2. We have not been furnished with an actual up-to-date survey of the land .under examination made by a civil engineer or surveyor. However, for the purpose of computing interest of the parties in production attributable to the Tracts and from the Units, you have asked ·us to assume that the Northwest Quarter of the South-east Quarter (NW 1/4 of SE 1/4)of Section 21, Township 14 North, Range 5 west contains 3 acres and 24 acres_, respectively . ·

By virtue of an instrument dated February 3, 1904, and with out the concurrence of' anyl of' his co-owners, he conveyed to his then wife, MOLLIE WASHINGTON, by a cash deed, the following_ describedtract of land:

Three ( 3) acres of land, now owned by Granter ( C . N. WALTON)located on tne south side of the five-acre tract previously sold to purchaser• (MOLLIE WASHINGTON) in the NW Cor.of the NW 1/4 of SE 1/4, Sec. 21, T-14M, R-5-W,

the consideration being recited as $100.00 in cash paid, ·with c.N. WALTON reserving the oil, gas and lease rentals under the then ex isting lease . This deed could not have carried more than WALTON 'S theninterest in the land, if valid, but we believe it is an absolute nullity and may be overlooked by third persons dealing on the record since a husband cannot contract with his wife except in enumerated cases ofwhich this is not one.

'.i'he mineral lease executed by c.n.WALTOir on 11.ugust 29, 1969 covers this three-acre tract of land; ·therefore, you may consder the same as a valid.lease

The sale of a 10/24th interest in the oil, gas and other minerals by c.N .WALTON to J.o.EVANS dated April 5, 1967 did not . include this three-acre tract, and this alone accounts for there beingtwo separate tracts in the property under examination.

IREQUIREMENT: None, but note the above which is

furnished for your -information.

4. The details of.the oil, gas and mineral leases covering the property under examination are set forth in our Opinion No. 2 - First Supplemental and Final Title Opinion, dated April 30, 1973, and the same will not again be repeated but we refer you thereto. How ever, we would call your attention to the following in connection with said leases:

(l) Lease IA-2200C dated September 23, 1969 was exe cuted by MYRTLE BIANKENSHIP but she died intestate during.the year 1972 and her.7/48th interest in the land under examination was inherited in equal proportions by her six hildren.

(2) The l0/24th interest in the minerals in the pro perty described as TRACT NO.II is subject to an oil, gas and mineral lease daed August 17, 1972,executed by J. o. EVANS in favor of FRANKSPETROLEUM, INC., which lease provides for a·l/4th royaltr instead of the usual 1/8th royalty.

(3) EVA WALTON WILLIAMS is the owner of ajl 7/48th .'interest in the whole of the property under exam- . ination and according to our records she has not executed an oil, gas and mineral lease coveringthe same. ·

We have been furnished with a copy of the operating agreement xccuted by FRANKJ3 PETROLEUM, INC., BODCAW COMPANY and others covering the Hosston A, B and C Zones composed of Section ?.l, To'l-mship 14 North,Rance 5 ;7est, anrl on that basis we have been informed by your office · that the unleased mineral interest is to be carried by }'ranks Petroleum, Inc.in the proportion of 84.8675% and by- Bodcaw Company- in the propor tion of 15.1325%. Also, despite the fact that Franks P.etroleum, Inc. is the owner of recorr of the lease covering the 10/24th mineralinterest owned by J.o.Evans, the same is to be considered as

5. The ·Department of Conservation, State of Louisiana., issued Order No. 729-B-4, effective August 1, 1972, establishing additional units for the Hosston A, B and C·Zones in the Danville Field, Bien ville Parish, Louisiana, as such zones were defined in Order No• .729-B defining said zones. The units so established were 640-acre units composed of regular governmental sections, Section 21, T-14N, R-5-W, in which the property under examination is located, being the unit for the Hosston A Zone (SU-JJ), the Hosston B Zone (SU-II)and the Hosston C Zone (SU-JJ).

We have been informed that the Franks-Logan Walton A-1 Well of the Danville Field, Bienville Parish, Louisiana,

located upon the above referred to unit which includes the whole of the property under examination, has been drilled to and completed in one or more of the Hosston Zones as defined in said Order, and was shut-in.on November 15, 1973 awaiting pipeline connections .

In the event this opinion is used for payment for production, then tlie division order should be limited to the Hosston Zone or Zones from which the well is producing.
