2015 DBE & Subcontractors’ Conference

On behalf of the Alaska Department of Transportation & ‘Public Facilities(ADOT&PF) Civil Rights Office (CR0), we would like to thank everyone whoparticipated in the 12th Annual DBE & Subcontiactors Conference. We apprec.1ate theefforts that were put forth into making this event successful and informative toeveryone who attended We look forvard to collaborating with everyone next year tomake this conference successful again.

The 12th Annual OBE & Subcontractors’ Conference was held March 5-6 at theCrowne Plaza, Anchorage and was also available live stream at www.dbealaska.comfor those who could not attend in-person. Setting the OvertlI DBE Goal

An important aspect of the State of AEaskas OBE Program., but also one that manyreaders are unfamiliar with, is the overall DBE goal This is an mporant topic, andone that every contractor should be farriihar wth because it drectiy affects every DBEand noriDBE contractor vo interds to bid on federal funded DOT projects We willbegin by providing some backgound information about the overall goal, ari concludevith the FFY2OI5-2017 proposed overatl goal and program updates.

49 CFR Part 26 (the federal regulation detailing the rules for imp’ementing the DBEProgram) requires that an overall DBE goal be set every three years that reflects thelevel of DBE participation that could be expected absent the effects of thscrmination,and expressed as a percentage of federal funds received from each funding mode(FHWA, FAA, FTA). The regulations set out a two-step process for setting the overallgoal, but for all intents and purposes,, there are actually three steps.. The first step s toestablish the avaitability of DBEs relative to all firms ready, willing, and able to peormwork on USDOT- assksted contracts. The second step requires that the federal fundsrecipient (in our case, ADOT&PF) examine all available evidence in its jurisdktion toidentify any adjustments that need to be made to the figure derived in step one in

order to accurately reTLet me level 01 UhIh partcipation tnat couici be expected atsentthe effects of discrimination. ‘Step 3 of the process for setting the overall DRE goat sto establish what portion of the DBE goal will be met by race-conscious (e g. requiredDBE goals on individual projects) means. and ‘hat portion wiU be met through race-neutral means. These steps must be followed in order to arrive at a DRE goal for eachindividua’ funding mode.

For FFY2OI 5-201 7, the proposed overall DBE goal for FRWA-assisted contracts is846%, to be met through entirey race-neutral means. The methodology for how thisgoal was established is available on the Civil Rights Offce website(http:hw,wdot.state ak.us/cvlrtsiindexshtml), and is open for public comment untilthe close of business on March 1 0, 201 5. If approved by FHWA, the most noticeablechange from a program implementation perspective is that the proposed goal does notinclude a race-conscious component. In practice, this means that FHWA-contractgoals would riot exceed ftOO%, and therefore, all DRE parlicipation on FHWAassisted contracts woutd be considered race-neutral. It is impoitant to note that in theabsence of a race-conscious component of the overall DBE goal, additional race-neutral efforts wLlI be rolling out to help facilitate DBE participation For moreinformation on race-neutral measures and available resources, please contact theCivil Rights Office.

Megan Sawtefle

Megan Sawielle is the PdministrativeOfficer for the CR0. Her backgroundinvolves four years working forDOT&PF, as well as five years as anAir Force cMlian. She holds twodegrees in business: an Associatesin Business Administration andManagement and a Bacheiors inSma11 Business Management andEntrepreneurship. Growing upmilitary, she experienced diversyand acceptance of various culturesat an early age, which lead her tobeing excited as part of the CR0

team. She enjoys meeting new people and creating memories from new experiences,especially re’ated to ar and music.

tAatt deLaBruere is the new Support ServicesSpecialist for the CR0.He moved to Anchorage in January fromJuneau wheie he worked for the Departmentof Education for the pasto years. Mallenjoys a viide variety of outdoor activitiesincluding, fishing hunting, campng hiking,cross country skiing, and f the weather werewarmer in Alaska, he woud surf and snorkeltoo Mall attended Nofthern Arizona Universityin Flagstaff AZ for his first year of college.Mall moved to Melbourne, Australia to attendLa Trobe University and graduated with aBachelor of International Development. WhilelMng in Australia, iatt fell in love with thesport of Australian Rules football. He playedAussie Rules football at La Trobe Universityfor four years. Mall is a food fanaticand enjoysa wide variety of dishes his favorite food issushi and his favorite dessert is tiramisu. Mallis also an avid home brewer he brewshomemade hard apple cider and he would liketo participate in several homebrew festivals.
