Law 448/2006 regarding the protection and promotion of disabled people rights (MO 1006/18 December 2006) stipulates that any legal entity having more that 50 employees must have a percentage of at least 4% disabled people.

Otherwise, companies with more than 50 employees are obliged to pay to the public budget a monthly amount/fine representing 50% of the minimum gross basic salary multiplied with the number of jobs for witch they havent hired disabled people according to this law.

Or they can choose to :Purchase products or services from the Authorized Protected Units, on the partnership basis in the amount equivalent of the above mentioned fine under the conditions provided by law.

What is a protected unit

Art. 44. these are considered Protected Units, according to the law:

a) companies with legal personality, irrespective of the property and organization form, which have at least 30% of the total number of disabled employees having an individual labour contract;

b) sections, workshops or other structures within companies, public institutions or non-governmental organizations, with individual administration and at least 30% of the total number of disabled people employed and paid;

The Protected Units are entities of social economy in Europe known

as social enterprises for work intergration (Work Integration Social

Entreprises WISE) or enterprises of employability.

Orientation, professional training, labor occupation and hiring

The procedure of deduction of the monthly tax paid to

the State for not hiring disabled personnel in the

quotas required by the Law.

The calculation formula of the monthly fine amount: 0.04* x 400** x the number of employees Legend: * 0.04 = percentage of persons with disabilities should be employed in the structure of society with over 50 employees

** 350 = half of minimum national salary

1. When you will sign the contract we will bring you the Authorization and the ANPH Order witch attest that ANIP is a Protected Unit.

2. If the purchase value is an amount equivalent to the amount due to the State Budget, in the reporting month, you have no obligation to declare position 23 Payments from legal entities for not hiring people with disabilities.

If the purchase value is lower than the amount due to the State Budget, in the reporting month, at the 23 position you shall declare the difference between the amount due to the state Budget and the purchase value.

If the purchase value is higher than the amount due to the State Budget, you will not declare the 23position in the reporting month, and the difference of amounts is reported in the next months, by decreasing the payment obligation.

Art. 78:

(3) Authorities and public institutions, legal, private or public persons witch do not employ persons with disabilities as provided by paragraph (2), can choose to fulfill one of the following obligations:

b) To purchase products or services from authorized protected units, on a partnership basis, in the amount equivalent to the monthly tax paid to the State Budget as provided at point a).

(4) Are exempted from the previsions of paragraph (3) point b) protected units established under disability organizations that can perform activities of sales/intermediation, on condition that minimum 75% of the obtained profit should be intended to socio-professional integration programs for people with disabilities from this organizations. This units have the obligation to present early a financial report, showing how were used the funds obtained by trading.
