ARLINGTON COUNTY TRESPASS TOWING ADVISORY BOARD (TTAB) ROSTER

The Advisory Board on Trespass Vehicle Towing shall consist of seven (7) members. The members shall be: three (3) representatives from the Police Department, three (3) representatives from the towing industry, and one (1) citizen representative. All members serve at the pleasure of the County Board for three (3) year terms. The Chairman shall

be elected annually from among the voting members of the Advisory Board by a majority vote and shall rotate annually between a representative of a local law-enforcement agency, a representative of a licensed towing and

recovery operator, and one member of the general public.

Trespass Towing Advisory Board (TTAB)

Previously known as the Advisory Board on Trespass Vehicle Towing Originally adopted April 24, 2007

Amended July 24, 2012 Amended July 18, 2017

BACKGROUND:

In July 2006, the County Board adopted Chapter 14.3 of the Arlington County Code relating to the towing and storage of motor vehicles. According to the State Code, prior to adopting or amending any towing ordinance, the local governing body shall appoint an advisory board to advise the governing body with regard to the appropriate provisions of the ordinance. The Advisory Board is required by Virginia Code to meet at least once per year (Virginia Code Section 46.2-1233.2.). Since the ordinance language has been adopted and implemented, a new advisory board provides an opportunity to review the experiences and successes of its first year and to make any recommendations on proposed amendments.

CHARGE: The TTAB shall review the current ordinance and any provisions recommended for amendments to the ordinance and provide input and recommendations for the County Board’s consideration. The TTAB shall meet at least once per year at the call of the Chairman of the TTAB. COMPOSITION: The TTAB shall consist of 7 members. The members shall be: three (3) representatives from the Police Department, three (3) representatives from the towing industry, and one (1) citizen representative. All members serve at the pleasure of the County Board for three (3) year terms. Meeting Minutes The meeting was called to order at 6:30 p.m. The staff coordinator opened the meeting and thanked members for serving. Introduction of all attendees followed. The staff coordinator briefly reviewed the charge, scope and composition of the Advisory Board. The first order of business was the election of a Chair person as required by Code of Virginia § 46.2-1233.2. Detective O’Keefe made a motion to nominate Mr. O’Neill, seconded by Mr. Leach. Mr. Chiste made a motion to nominate Detective O’Keefe. The motion died for a lack of second. Mr. O’Neill was elected Chair by a vote of 6-1. The Chair requested the staff coordinator provide an overview of towing data and towing complaints for Calendar Year 2017. The staff coordinator provided data on all trespass tows in Arlington County and Detective O’Keefe provided data on towing complaints. Copies of the data provided are included as Attachment A. The TTAB moved to a section-by-section review of the draft ordinance and opened the floor for amendments. The TTAB discussed the issue of the availability of towing contracts to the public at large and vehicle owners who have been towed. The debate focused on the policy issue of who should have access to the contracts as well as where the contracts should be retained and made available. TTAB members

representing towing and recovery operators discussed and informed the TTAB about the software packages most companies have purchased, which allow for contracts to be loaded into the system and available to employees. A motion was made by Mr. O’Neill, seconded by Captain Desamour, to amend Chapter 14.3-5(A)(4) to remove “for public inspection” and “and at the property, respectively.” The motion was approved by a vote of 7-0. A companion motion was made by Mr. O’Neill, seconded by Captain Desamour, to include the towing contract (the contract that was in place at the time of the tow) as a record that must be retained by the towing and recovery operator for a period of one year under Chapter 14.3-11. The motion was approved by a vote of 7-0. A motion was made by Mr. Chiste that the TTAB acknowledge that property owners and vehicle owners are not represented on the TTAB. The motion died for lack of a second. The Chair called for any additional amendments, and none were offered. A motion to adjourn was made by Mr. Leach, seconded by Captain Desamour, and approved by a vote of 7-0. Adjournment Seeing none, the meeting adjourned at 7:39 pm.
