SEC PROJECT NUMBER: 014057 DEA&DP REFERENCE NUMBER: NOT YET OBTAINED FROM DEA&DP Dear Mr Swiegers, Sillito Environmental Consulting (“SEC”) has been appointed by Chevron South Africa (Pty) Ltd to undertake anapplication for an Environmental Authorisation to reduce the total storage capacity for heavy fuel oil (“HFO”), at theKWV distillery on Erf 19426, Paarl from 156m3 to 46m3. The proposed development involves decommissioning the existing Chevron owned above ground storage tanks(“AST”) which include 2 x 23m2 AST’s and 1 x 110m3 AST and replacing them with one single tank (1 x 46m3 AST). The proposed activity triggers an activity listed in terms of the Environmental Impact Assessment Regulationspublished in 2010 in terms of the National Environmental Management Act (Act No. 107 of 1998) as amended. Theactivity in question is listed as follows: Government Notice R544 Activity 27 (v): The decommissioning of existing facilities or infrastructure for: (v) storage, or storage and handling, of dangerous goods of more than 80 cubic metres. As such, a Basic Assessment process is required to apply for authorisation of the proposed activity. As KWV Distillery is the registered landowner, you will be included in the database of the affected parties and so willbe given the opportunity to review and comment on the assessment reports produced for this application process.Public participation is anticipated to commence in approximately one month’s time. When the time comes for SEC to conduct a site visit on your property to assess the potential impacts, please would you indicate whether we may liase with Chevron or whether you would prefer that SEC liase directly with you as thelandowner of the site. The proposed activity triggers an activity listed in terms of the Environmental Impact Assessment (“EIA”) Regulations published in 2010 in terms of the National Environmental Management Act (Act No. 107 of 1998) as amended (“NEMA”). The activity in question is listed as follows: Government Notice No. R544 of 2010 Activity 27 (v)

The application process for Environmental Authorisation is a Basic Assessment process as defined in the NEMA EIA Regulations contained in Government Notice No. R543 of 2010.

Comments received from Cape Nature include the following: Historically Erf 19426 where the existing fuel tanks are

located was covered by Swartland Granite Renosterveld, which is considered to be a Critically Endangered vegetation type. The entire Erf however and most of the surrounding area, has been transformed and no natural vegetation remains.

The Critical Biodiversity Areas mapped to the east and west of Erf 19426 should not be there and are reflected as a result of mapping errors caused by issues of the scale at which the Drakenstein Municipality Critical Biodiversity Areas were mapped.

The BAR has adequately addressed monitoring requirements and emergency response plans and the tanks are noted as SANS compliant.

Cape Nature has no objection to the proposed fuel tank decommissioning and replacement at KWV Distillery on Erf 19426, Southern Paarl.

In an email dated 31st March 2015, SEC responded to Cape Nature as follows: SEC acknowledged receipt of Cape Nature’s comment on

the draft BAR. SEC noted that the CBA areas as indicated on the

Biodiversity Network Map are there in error. The final BAR will updated accordingly to reflect this information.

SEC noted that Cape Nature has no objection to the proposed development.

Comments received from the Drakenstein Local Municipality include the following: The position of the new aboveground storage tank should be

indicated in the final BAR. Additional mitigation measures should be included in the

final BAR and EMPr as follows:

Comments received from the Directorate: Pollution and Chemical Management include the following: A: The Directorate: Pollution and Chemical Management

acknowledged receipt of the draft BAR. B: The Directorate: Pollution and Chemical Management

noted that the intention of the proposed development is to reduce the Heavy Fuel Oil (“HFO”) storage at the site from 156 m3 to 46 m3.

C: The Directorate: Pollution and Chemical Management noted the tanks on site as 2 x 23 m3 and a 1 x 110 m3 which are for the storage of HFO (and are to be decommissioned) as well as a 2 m3 which is for the storage of waste oil prior to the removal of the waste oil from site (to remain on site). The Directorate noted that the 1 x 110 m3 has not been in use for 20 years.

D1: It is noted that an Environmental Conditions Assessment was conducted on site 30th April 2013 whereby the conclusion was that the site is not contaminated. According to the site layout plan, only one soil auger hole was drilled in each area and thus the conclusion that the site is not contaminated is considered to be premature. The

In an email dated 15th May 2015, SEC responded to the Directorate: Pollution and Chemical Management and Directorate as follows: SEC acknowledged receipt of the Directorate: Pollution and

Chemical Management’s comment on the draft BAR. With reference to point D2 and D3 of the Directorate’s

comment, Chevron confirms that they will conduct a follow up contamination assessment once the proposed activity has been completed and the results will be submitted to the DEA&DP and the Directorate. Should the site be found to be contaminated, Chevron confirms that they will comply with Part 8 of Chapter 4 of the NEMWA.

With reference to point D4 of the Directorate’s comment, Chevron confirms that the tanks scheduled for decommissioning are owned by Chevron.

With reference to point D5 and D6 of the Directorate’s comments, Chevron confirms that they will comply with the best practice decommissioning and degassing procedures as contained in Section E the BAR as well as the commitments made within the EMPr.

decommissioning of the tanks will provide an opportunity to conduct a more comprehensive assessment.

D2: It is noted that the results of the assessment do not exceed the Soil Screening Values of the National Norms and Standards for the remediation of contaminated land and soil quality of 2014 made in terms of NEMWA. As per comment D1, these results cannot be taken as conclusive proof and a follow up assessment to be conducted after the proposed decommissioning is advised. The results should be submitted to the Directorate for review.

D3: Should the results of the follow-up assessment confirm that the site is contaminated, Chevron SA will be required to comply with Part 8 of Chapter 4 of the NEMWA as outlined in Section E of these comments.

D4: Confirmation is required from Chevron with regards to the ownership of the tanks to be decommissioned.

D5: It must be ensured that best practice decommissioning and degassing procedures are undertaken and adhered to in order to avoid any soil and groundwater contamination impacts during the decommissioning of the tanks.

D6: Chevron SA must ensure compliance with the commitments made in the BAR and the EMPr.

D7: The applicable requirements of the Occupational Health and Safety (OHS) must be observed during the decommissioning and replacement phases.

D8: The decision to install the 46 m3 within the footprint area of the existing tank farm should take cogniscence and is subject to the outcome of the contamination assessment conducted for the site; and

E: The applicant must take note of the following requirements of Part 8 of Chapter 4 of the NEMWA:

E1: The Directorate must be notified of any contamination as soon as the applicant becomes aware of significant land contamination on site via a “Notification of Contaminated

Following the reporting of such an incident, the applicant must comply with Section 30 to deal with the incident and submit the report to the Department, the National DEA and the Municipality to allow an initial evaluation of the incident; and

SEC has requested Chevron’s Emergency Response Plan for the site. This will be included as an addendum to the final EMPr which will be submitted with the final BAR submission to the DEA&DP.

SEC confirms that proof of site notice placement, the advert placed in the local newspaper and the registered letters delivered to all I&APs along with copies of comments received and responses sent as well the Comments and Responses Report will be included with the final BAR. Good afternoon Simon,   SEC has received the Directorate: Pollution and Chemical Management’s (D:PM) comment on the draft BAR for the  proposed decommissioning and replacement of fuel tanks at the KWV Distillery in Southern Paarl.   Please see SEC’s response to the D: PM’s comments below.   

SEC has noted the contents of the D:PM’s comments.  

With reference to point D2 and D3 of the Directorate’s comment, Chevron confirms that they will conduct a 

follow up contamination assessment once the proposed activity has been completed and the results will be 

submitted to the DEA&DP and the Directorate. Should the site be found to be contaminated, Chevron confirms 

that they will comply with Part 8 of Chapter 4 of the NEMWA.  

With reference to point D4 of the Directorate’s comment, Chevron confirms that the tanks scheduled for 

decommissioning are owned by Chevron. 

With reference to point D5 and D6 of the Directorate’s comments, Chevron confirms that they will comply with 

the best practice decommissioning and degassing procedures as contained in Section E the BAR as well as the 

commitments made within the BAR. 

With reference to point E and F of the Directorate’s comments, SEC confirms that Chevron has taken note of the 

requirements of Part 8 of Chapter 4 of the NEMWA as well as the requirements of Section 30 of the NEMA.

Good morning Cindy,   SEC received the Drakenstein Municipality’s comment on the draft BAR for the proposed development at KWV Distillery, Paarl, thank you.   The applicant has advised that the new tank will take the place of the tank still in service (1 x 23 HFO located within its own bund on the southern portion of the site). The new tank (not Chevron owned) will be located close to the existing in service tank but not in exactly the same position on site. SEC will request the exact location of the new tank on site and update the Site Map (014057/1) and Locality Map (014057/2) accordingly to reflect this. The updated maps will be included in the final BAR.   With regards to the Drakenstein Municipality’s additional conditions as per the attached comment, SEC will incorporate these conditions into the final BAR and final EMPr where applicable. The updated EMPr will be included in the final BAR.   I trust this is in order? Should the Drakenstein Municipality have any further queries at this stage, please     Warmest regards,

1. Historically, Erf 19426 where the existing fuel tanks are located was covered by Swartland Granite Renosterveld, which is considered to be a Critically Endangered vegetation type. However, the entire erf and most of the surrounding area has been transformed and no natural vegetation is remaining (note that the Critical Biodiversity Areas mapped to the east and west of Erf 19246 should not be there and are due to mapping errors caused by the issue of the scale at which Drakenstein Municipality Critical Biodiversity Areas were mapped).

2. The assessment report has adequately addressed monitoring requirements and emergency response plans and the tanks will be SANS compliant.

3. CapeNature therefore has no objection to the proposed fuel tank decommissioning and replacement at KWV distillery on Erf 19426, Southern Paarl.
