It is further stated that the appellant approached the respondent no.2 for allotment of office unit with Leasehold rights in Local Shopping Complex (LSC) built and developed by respondent no.2, DDA vide letter dated 22.01.1979, pursuant to which respondent no.2 allotted two office units / shops no. 6 & 7 to the appellant in Local Shopping Complex C-4/E, Janak Puri, New Delhi vide allotment letter bearing No. F-1(262)/78-IMPL dated 03.02.1979 on lease hold basis.     Ld. counsel for respondent seeks time to file status report

    1. This is an appeal filed against the order of demolition

    dated 17.02.2020. Ld. counsel for appellant has pressed

    the application for ad-interim stay on the ground that

    otherwise the appeal will become infructuous.

    2. The submissions made are that the appellant is a Co-

    operative Bank and is running its Banking functions since it

    was established in the year 1969. It is further stated that in

    order to start a branch in Janak Puri, New Delhi, the

    appellant approached Reserve Bank of India (RBI) for

    necessary permission pursuant to which permission was

    granted by RBI to open a branch at Janak Puri, New Delhi.

    It is further stated that the appellant approached the

    respondent no.2 for allotment of office unit with Leasehold

    rights in Local Shopping Complex (LSC) built and

    developed by respondent no.2, DDA vide letter dated

    22.01.1979, pursuant to which respondent no.2 allotted two

    office units / shops no. 6 & 7 to the appellant in Local

    Shopping Complex C-4/E, Janak Puri, New Delhi vide

    allotment letter bearing No. F-1(262)/78-IMPL dated

    03.02.1979 on lease hold basis. It is further stated that

    stated that the appellant thereafter approached respondent

    no.2 to remove the partition wall in between the office units

    6 & 7. The DDA vide letter dated 06.04.1979 acceded to

    the said request of the appellant, subject to the condition not

  • to damage the building. It is further stated that the appellant

    thereafter vide registered sale deed dated 06.01.2006

    purchased office units shop no.5 adjoining units No. 6 & 7.

    It is also stated that the appellant has been regularly paying

    house-tax of all the units and the temporary structure

    construction raised upon the units 5, 6 and 7. It is further

    stated that in August, 2019, the appellant received a notice

    u/s. 343/344 of DMC and thereafter received another notice

    u/s. 345A of DMC Act dated 28.10.2019. The appellant had

    filed reply to the said notices. It is also stated that no illegal

    construction has been carried out by the appellant in the

    said units. The entire office units and temporary structures

    above the said units have been assessed to property tax by

    respondent no.1 since decades. It is further stated that the

    as office / units in question are situated in the LSC

    developed by respondent no.2 as such no demolition can be

    done by respondent no.1 in the said market without the

    consent of respondent no.2. It is also stated that respondent

    no.1 has never raised any objection to the temporary unit

    prior to09.08.2019. It is also stated that the application for

    regularization of the temporary structure is pending before

    the appropriate authority.

    5. Heard, keeping in view the submissions made and

    documents filed by appellant and as time is sought to file

    status report and record, in my view appellant has made out

    the case for grant of ad-interim interim stay. Respondent is

    restrained from taking demolition action in the property in

    question bearing no. shop no. 5, 6 and 7,LSC Market,C-4/E,

    Janak Puri, New Delhi pursuant to impugned order dated

    17.02.2020 till next date of hearing.

    6. However, this order is subject to any order passed by

    the Hon’ble Supreme Court / Hon’ble High Court / Hon’ble

    NGT about sealing and demolition in respect of the property

    in question.

  • 7. Appellant is directed to file affidavit giving details of

    construction with measurements of the existing construction

    alongwith existing site plan and photographs of the property

    in question within five working days, failing which stay order

    granted shall deemed to be vacated.

    8. Copy of the affidavit will be provided to concerned

    AE(B) by the appellant, who shall verify whether details of

    construction mentioned in the affidavit is correct or not.

    9. Appellant is also directed not to carry out any

    addition, alteration, repair or construction and shall also not

    create any third party interest in the property in question.

    10. Be listed for filing of status report and record on

    23.10.2019 interim protection was granted to the appellant in

    Appeal No. 614/19 filed against the order or sealing dated

    24.07.2018. Respondent was restrained from taking coercive

    action in the property in question. It is further stated that due to

    typographical error, the date of impugned sealing order

    mentioned in the order dated 23.10.2019 was 26.06.2018

    instead of 24.07.2019. The respondent has therefore, sealed the

    property of the appellant on 17.01.2020. It is also stated that

    necessary corrections were made in the order dated 23.10.2019

    in appeal No. 614/19 regarding the date of impugned order on

    20.01.2020 but till date the property has not been desealed.

    I have heard the Ld. counsel for parties.

    It is submitted on behalf of respondent that property would

    be desealed till further orders in compliance of orders dated

    23.10.2019 and 20.01.2020.
