APA News Update Winter/Spring 2012 Statutory Regulation Time Schedule The proposed legislation for statutory regulation will be published in spring this year followed by a public consultation lasting three months. It is anticipated that the legislation will go through parliament by the end of 2012. It will then take another six to nine months to set up the register, which is scheduled to be operational by summer 2013. Expected Standards In January 2012 executive directors from APA and BAAAP had a meeting with Michael Guthrie from the Health Professions Council (HPC), who is in charge of coordinating the transfer of practitioners supplying unlicensed herbal remedies from voluntary to statutory regulation. Michael Guthrie pointed out in the meeting that any association that wants to transfer its membership en bloc to the HPC needs to be robust and comply with expected standards. Most of these standards are detailed in the Pittilo Report (2008) and have been implemented by the APA already. They include standards of proficiency, ethics and conduct, disciplinary procedures, CPD etc. Together with our partners in the EHTPA, we are currently working on final details for getting ready for HPC audit and, subject to approval, transfer of membership to the HPC when statutory regulation commences in 2013. Professional Associations The HPC confirmed that any currently existing associations representing one profession do not have to merge prior to HPC registration in 2013. Michael Guthrie assured APA and BAAAP that there is no need to create a unified voluntary register or an umbrella organisation in order for Ayurvedic practitioners to be transferred to the HPC. Any existing associations will be audited individually and, subject to approval, have their membership transferred to the HPC. Registration Expenses Practitioner members of an HPC-approved association will transfer directly to the HPC register and only pay the annual registration fee of currently £76. Practitioners who are not members of an approved association have to individually apply with a detailed portfolio and pay £420 for the application. Practitioners who wish to avoid this expense should register as soon as possible with one of the two bodies that have been preparing in the last years for HPC audit: APA and BAAAP. There are no other Ayurvedic associations in the UK fit to qualify for HPC approval in 2013, because the minimum expected time of uninterrupted operation prior to HPC audit is stipulated as five years. Grandparenting The start of the statutory register will be followed by a ‘grandparenting’ period of two years during which non-member practitioners can individually apply for HPC registration. Thereafter, only graduates from UK-recognised degree courses that follow the EHTPA core curriculum will be able to register. This means that after 2015, BAMS or similarly qualified practitioners from overseas will have to apply for HPC registration via the so-called ‘international route’, which is likely to involve tests of competence and language proficiency. Criminal Records Bureau (CRB) Checks The APA has been assured by Michael Guthrie that CRB checks are not a standard expected of associations for HPC approval. Therefore, the APA executive committee has decided not to introduce mandatory CRB checks as part of the APA membership criteria. Protected Title No decision has been made yet as to the protected title that HPC-registered practitioners will be entitled to use. This and other remaining details will be finalised in the coming months. Statutory Regulation

Time Schedule The proposed legislation for statutory regulation will be published in spring this year followed by a public consultation lasting three months.

Representing Ayurvedic Practitioners throughout the United Kingdom

Call for APA members to contribute to LOAJ
