1. In your own words, briefly describe the three categories of Continual Professional Development programs from which points can be claimed towards acquiring a Practicing Certificate. (3 marks)

a) State any 2 requirements for eligibility to apply for a Practicing Certificate under the Architects’ Registration Regulations (2 marks)



2. Maranyane University has issued an Invitation to Tender (ITT) for registered

architects to tender for the provision of Architectural Services for the design and supervision of a research facility building consisting of amphitheatres, teaching spaces, research laboratories and staff offices. As part of the submission for the ITT, they have requested drawings to demonstrate the design concept commensurate with Workstage (2) of the Framework for the Delivery of Architectural Services and Use of the Tariff of Fees. Tendering architects will have to bear all costs arising from the tender preparation and submission.

a) As a registered architect, will you submit design concept drawings as part of your tender submission? Briefly explain why. (2 marks)

b) As a registered architect intending to comply with the provisions of the Code of Professional Conduct and Ethics of the Profession, what would your advice be to Maranyane University about the best way to procure Architectural Services at this stage of the project? (3 marks)



c) List any 2 (two) circumstances under which the Architects’ Registration Council can order the removal from the register of the name of an architectural professional. State the procedure followed for the reinstatement of the removed name to the register. (5 marks)



3. a) What is the importance/function of the Development Control Code (DCC)? (4 marks)

(2 marks) 4. Government buildings in Botswana and some other countries are mostly erected by

the Ministry responsible for Works (DBES or otherwise), and are exempted from Building Regulations. In your view, why does this exemption exist?

5. Botswana Institute for Technology Research and Innovation (BITRI) in collaboration with the Faculty of Engineering and Technology of University of Botswana want to investigate the performance of new building materials including Compressed Earth Bricks (CEB) and Straw Clay Roof Tile (SCRT). They have designed 5 different buildings they want to erect using these materials. They have approached you as a registered professional with ARC to assist them with the submission to Gaborone City Council to obtain the necessary compliances with the Building Regulations. How will you assist them? (5 marks)



6. You have been approached by a Client to design a multi-family development of 15 Townhouses on a 3000m2 plot in Tlokweng. In close proximity to the plot are a Shopping Centre, a Daycare Centre and a Public Park.

a) Is it mandatory for you to provide for Open Space on your design? Explain

your answer. (2 marks)

b) What is the minimum number of parking bays required for your development? (3 marks)

c) Your Client would like the development to be one large building. What is your advice to her? (2 marks)



7. You are a registered and Practicing Principal/ Architect at D4000 (Pty) Ltd. The tenders have just been retuned and the lowest bidder’s price of P12, 600,000 (twelve million six hundred thousand pula only) inclusive of 12% VAT has been accepted by your client. The accepted tender amount includes contingencies of P800, 000 (Eight hundred thousand Pula only). The VAT included in the contract sum is P1, 350,000 (One million three hundred and fifty thousand pula). Just prior to tender you had claimed Stage 4a Fees based on the Quantity Surveyors pre-tender estimate of P10,000,000 (Ten million Pula only) which did not include VAT but still included a contingency of P800,000 (Eight hundred thousand Pula only). a) In the space provided below, calculate the fees now due for stage 4b

c) After completion of the project, the client dispenses with your services but

informs you of his intention to re-use your designs with another architect on another site. How would you respond to the client’s decision and how much would you charge for re-use of your drawings if at all. (4 marks)

a) Create a timeline for the submission of a Contractor’s claims under FIDIC 1999 Red Book if the event or circumstance giving rise to the claim has a continuing effect. (2.5 marks)

b) Explain the role of the Engineer under FIDIC 1999 Red Book by comparing the Engineer’s authority to issue instructions under Sub-Clause 3.3 and the Engineer’s duty to make determinations in accordance with sub-Clause 3.5

c) Explain the role of a standing DAB under FIDIC 1999 Red Book (2.5 marks)

d) Explain the steps to be taken by the Engineer in accordance with Sub-Clause 3.5 (Determinations) of FIDIC 1999 Red Book and illustrate the requirements by providing the sequence of events under the Sub-Clause

BIDP STANDARD FORM & JBCC MINOR WORKS AGREEMENT 11.

a) Describe below the main difference between how the BIDP Standard form of Contracts and the JBCC Minor Works (or JBCC Principal Building Agreements) are administered in relation to both the Architect’s registration act and the Framework for the use of Tariff of Fees . (2.5 marks)

b) What is the Prescription Period for written contracts under Botswana Law and what effect does this have on the latent defects liability period?

c) The BIDP Standard Form has the option of being executed “under hand” or “under seal”. Explain your understanding of the 2 terminologies in the space below. (2.5 marks)

d) Explain below the major differences in Insurance provisions between the BIDP Standard form of Building Contract and the JBCC Minor Works Agreement. (2.5 marks)
