James Lewis (D-Charlestown) in the Sen- ate was signed by Gov. Mitch Daniels into law on March 13. The Model Home Act provides a 50 per- cent property tax deduction on the struc- ture of a model or speculative home built in Indiana. The deduction is allowed for an assessment date for which the residence is partially assessed and for the first three years for which the residence is fully as- sessed as long as the structure has never been used as a principal residence or used as the owner’s principal office space. IBA’s govern- mental affairs team researched other states that passed legislation in the 1980s that of- fered a similar exemption and with the help of members in Howard County, IBA secured two authors for the legislation in the 2008 session. Facing long odds in a short session that was dominated by property tax relief, the authors and sponsors of the bill with the help of IBA’s lobbyists were able to pro- duce a piece of legislation with significant results to not only the home builders of In- diana, but to every associate and supplier whose livelihood depends on the residen- tial construction industry and ultimately the homeowner who purchases the new home. T he month of April is national newhome month and the month that theIndiana Builders Association isconducting its annual statewide

membership renewal drive. As 2008 Presi-dent of the IBA, I want to be the first tothank you for your membership in the IBAand your dedication to the industry. I feel like Rocky Balboa in the fifthround of a fifteen round fight. As an indus-try, we are still standing and fighting, al-though our nose may be bloodied and ourlip swollen. Each day, I — like many ofyou — pick up the newspaper or click ontoMSN news looking for something to indi-cate that we are turn-ing the corner. The Fed has beenaggressive in cuttingshort term interestrates in an effort tostabilize the bankingindustry and providerelief to homebuyerswho have adjustable rate mortgages. How-ever, because we live in a world economy,these rate cuts come at a price that includeshigher gas prices and inflation. Not muchgood news, but some. It will be a long and winding road on anational level for the economy and for thehousing industry. We are taking baby stepstoward a slow recovery. However, I have seen better news com-

ing out of the Indiana Statehouse. H.B. 1001was signed by Gov. Mitch Daniels on March19, bringing forth the most sweeping prop-erty tax reform that has ever been proposed,

discussed, shapedand passed in thestate of Indiana.H o o s i e rhomeowners willsave about 30 per-cent off their taxbills from 2007with a property tax

cap amendment capping property taxes at1 percent of a homes assessed value. Inaddition, tighter spending controls througha referendum process will be available forschools and government constructionprojects. Congratulations to all involved in shap-ing this legislation that has brought clarityto property taxes in Indiana and has takenaway a major uncertainty that was keeping

Hoosiers from buying new homes due toproperty tax concerns. I also want to take a moment to congratu-late Rick Wadja, IBA’s CEO, and the IBAgovernmental affairs team who successfullyhelped pass H.B. 1164, the Model HomeAct. The Model Home Act provides a 50percent tax credit on the structure for modeland speculative homes built for up to a threeyear period. This bill will save our buildermembers thousands of dollars on modelhomes that they build to showcase theirhomes and our associates’ products to thebuying public. No longer will we as anindustry be penalized for showcasing ourinventory. As we move into the spring and summermonths, I look forward with optimism. Withclarity on property taxes, qualified buyerswill be less apprehensive about a new homepurchase. The national credit crunch willbegin to correct itself albeit slowly. We as an industry will begin to take smallsteps forward on the long and winding roadto recovery. In the meantime, it is impera-tive that we continue to support the effortsof the IBA in protecting the affordability ofhousing within the state of Indiana. he Indiana General Assembly ad-journed for the year on March 14,after passing a number of key piecesof legislation and before taking fi-

nal action on several potentially harmfulissues. IBA had a successful session due to lob-bying efforts on numerous bills throughoutthe process and as a direct result of mem-

bers who took the time to contact their leg-islators to voice their support or opposi-tion. Below are summaries of legislation im-pacting the building construction industry.Property tax reform passes* Increases sales tax from 6 percent to 7percent on April 1.* Provides $620 million in additional home-stead credits this year, $140 million in newhomestead credits in 2009 and $80 millionin 2010. Homeowner bills would be re-duced by about 30 percent on average state-wide this year over last year’s bills, andnearly 28 percent lower in 2010 over lastyear’s bills.* Phases in caps in property tax bills. Whenfully implemented in 2010, homeowners’tax bills would be limited to 1 percent oftheir homes’ assessed value (AV), with 2percent limits on rental property and agri-cultural land as well as 3 percent on busi-ness property.* Allows counties to adopt new local op-tion income taxes.* Duties of township assessors in townshipswith less than 15,000 parcels would betransferred to the county auditor.Referendums:* Required for future debt if it falls outsidethe caps, and exempts existing debt in Lakeand Saint Joseph counties from countingagainst the caps.* Required for building projects for elemen-tary and middle schools that cost more than$10 million. Same requirement applied forhigh school construction projects costingmore than $20 million.* Required for local government projectsthat cost more than $12 million or 1 per-cent of the taxing unit’s assessed value, if atleast 5 percent of the unit’s registered vot-ers or 100 voters of property taxes petitionfor the referendums.Property tax constitutional cap amend-ment passes Senate Joint Resolution 1 (S.J.R. 1), theproposal to place the 1, 2 and 3 percentcircuit breaker tax caps into the IndianaConstitution, passed the Indiana House ona 79-20 vote and the Indiana Senate on a40-7 vote on March 14. S.J.R. 1, if passed

by the Indiana General Assembly in 2009and then approved by voters, would put thetax caps in the state’s constitution. S.J.R. 1 was amended in conference com-mittee to provide a different circuit breakertax cap calculation methodology for Lakeand Saint Joseph counties than would ap-ply to Indiana’s other counties.Employee classification bill dies H.B. 1269, the Employee Classificationbill, died after it failed to receive a hearing

in the Senate. The bill assumed almost allworkers on a project are employees of thecontractor. H.B. 1269 implements a vagueand confusing definition of “independentcontractor” that significantly undercuts tra-ditional methods of defining “subcontrac-tor” status; which involve a more thoroughevaluation of the relationship between theworker and the employer. While no legislation was passed directlyaddressing the issue, there was a resolution

passed in the Senate to study the issue insummer study committee.Immigration bill dies in last hours of ses-sion The immigration bill underwent multiplechanges throughout the process from theSenate version which would have imple-mented a “three-strikes and you’re out” ap-proach for companies who hire illegal aliensto the House version which allowed an ex-

Your association membership is important to usH

ow many times have you heardor thought “I haven’t seen anincrease in my business since Ijoined” or “I find no value in my

membership”? My response to these statements is: “Whatdid you expect to get out of your member-ship when you joined the association?” The most common answer is “more busi-ness.” Then I follow-up with the question, “Areyou married?” If the answer is yes, I ask, “Did you justsee her, ask her and she agreed to marryyou without knowing any more aboutyou?” Rarely is that answer yes. My questions are designed to illustratethat gaining business is more than just mail-ing a check once a year. You need to pro-vide other members of your association withthe opportunity to meet you and to learnabout your company’s products and ser-vices. Once they are familiar with you andyour company, then they will think of youwhen they or someone else they come intocontact with needs your products and ser-vices. The process is two-way. Builders will callassociates when they need a product. As-sociates will refer builders and other asso-ciates when someone asks them for theirassistance. Through successful interactions,you strengthen relationships and your busi-ness blossoms.

When you fail to renew your membership,you lose out. You lose the opportunity tonetwork with prospective customers at as-sociation functions. You lose the crucialsupport of 235,000 other members of theNational Association of Home Builderswho, like yourself, work to support safe andaffordable housing. You lose several hun-dreds in membership discount opportuni-ties. You also lose the ability to access thegreatest housing industry resource streamavailable from your local, state, and nationalbuilders associations. Your membership plays a huge role in thesuccess of your local, state, and nationalhousing industries. Strength is in numbersand your membership is one of 235,000national and 7,000 statewide. Last year, the Indiana Builders Associa-tion increased our membership by 20 per-cent and received recognition in severalnational membership competitions. We accomplished great achievementsthrough our big membership push last year.But, like a well planted garden, we mustcontinue to work to reap the seeds we sow. We have identified April 21-25 as state-wide membership retention week. If yourecruited a new member last year, please takethe time this month to pick up the phoneand follow up with how that member is do-ing. Often times, a personal call and aninvitation to an association meeting or com-mittee activity will really get the member-ship ball moving. I encourage you to get creative with yourmonthly gatherings to increase participa-tion and retention. The HBA of HowardCounty is going to have a membership re-tention party April 23. The HBA of Howard County is followingup this great event with implementing apoint system, where a member will get pointsfor different areas of involvement in theirassociation. Points will accrue over the yearand at the end of the year rewards, such asdiscounts on advertising, Home Show boothdiscount, free meals at monthly meetingswill be presented. Even if you don’t have time to be an ac-tive member in your association, your dailymembership - which is the cost of a large

The greater our membership, thegreater our ability to impact state and na-tional legislators on housing industry con-cerns. During confer-ence committee time, IBA continued tooppose the mandate and the final versionof the bill passed requires the issue to befurther studied in summer study commit-tee. IBA will continue to advocate for avoluntary, market-driven approach for green

Carter was first elected Attorney Generalin 2000 and was sworn in to serve a secondconsecutive term in 2005. Carter is a leader among his colleagues,having served as President of the NationalAssociation of Attor-neys General. He nowchairs an ExecutiveWorking Group of sixU.S. Attorneys, sixstate attorneys gen-eral, and six localprosecutors that meetat the United StatesDepartment of Justiceto advise the U.S. At-torney General oncriminal justice matters. Since taking office, Carter has increasedthe amount of lost and forgotten assets totheir rightful owners by eight-fold. Morethan $54 million in unclaimed property wasreturned in 2006 alone. He has taken an active role in fightingpublic corruption in Indiana including amassive vote fraud investigation in LakeCounty. Carter was born in Lafayette, Indianaand grew up on his family’s farm in southLake County in Northwest Indiana. Graduating with honors from HarvardUniversity, Carter received his bachelor’sdegree in economics. He earned a J.D. andan M.B.A. from Indiana University gradu-ate Schools of Law and Business. He has served as Chief City County at-torney for the city of Indianapolis, Legisla-tive Counsel for the Indiana State Senate,and the Agricultural Assistant and Chief ofStaff to the Indiana Lieutenant Governor. Another item on the agenda is the pro-posed bylaw amendment placed before theIBA board of directors at the January meet-ing. The proposed amendment increasesthe number of members on the finance com-mittee from three to five. he new amendments to the IndianaResidential Code (IRC) took effectApril 5. IBA Codes Committeevolunteers participated in the re-

view of the current IRC and the writing ofthe new amendments to it. It was a longhaul. The current residential code in effect forthe last several years has been the 2005 In-diana Residential Code (IRC.) The codeafter April 5 will also be called the 2005Indiana Residential Code (IRC.) The residential code is made up of amodel code with Indiana amendments. Forthe 2005 IRC, the model code adopted isthe 2003 International Residential Code.For the code after April 5, the model codewill still be the 2003 International Resi-dential Code. The name of the code hasn’t changed.The model code adopted as a part of thecode hasn’t changed. What has changed?The amendments. But they are only beingupdated, not rewritten entirely. That meansthat many of the current amendments willnot change either; but some will change,some will be deleted, and then some will bebrand new. The brand new ones are written for thepurpose of making life easier! For example,with these amendments, you will now know: What is fireblocking, and how is it dif-ferent from fire resistive construction? What is a mono-pitch truss, and how canit be tied to the wall?

What is a wall line? What is a sill plate? What is a sole plate? What is an exterior door, and how are itslandings and threshold different from thoseof an exit? What does an unvented crawlspace looklike? And more. You can now look it all up on your own,and download the amendments at http://www.in.gov/legislat ive/iac/T06750/A00140.PDF?. You want 675 IAC 14-4.3,the legal name for the current IRC, so youmay have to scroll a bit past repealedamendments. The amendments may lookthe same at the beginning. To make sureyou have the new version (the new amend-ments merged with the current ones,) checkto see if the Department of Homeland Secu-rity is listed in Sec. 1. If yes, the amend-ments are merged.

The Henry County Builders Associationis working to not only provide warm homesfor locals, but also warm coats for areayouth with their Coats from the Heartprogram. Over the past four years, the HenryCounty BA has raised money to purchaseover 175 coats for needy children. “Manypeople say that the community serviceprojects are the reason they stay involvedin the association,” Becki McGrady said.“We hope to only improve on this programand be able to provide coats to morechildren.”

New Indiana code amendmentsver 130 code officials, builders,remodelers and suppliers partici-pated in one of three codes semi-nars held in South Bend,

Clarksville and Indianapolis. The semi-nars discussed the new Indiana codeamendments, which took effect April 5. Lynn Madden, Code Compliance/ Qual-ity Control Supervisor for HallmarkHomes and the IBA Codes Committee

O Chairwoman presented the one-day semi-nars. One attendee said that the best part ofthe class was learning more about formalinterpretations. Attendees also had the opportunity toparticipate in discussions concerning theupdated amendments that were approvedand adopted by the Indiana Fire Preven-tion and Building Safety Commission.

emption for employer’s acting in good faith.During the final week of session, legisla-tors could not reach a compromise and thebill died from lack of action. IBA workedon the legislation throughout session, of-fering several suggestions to ensure that thehome building industry was not negativelyimpacted and will continue the dialoguewith interested legislators.

No action taken on annexation S.B. 114 did not receive a hearing in theHouse after passing the Senate 26-22 anddied from lack of action. IBA was concerned

about the potential impact the waiver lan-guage could have for economic develop-ment and suggested alternatives to legisla-tors supporting the bill. This issue will likely surface in the fu-ture and IBA will be proactively discussingthe issue with legislators during the interim.

Green building mandate dies after nego-tiations fail H.B. 1280, which originally required cer-tain public works contracts valued at $1million dollars or more be built or remod-eled to LEED Silver, Green Globes TwoGlobe or an equivalent ANSI-Certified Stan-dard was changed in the Senate to send the

issue to a summer study committee. Duringconference committee time, IBA continuedto oppose the mandate and the final ver-sion of the bill passed requires the issue tobe further studied in summer study com-mittee. IBA will continue to advocate for a vol-untary, market-driven approach for greenbuilding and oppose mandates in this area.

Weather sirens standards passes S.B. 334, the Weather Sirens Legislation,requires the Indiana Department of Home-land Security to adopt rules establishingstandards for severe weather warning sirensand assist counties in the development of a

siren coverage plan for the county. IBAsupported the final version of the bill. Theoriginal language in the bill would haverequired developers to pay for weather si-rens through an impact fee for the installa-tion of the sirens.

Licensing of new home salespeople mea-sure dies The requirement of licensing new homesalespeople included in the filed version ofS.B. 275 died during the 2008 session. IBAopposed the licensing provision containedin the bill and will work with interested par-ties over the summer on this issue to ex-plain the negative consequences it couldhave on affordable housing in Indiana.

Registry bill stops due to IBA concerns S.B. 257, the bill that would have cre-ated a statewide construction registryonline, was changed at the urging of IBAand sent to a summer study committee. Thischange occurred after recognizing aspectsof existing Mechanic’s Lien statute wouldbe inadvertently impacted. The possibilityof a statewide construction registry will befurther evaluated during the interim by bothIBA’s mechanic’s lien task force and legis-lators.

Modified lead paint legislation passes S.B. 143 dealing with lead paint under-went numerous changes throughout the pro-cess before being passed. IBA worked withlegislators to address concerns specific tothe housing industry. The bill originallyrequired the testing for lead paint of apart-ments in buildings built prior to 1978 when-ever there was any building permit pulled.IBA opposed this provision as there are lim-ited workers across the state qualified totest for lead and would require additionaltimelines for projects. Ultimately, the provision was removedand the final bill only impacts the buildingindustry with two provisions: one createsan advisory council to make recommenda-tions on several issues and the second re-quires the Department of Health to adoptrules consistent with HUD lead safe workpractices. IBA does have a seat on the advi-sory council and will closely monitor anyfindings.

Archaeology legislation signed by governor H.B. 1129, the archeology legislationwhich focused on artifacts and burialgrounds, was a culmination of work withlegislators that began last summer and IBAensured the language addressed our con-cerns for developers around burial grounds.The bill was signed by Gov. Daniels.

Summer study committees IBA will now focus attention on summerstudy committees comprised of legislatorsand members of the public charged withthe task of evaluating issues in various ar-eas during the interim. Study committeesare typically reserved for complex issueswhich demand more in depth discussionthan available during session. IBA will monitor and provide insighton issues studied during the interim and islikely that some recommendations fromstudy committees will turn into legislationto be debated in future sessions. UILD-PAC is the political actioncommittee of the National Associa-tion of Home Builders. BUILD-

PAC provides all NAHB members with atool to combine their voluntary and per-sonal financial contributions and supportthe campaigns of candidates for the U.S.Congress and other political committees. BUILD-PAC is a critical element inNAHB’s advocacy program. BUILD-PAC’smission is to forge a powerful political part-nership among NAHB, its state and localassociations, and all 235,000 NAHB mem-bers, in order to protect the housing indus-

try from potential risk. BUILD-PAC maintains five clubs: theCapitol Club ($5,000 annually,) the Plati-num Club ($2,500 annually,) the Gold KeyClub ($1,000 annually,) the Dollar-A-DayClub ($365 annually,) and the Century Club($100 annually.) Contributions made to BUILD-PAC arenot used for administrative expenses. Ev-ery dollar contributed to the PAC is used forpolitical purposes. he NAHB Spike Club is NAHB’srecognition and incentive programfor individuals working in member-ship recruitment and retention.

Based upon credits earned, there is a pro-gressive program of awards including pins,certificates, plaques, sweaters, and blazers. A Spike is an individual who has earnedat least 6 credits within a two-year period.Spike credits are earned by recruiting andretaining NAHB and council members. ASpike Candidate is an individual who hasearned between 1 and 5 Spike credits andwill soon become a full Spike with contin-ued credit accrual. NAHB recognizes and rewards these

T membership development efforts with itsSpike Club awards program.How Credits Are Earned Individuals earn one new member creditfor each new member sponsored. One re-tention credit is automatically assigned tothe sponsor of record for first-year renew-als, if the renewal occurs on or before theanniversary date. Every year after one-halfa credit is earned, if the renewal form liststhe sponsoring member. One-half credit isearned for the recruitment and retention ofaffiliate members.
