The Purpose of WIC

The WIC Program is a federally funded nutrition program that delivers important services to low income pregnant and postpartum women infants and children up to the age of five who are at nutritional risk These services include the provision of nutritious foods guidance on nutrition and breastfeeding and referrals to health care and community services WIC strives to prevent health problems and to improve participantsrsquo health during critical times of growth and development WIC provides food instruments (FIs) also known as coupons vouchers or checks to purchase nutritious foods from WIC authorized vendors

WIC Food List Database

CDPHWIC maintains a database of foods that have been determined to be eligible for purchase by WIC participants per federal and state regulations The California WIC Food List Database is a supplement to the WIC Authorized Food List Shopping Guide (WAFL SG) and is sorted by food category to help participants and vendors identify WIC eligible foods In addition to being sorted by food category the California WIC Food List Database identifies food brand package size UPC and other relevant information The California WIC Food List Database is split into two subgroups Brand Specific Foods and Non‐Brand Specific Foods For Non‐Brand Specific Food categories a product does not need to be included in the California WIC Food List Database to be eligible for purchase mdash the only requirements for eligibility and purchase are that the foods must meet the eligibility requirements listed in WIC Bulletin Regulations (WBR) section 82000‐83000

The WIC Authorized Food List Shopping Guide (WAFL SG) is the educational document that outlines the requirements for supplemental foods authorized by WIC Bulletin Regulations (WBR) section 82000‐83000 The most recent publication is dated March 28 2016 and is available in both English and Spanish We recommend that you keep a copy at each register to look at during WIC transactions

DID YOU KNOW

Yogurt is now authorized If printed on the FI WIC shoppers may choose from plain vanilla and strawberry yogurt in 32 oz containers The WIC shopper must purchase the fat level printed on the FI See the March 28 2016 WAFL SG for a list of authorized brands products and cannot buys

Whole Wheat Pasta is now authorized WIC shoppers may choose from organic and non‐organic in 16 oz packages See the March 28 2016 WAFL SG for a list of authorized brands and products and cannot buys

WIC foods are carefully selected to meet nutritional requirements for WIC participants Substituting WIC authorized food items for non‐WIC authorized items is not allowed

Infant Formula

The Infant Formula Food Instrument

The Infant Formula FI is the only WIC FI that requires the WIC shopper to purchase the full quantity brand product name type and size printed on the FI

Once purcased WIC shoppers are not allowed to exchange WIC formula for another brand product name type or size If the WIC infant formula was expired when purchased from the store the WIC shopper can return it for a replacement of the same type

Purchasing Infant Formula

WIC authorized vendors may only purchase infant formula from wholesalers

verify that wholesalers distributors and retailers have a valid sellerrsquos permit in California go to the Board of Equalization website at httpsefileboecagovboewebservicesverificationjspaction=SALES

You can also purchase infant formula directly from one of the following manufacturers Nestle USA Mead Johnson and Company Nutricia North America PBM Nutritionals Solus Products LLC and Abbott Laboratories

As a WIC authorized vendor you are required to stock the WIC authorized foods and quantities listed in WIC Bulletin Regulation (WBR) section 71100

These minimum stocking requirements ensure WIC participants have access to the foods they need while shopping at your store WIC foods included in the minimum stocking requirements must be stocked in

full quantities at all times in a public area All WIC foods included in the minimum stocking requirements must be available at the store Products on order that have not been delivered do not count toward the minimum stocking requirements

Successful WIC Transactions

8 Steps to Conduct a WIC Transaction There are 8 easy steps to the WIC checkout procedure Here is a quick review

1 Request the WIC ID folder from the WIC shopper and check for a signature on the front

2 Ask for the Food Instrument (FI) being used in the transaction

3 Check the ldquoFirst Day to Userdquo and ldquoLast Day to Userdquo printed on the FI

4 Group the WIC foods by the FIs listing those foods Check for authorized foods and correct quantities

5 Enter the exact purchase price on each FI

6 Ask the WIC shopper to sign each FI

7 Compare the shopperrsquos signature on the FI with the signature on the WIC ID folder

8 Give the WIC ID folder and receipt to the shopper

WIC wants to thank you for providing WIC shoppers with excellent customer service A positive shopping experience is what keeps WIC shoppers coming back to your store

Security Features

If a WIC FI is photocopied VOID will appear on the copied FI

A thermochromic WIC logo on the back of a WIC FI will turn transparent when pressed with a warm fingerthumb

Artificial watermarks on the back of a WIC FI can be viewed at any angle or by using a black light

VWIX will indicate if a WIC FI is invalid or stolen

Food Instruments (FI)

With the exception of Infant Formula WIC shoppers are not

Cash Value Vouchers (CVV)

The WIC CVV works just like any other WIC FI except that it may only be used for the purchase of authorized fruits and vegetables

If the total dollar amount of the item(s) being purchased exceeds the dollar amount printed on the WIC CVV the WIC shopper can pay the difference

No change is given if the purchase amount is less than the dollar amount printed on the CVV

Peer Groups B and C

Vendors in peer group B and C are allowed to offer promotionsdiscounts to WIC shoppers as long as the promotionsdiscounts are equally offered to non‐WIC shoppers Examples of allowable promotionsdiscounts are buy oneget one free offers andor manufacturer or store coupons

WIC was formally created by an amendment to section 17 of the Child Nutrition Act of 1966 on September 26 1972

WIC Changes in 2016 Regulatory Bulletin 2016-01

On August 3 2016 CDPHWIC adopted amendments to WBR section 60300 Rules for Calculating the Maximum Allowable Department Reimbursement Rate The Final Action became effective September 7 2016

Regulatory Bulletin 2016-02

On July 11 2016 CDPHWIC adopted amendments to WBR sections 70100 Business Integrity and 70500 Circumvention of WIC Sanction The Final Action became effective August 15 2016

On December 31 2015 CDPHWIC adopted an amendment to California WIC Authorized Food List regulations which details the requirements for CDPHWIC authorized foods The amendment resulted in a new WAFL SG that went into effect March 28 2016 and includes changes to many food categories such as milk eggs soy tofu canned fish whole grains breakfast cereal fruits and vegetables infant cereal infant fruits and vegetables and infant meats

Additionally yogurt was added as a new food category

On December 31 2015 CDPHWIC adopted an amendment to regulations for the WIC Authorized Food List which details the requirements for CDPHWIC authorized foods The Final Action is effective March 8 2016 and includes new food item numbers and Maximum Allowable Department Reimbursement Rates (MADR)

Vendor Alert 2016-04

7 Code of Federal Regulations part 24612(l)(iii)(D) and the California Code of Regulations title 22 section 40740 subdivision (e)(4) prohibit vendors from receiving transacting andor redeeming food instruments outside of authorized channels

Redeeming a food instrument outside of authorized channels includes redemption by an authorized vendor of food instruments accepted from participants or other third parties in greater quantities than could be validly transacted from an unauthorized vendor or from a local agency employee as well as other such forms of trafficking (Special Supplemental Food Program for Women Infants and Children Food Delivery Systems 55 Federal Register (FR) 53446‐01)

WIC Compliance Vendor Sanctions and Claim Process

CDPHWIC may seek restitution by establishing a claim for payment of any benefits or monies received as a result of WIC program violations impose disqualification andor termination from the program and make referrals to other public programs for investigation andor possible criminal prosecution under state and federal laws A civil money penalty may be imposed in lieu of a disqualification if CDPHWIC determines there is a participant access concern in the geographic area Failure to pay claims timely may result in non‐reauthorization of a vendor agreement

As a WIC authorized vendor you can avoid vendor sanctions by following the Vendor Authorization Criteria which is the criteria the CDPHWIC uses to select stores for authorization as well as the terms of the Vendor Agreement that vendors must sign to become a WIC vendor

Infant Formula

The Infant Formula Food Instrument

The Infant Formula FI is the only WIC FI that requires the WIC shopper to purchase the full quantity brand product name type and size printed on the FI

Once purcased WIC shoppers are not allowed to exchange WIC formula for another brand product name type or size If the WIC infant formula was expired when purchased from the store the WIC shopper can return it for a replacement of the same type

Purchasing Infant Formula

WIC authorized vendors may only purchase infant formula from wholesalers

1 Request the WIC ID folder from the WIC shopper and check for a signature on the front

WIC Compliance Vendor Sanctions and Claim Process

CDPHWIC may seek restitution by establishing a claim for payment of any benefits or monies received as a result of WIC program violations impose disqualification andor termination from the program and make referrals to other public programs for investigation andor possible criminal prosecution under state and federal laws A civil money penalty may be imposed in lieu of a disqualification if CDPHWIC determines there is a participant access concern in the geographic area Failure to pay claims timely may result in non‐reauthorization of a vendor agreement

As a WIC authorized vendor you can avoid vendor sanctions by following the Vendor Authorization Criteria which is the criteria the CDPHWIC uses to select stores for authorization as well as the terms of the Vendor Agreement that vendors must sign to become a WIC vendor
