What is a joint tenancy?

A tenancy is a legally binding contract. It is thereforeimportant that all tenants who enter the contractunderstand the terms and conditions.These terms and conditions arecontained in New Charter’sTenancy Agreements. As anexisting tenant, you will alreadybe familiar with your TenancyAgreement. However, peoplewho you wish to create a jointtenancy with should alsofamiliarise themselves with theseterms and conditions before theyapply.

A joint tenancy can be a tenancy between two and four jointtenants. So, if you are currently a sole tenant you can apply tohave a joint tenancy with up to three other people.

It is important to remember that each tenant is jointly and severallyliable for the tenancy. This is a legal term which means that youare collectively and individually responsible. For example, eachtenant is responsible for all the rent. A breach of tenancy by oneis the responsibility of all the tenants. Ending of the tenancy byone ends the tenancy for all the tenants.

There must be trust and co-operation between tenants if thetenancy is to work.

Can I just add someone elseinto my existing TenancyAgreement?

No. As a New Charter tenant youmust first end your existing tenancyby giving 4 weeks notice to quit inwriting. On expiry of the 4 weeks notice,we can then create a new tenancy. However, creatingany new tenancy is subject to the written consent of NewCharter.

Will I keep my preserved right to buy if I amgranted a new joint tenancy?

Yes.

Will my Housing Benefit entitlement be affected?

Yes, it could be. If you areapplying for a joint tenancy withsomeone other than yourpartner, you will only beentitled to Housing Benefit onyour share of the rent. Inthese circumstances, each jointtenant who wishes to apply forHousing Benefit will need tocomplete their own individualapplication form.

Partners who are not recognised as couples under Housing Benefitregulations will be affected in the same way.

Before you decide to apply for a joint tenancy, you can contactthe Housing Benefit Section of Tameside Council to find out howyour Housing Benefit claim may be affected. You can do this bytelephoning 0161 342 3709. You will need to supply details ofyour rent, your income and the income of any proposed jointtenant(s) to receive the right advice.

Is a joint tenancy right for me?

There are many reasons why existingtenants want to create joint tenancieswith other people. We recognisethat these reasons will be personalto each individual.

However, if you are considering applyingfor a joint tenancy for the following

reasons you may want to think again.

I want to provide security for a member of my family. I amworried about what will happen to them if I die.

New Charter offers extensive succession rights if you die.Section 10 of your Tenancy Agreement outlines these rights inmore detail. However, if you need further information aboutsuccession and how it personally affects you and your family,please contact your local Neighbourhood Management Officer.

I intend to exercise my preserved right to buy, and to do somy partner needs to be a joint tenant.

This is not correct. You may sharethe preserved right to buy with upto three members of your family(including partners and spouses)who are not themselves tenants,subject to certain requirements.You can find out more informationabout these requirements bycontacting our Right to Buy team on0161 331 2000.

Can anyone apply to become a joint tenant?

Yes. However, as a tenant you do not have any legal rightto change your tenancy in this way. You will need theLandlord’s written consent under NewCharter’s policy on creating jointtenancies with existing tenants.

If you are thinking of applying tocreate a joint tenancy withsomeone else, then you need toconsider the following:

1. Joint tenancies can only becreated between an existing tenantand members of their family asfollows:

The tenant’s spouse or civil partner, providing they occupy theproperty as their only or principal home and can provide acopy of their marriage or civil partnership certificate.

The tenant’s partner (including non-heterosexual relationships),providing they occupy the property as their only or principalhome and can provide evidence that they have been livingwith the tenant for the last 12 months.

Any other member of the tenant’s family (for example, son,mother, aunt or nephew), providing they occupy the propertyas their only or principal home and can provide evidence thatthey have been living with the tenant for the last 12 months.

2. If you are in rent arrears or have other outstanding debts toNew Charter, we may refuse your application.

Before a decision is made, we will consideryour individual debt under our Debt Policyand Anti-Poverty Strategy.

3. If you are in breach of any of yourexisting tenancy conditions, anyapplication to create a joint tenancy willbe refused. However, you can reapply

once the breach is put right to oursatisfaction.

4. If there is a history of relationship breakdown between youand the person(s) you wish to create a joint tenancy with, wemay refuse your application.

5. We will refuse your application if you are overcrowding theproperty.

6. We will refuse your application if you are under-occupying theproperty by more than one bedroom.

7. If your current property is classed as“suitable for elderly residents only”,and the person(s) you wish to createa joint tenancy with does not meetthe necessary age criteria, we willrefuse your application.

8. Everyone who applies for a joint tenancy must be aged 18 orover. New Charter will considerapplications from minors aged 16 or 17providing it can be independentlyproven the joint tenancy isnecessary for the minor.

9. If the person(s) you wish tocreate a joint tenancy with doesnot qualify for accommodationunder our Allocations Policy, wewill refuse your application.

10.If the person(s) you wish to create ajoint tenancy with is not a U.K. resident and does not meet thehabitual residence test requirements, your application will berefused.
