SUPPLEMENTARYReport #: 1200002824 - 000041 67We advised all of the neighbors outside to go into their houses. Several neighbors listened and went inside but others did not do so. There werealso parties outside on the sidewalk with two small dogs near the intersection of Judson Place and Cottage Street. Officer Diaz removed a snarefrom his patrol vehicle to attempt to calch the dog.

The rcar yard of 34 Judson Place had what appeared to be six foot fences on both sides that extended fom the back corneG of the houselo a rear stone wall which was slightly shorter than the fences. The white pitbull was able to jump up and down the stone wafl with ease. Abovethe stone wall was a large dirt hill v{here the dog continued to run from side to side. When I began to walk toward the backyard on the North sideof the residence. The wlrite pitbull came charging towards me and was barking aggressively. I backed off of the yard and stepped back into thestreet. The dog stopped on the grass as I pulled out my department issued HK USP 45 pistol Sgrial #25-109079. The dog continued to act in anaggressive manner lowards mysef and the other ofiiceF on scene. Fle would continue to run back and forth to both sides of the residence andbehind the neighboring houses as well. Each time we attempted to approach the dog, it would charge at us barking and growling. lt did notappear as though there was any way to apprehend the animal due to its extremely aggressive behavior and the dog was clearly not contained inthe yard in any way. Based upon the actions of the dog, I knew that myself and my fellow officers were at risk of being atlacked by the dog. O{herarea residents that were outeide of thg yards were alao at risk and I deemed it necessary to dispatch the dog. I waited until the dog stopped in alocation in the front yard where lhere was a safe backstop to discharge my pistol. The dog stoppd on the grass in front of the residence to theright of the front concrete sidewalk and steps. There was a small hill in the front yard which was able to ac1 as a safe backstop. I was standing inthe street behind a patrol vehicle almost straight oul from where the dog was standing. When the dog slopped iri the safe location, I fired oneround al the dog striking it in what appeared to be in the shoulder area. The dog immediately tumed and ran behind the residence and lhennorthbound behind the residence&., Officer-l-oschiavo and lattempted-to follow behind the.dog.- Sergeant. tterry anived. on scenet that timeandlocated the dog after it had tumed bac* southbound and ran towards Cottage Street. Sergeant Henry advised us that the dog went into the woodsbehind the churches on South Cliff Street headed towards East Main Street.

Officer Loschiavo, Officer Diaz and I drove to East Main Street. I located the dog southbound on East Main Street. The dog slo$/ed downand ran onto a steel stairway in the corner of the loading dock aIea of the building. The dog laid down on the landing of the stairway. Due lo thesurounding stlucture, it was unsafe to attempt to dispatch the dog. Sergeant Henry arrived on East Main Streel. Officer Oksenberg and OfiicerDiaz closed East Main Street between State Street and Kingston Avenue. While waiting to see what the dog was going to do next, dispatchadYised me that lhe viclim called from Grifiin Hospital with further details. The viclim, later identified as Steed Kaliszewski, stated that he hadbeen watching the dogs at 34 Judson Place and was attacked by the grey pitbull with the white face and blue eyes. Officer.l-oschiavo advised methat she had seen a dog matching that description in th6 back yard of 34 Judson Place when we were al lhe residence. steed stated that theME: NOTARYYRhtd
