(For works costing less than Rs 15 Crores) HQ Chief Engineer Jalandhar Zone, Jalandhar Cantt- 144005 on behalf of the President of India invites E-tenders (on line in two cover system) from eligible enlisted contractors of MES and enlisted/ un-enlisted contractors working with other Govt./ semi Govt. departments meeting eligibility criteria for selection of contractors for issue of tender of under mentioned work:-

1. Name of work : Widening of approach road to 2 ASD Kasubegu From JN on Ferozepur to Gate 06 of 02 ASD Kasubegu under GE (East) Ferozepur Cantt

2. Estimated cost : Rs. 135.00 Lakhs at par market rate

3. Period of completion : 180 days

4. Cost of tender documents : Rs. 1000/- in the shape of Demand Draft/ Banker’s Cheque from any Nationalized/ Scheduled Bank in favour of Garrison Engineer (East) Ferozepur Cantt and payable at Ferozepur.

: The tender shall be based on item rate (IAFW-1779A) and General Condition of Contracts (IAFW-2249) with Sch ‘A’ (BOQ) and the bidder to quote rates of items in BOQ.

8. Eligibility criteria :-

(a) For MES enlisted contractors : All contractors enlisted with MES in Class ‘B’ and above and Category ‘a(i)’ shall be considered qualified provided they do not carry any adverse remarks in work load return of competent engineering authority.

(b) For Un-enlisted contractors : (a) The firms not enlisted with MES shall meet the enlistment criteria of ‘B’ class MES contractors and category ‘a(i)’ i.e. with regard to having satisfactorily completed requisite value works, annual turnover, solvency, working capital, immovable property/ fixed assets, no recovery outstanding in any Govt. department, police verification/ Passport etc. Enlistment criteria may be seen in para 1.4 of Section 1 of Part-I of MES Manual on Contracts- 2007 (Reprint 2012) as available in all MES formations.

(b) These firms shall also submit copy of police verification from police authority of the area where the registered office of the firm is located/ notarized copy of valid passport of proprietor/ each partner/ each Director.

(c) They should not carry any adverse remarks in WLR/ or any other similar report of any authority.

(c) For all contractors : Contractor will not be allowed to execute the work by subletting or through power of attorney holder on his behalf to a third party/ another firm except sons/ daughters/ spouse of proprietor/ partner/ Director and firm’s own employees, Director, Project Manager. This shall be subject to certain conditions which will be prescribed in the Notice of Tender forming part of the tender documents.

NOTES :- (a) (i) Normally the application from contractor enlisted in eligible class only shall be considered.

(ii) Contractor one class below may also bid for this tender. Their application shall be considered subject to fulfillment of other eligibility criteria given in NIT when number of applicants of eligible class qualifying for the tender are less than 7 (seven).

(iii) Applications from two class below eligible class contractors may be considered in the event of inadequate response from the applicants of eligible class and one class below eligible class taken together (less than seven) provided their past performance has been satisfactory and in the opinion of Accepting Officer they are considered capable of handling this work.

(iv) In case number of eligible class contractors satisfying the eligibility criteria given in NIT are 7 or more than 7, application of one class below the eligible class shall not be considered except those who have previously completed similar works satisfactorily and are meeting the criteria of upgradation in respect of past experience or average annual turnover and financial soundness (solvency/ financial soundness and working capital) provided the value of work is less than twice the tendering limit of such contractors. Contractors one class below the eligible class may upload necessary documents wrt works experience and financial soundness in cover 1 of tender (T bid). The details of eligibility of such one class below contractor(s) shall be same as for unenlisted contractor(s) given here-in-after.

(v) Contractors enlisted in one class/ two class below eligible class shall submit the documents such as details of three highest value similar nature works executed during last 05 years, solvency and working capital certificate, Annual turnover certificate for last two years in the manner prescribed for un-enlisted contractors here-in-after in support of their capability to execute the subject work, to enable Accepting Officer take a considered decision as per departmental policy.

(vi) Contractors may note that they shall not be loaded beyond their tendering limit as under :-

(aa) In case contractors of eligible class are selected for issues of tender : 4 to 5 times the tendering limit.

(bb) In case of one class below eligible class contractors are selected for issue of tender : 6 to 7 time

(cc) In case of un-enlisted contractors : 2 times the upper tendering limit of class for which contractor meets the criteria for enlistment.

(b) Contractors enlisted with MES will upload following documents (scanned copy in pdf format) for checking eligibility:-

A. (Cover 1)

(i) Copy of application for issue of tender on letter head of company/ firm.

(ii) Copy of valid enlistment letter showing class & category of enlistment.

(iii) Coloured copy of Demand Draft/ Banker’s Cheque of requisite value as per details & amount indicated.

(iv) The applicant/ firms/ Co shall submit the copy of power of attorney/ other documents to exhibit that the person signing the application can bind the firm/ Co. for all actions taken by him on behalf of the firm/ Co.

(v) Copy of Provident Fund Code Number issued by Employees Provident Fund Organisation.

(vi) Scanned copy of Registration of Goods and Services Tax (GST) registration No.

(vii) Scanned copy of Registration under Employees’ State Insurance Act 1948

(viii) Copy of any other documents which the bidder feels relevant.

B. (Cover 2)

Bill of quantities (BOQ) (price/ financial Bid) shall be uploaded by bidder duly digitally signed in excel sheet (.xls) format between the duration (time) allowed for bid submission

Notes :

(i) The price Bid/ BOQ of those contractors who are considered technically qualified as per their documents in cover-1 & 2, shall only be opened.

(ii) Bidders to upload their updated priced BOQ of the tender.

(iii) The tender shall quote his rate on the BOQ file only. No alteration to the format will be accepted else the bid will be disqualified.

(c) Contractors not enlisted with MES will be required to upload necessary documents to prove their eligibility for enlistment in eligible class & category of work. List of documents required for enlistment in MES has been given in Para 1.5 of section 1 of Part I of MES Manual on Contracts 2007 (reprint 2012). A. (Cover 1)

(i) Copy of application for issue of tender on letter head of company/ firm.

(ii) Coloured copy of Demand Draft/ Banker’s Cheque of requisite value as per details & amount indicated.

(iii) Coloured copy of Earnest Money Deposit in the shape of call Deposit Receipt of requisite value.

(iv) The applicant/ firms/ Co shall submit the copy of power of attorney/ other documents to exhibit that the person signing the application can bind the firm/ Co. for all actions taken by him on behalf of the firm/ Co.

(viii) Copy of application of enrolment as Contractor on IAFW-2190 (Photographs affixed on Application shall be got attested by any Government Gazette Officer).

(ix) Details of three highest valued similar nature of works executed during last five years, financial year-wise in tabular form giving name of work, Accepting Officer’s details, viz, Address, Telephone, Fax No, E-mail ID etc, date of acceptance of tender and actual date of completion. This shall be duly signed by proprietor/ all partners/ authorised Director of Pvt/ Public Ltd, as applicable. It should indicate whether extension was granted or compensation was levied. Attested copy of acceptance letter and completion certificate shall be enclosed of each work. In case performance report has been given by the client same shall also be submitted duly attested.

(x) Copy of annual turnover certificate from CA/ Income tax deduction at source (TDS) certificates (26AS) in support of annual turnover during last 5 years.

(xi) Copy of balance sheet of last 5 years in case of Limited Companies.

(xii) Copy of affidavit for immovable property with total of Movable or Immovable Property having current market value of Rs. 60.00 Lakhs (80% of assets shall be in shape of immovable property) and containing following endorsement :-

(a) That the immovable property is free from mortgage, hypothecation or any other disputes and encumbrances and clearly belongs to the contractor.

(b) That the said immovable property has not been shown for seeking enlistment of a sister concern in MES.

(c) That the said immovable property will not be sold, transferred, gifted or otherwise disposed off without prior intimation to the registering authority in MES. While giving such prior intimation, new affidavit for alternate immovable property of value at least equal to minimum requirement as per scale alongwith valuation report from Registered valuer shall also be submitted; failing which the Registering Authority may declare the contractor unenlisted or may take action as deemed fit till acquiring alternate immovable property by the contractor.

Note : In case of partnership firm, the partner having immovable property in his name shall also endorse the following in addition to above “Irrespective of my share in partnership firm my whole property may be utilized by the Government for realizing their dues/ recoveries if the firm fails to deposit the same

(xiii) Copy of valuation report from Registered (with any Government body) valuer for immovable property clearly indicating ownership details. Alternatively the Contractor may submit certificate from the Deputy Commissioner/ Collector/ First Class Magistrate or assessment of wealth tax authorities.

(xiv) Coloured CTC copy of solvency and working capital certificate from scheduled bank

indicating that the bidder is solvent upto Rs. 1.00 Crores OR financially sound for engagement upto Rs. 3.00 crores and having working capital not less than 12.00 Lakhs.

Note : Above certificates shall not be older than 6 months as on date of submission of Bid. Signatory shall endorse his rubber seal, indicate his name & bank employee number, bank address, particulars like full address, telephone & fax number.

(xv) Copy of affidavit that no Govt. recovery is due against the firm.

(xvi) Copy of affidavit that contractor is not involved in Arbitration/ Court cases.

(xvii) Copy of affidavit that the applicant firm is not black listed or banned by any Govt.

(xviii) Copy of valid passport duly notarized or police verifications of each of the director/ partner or proprietor of company/ firm from police authority of the area where the registered office is located. Contd...4/-

(xix) Copy of performance report of work done by bidder issued by the concerned appropriate authority.

(xx) Copy of list of work in progress as on date of submission of bid as per format given in tender.

(xxi) Constitution of firm on an affidavit duly notarized indicating status of firm, i.e. whether it is proprietorship or partnership or Limited firm.

(xxii) Certified copy of Certificate of registration of firm with Registrar of Companies for partnership firms and certified copy of memorandum of articles for Pvt Ltd. Companies.

(xxiii) Certified copy of PAN No. /TIN No. of proprietor / partners/ firm.

(xxiv) Indemnity Bond on non-judicial stamp paper of value of Rs. 200/- duly attested by Notary (on format given below):-

1. We undertake to pay the Government of India any damages that may be

found to be recoverable on order of our contracts.

(xxv) Copy of an affidavit affirming that all the information and details furnished are true and the bidder may be liable for suitable administrative and legal action in case the information and details are found to be false/ incorrect.

(xxvi) Copy of affidavit that there is no relationship with any Gazetted/ Commissioned Officers and JEs in MES/ Corps of Engineers/ Ministry of Defence. In case of relation the same shall be disclosed with details.

(xxvii) Copy of any other documents which the bidder feels relevant.

Notes :

(i) All the affidavit should be on stamp paper of Rs100/- duly Notarized.

(ii) All the affidavit and other documents must be signed by Proprietor/ all partners/ authorized director of Pvt/ public Ltd firm as applicable.

(iii) All the affidavits, solvency and working capital certificates in original alongwith copies of other documents as above shall reach this HQ within seven days of bid submission and date.

B. (Cover 2)

Bill of quantities (BOQ) (price/ financial Bid) shall be uploaded by bidder duly digitally signed in excel sheet (.xls) format between the duration (time) allowed for bid submission.

(d) (i) Application/ bids not accompanied by scanned copies of requisite DD/ Bankers Cheque towards cost of tender and earnest money (as applicable) shall not be considered for validation of ‘T’ bid and their finance bids will not be opened.

(ii) Tenders/ bidders to note that they should ensure that their original DDs and earnest money (as applicable) are received within seven days of bid submission end date.

(iii) In case of applications/ bids from enlisted contractors of MES, where scanned copies of requisite DD/ Bankers Cheque towards cost of tender has been uploaded but physical copies are not received by the stipulated date, finance bids will be opened. However non-submission of physical copies of cost of tender shall be considered as willful negligence of the bidder with ulterior motives and such bidder shall be banned from bidding for a period of six months commencing from the date of opening of finance bid.

(iv) In case of application/ bids from un-enlisted contractors, where scanned copies of requisite DD/ Bankers Cheque towards cost of tender has been uploaded but physical copies are not received by the stipulated date, finance bids will not be opened. Name of such contractors alongwith complete address shall be circulated for not opening of their bids for a period of six months commencing from the date of opening of finance bid.

(v) In case of applications/ bids (enlisted contractor as well as unenlisted contractor) where scanned copies of requisite Earnest money (as applicable) were uploaded but the same are not received in physical form within stipulated time, such bids shall not qualify for opening of finance bid.

(e) In case of rejection of technical/ prequalification bid, contractor may appeal to next higher Engineer authority i.e. HQ Chief Engineer Western Command on email ID dydrcontceengrcl-mes@gov.in against rejection, whose decision shall be final and binding. However, Contractor/ bidder shall not be entitled to any compensation whatsoever for rejection of technical/ prequalification bid

(f) The applicant contractor should have provident fund code Number (PFCN) issued by EPFO and the same shall be uploaded alongwith other documents with ‘T’ bid (Cover-1) .Contractor not in possession of Provident Fund Code Number shall be disqualified in ‘T’ bid evaluation and his financial bid shall not be opened.

(g) Any change/ modification in the tender enquiry will be intimated & updated through above mentioned website only. Bidders are therefore requested to visit our website regularly to keep themselves updated.

(h) Court of the place from where tender has been issued shall alone have jurisdiction to decide any dispute out of or in respect of this tender. After acceptance of tender, Condition 72- Jurisdiction of Courts of IAFW-2249 shall be applicable.

(j) Full notice of tender IAFW-2162 & enlistment criteria are available in all offices of MES and also on MES website.

(k) This appendix shall form part of contract documents.
