until it happens, OMCA is asking Participant to waive certain claims in advance other than those caused by gross negligence or intentional acts or omissions, fraud or violation of statutory rights. In order to do that effectively under California law, a waiver of Civil Code section 1542 is necessary.

Therefore, Participant agrees that he or she waives the application of the following provision of California Civil Code section 1542 as it relates to any and all unknown claims Participant may have against OMCA or the other parties released involving Participant’s participation in the Guild Trip. Participant certifies that he/she has read and understands the provisions of section 1542 that he/she is waiving, which provides:

A general release does not extend to claims which the creditor* does not know or suspect to exist in his or her favor at the time of executing

the release, which if known to him or her must have materially affected his or her settlement with the debtor*.

*for the purposes of this release “creditor” is the traveler and debtor is any of the herein released.

The Participant understands that in waiving the protections of California Civil Code section 1542, he or she is waiving the right to bring claims for ordinary negligence against OMCA and the others released herein, including claims that are currently unknown to the Participant.

GENERAL INFORMATION

All of the above constitutes the Agreement between Participant and OMCA (collectively, “Parties”) and governs participation in the Guild Trip and supersedes any prior agreements or understandings. This Agreement shall be governed by the laws of the State of California without regard to conflict of law provisions. The Parties agree to submit to the personal jurisdiction of the courts located within Alameda County, California. The failure of OMCA to exercise or enforce any right or provision of the Agreement shall not constitute a waiver of such right or provision. If any provision of the Agreement is found by a court of competent jurisdiction to be invalid, the Parties nevertheless agree that the court should endeavor to give effect to the Parties' intentions as reflected in the provision(s), and the other provisions of the Agreement remain in full force and effect.
