Partial Exemption VATBIHS instructed for a VAT review to be carried out by the VAT People on behalf of the Society in February 2016 where they reviewed the VAT treatment of income received by the Society. Their summary was as follows:

• They were doubtful that exemption would apply to the membership subscription income that BIHS receives

• The BIHS may wish to consider amending its constitution so that it is able to treat it’s educational activity as exempt from VAT (delegate admission charges)

• Any profit made from the event is put into the course or furtherance of supply of education

• The supply is grant funded by central government

As a result of the review, a constitutional change was made and provisions put into place to ensure that any profit/surplus achieved would be ringfenced and used only for the provision of educational services.

As the Society is partly exempt due to the delegate fees being VAT exempt, the BIHS cannot recover all of it’s input tax (VAT that you have paid when you purchase materials) and uses a partial exemption method to work out how much input tax can be recovered (https://www.gov.uk/guidance/partial-exemption-vat-notice-706).

Following the VAT review, the BIHS accountants were instructed to carry out partial exemption calculations on behalf of the Society. There are 3 main steps to calculation how much input tax you can recover:

• Direct attribution of input tax

• Apportionment of residual input tax (tax on purchases used to make both taxable and exempt supplies

• Completion of an annual adjustment

Partial exemption is a very complex calculation with many factors taken into account to determine the percentage of VAT that can be reclaimed. At the end of 2018, we picked up on an error in the partial exemption calculations prior to the 2018 annual adjustment and corresponded with HMRC on this matter and on the basis of the information submitted they were happy to release the repayment of £9,937.01.

We have recalculated the partial exemption calculations for the financial years 2016 and 2017 and report that there is a reclaim to be made to HMRC for the following:

• 2016 - £5,246.38

• 2017 - £15,679.00

We have corresponded with HMRC regarding the miscalculation of VAT for 2016 and 2017 and they have advised that we need to submit a form VAT652 Notification of Errors which we can confirm will be submitted imminently.
