Overview of the Court’s statistics in 2016 Contrary to previous years the Court’s statistics for 2016 disclose a higher number of incoming cases allocated to a judicial formation. The number of applications allocated to a Single Judge was almost the same as last year but the number of other categories of cases has considerably increased in particular from a few countries.
Single judge applications continue to be processed as soon as they are identified as qualifying for such a procedure. As explained last year, as the Court focuses on other categories of cases, productivity will tend to remain more stable, with fluctuations depending on when large groups of cases are processed and adjudicated. This change of focus is reflected in the increase in the number of applications (categories I to IV) which were communicated1 or decided by judgment or decision. 2,542 more such applications were processed in 2016 than in 2015 (+ 33%).
A. New applications In 2016 53,500 applications were allocated to a judicial formation, an overall increase of 32% compared with 2015 (40,550) after two years of decrease. 27,300 of these were identified as Single-Judge cases likely to be declared inadmissible (a decrease of 1% in relation to 2015). 26,200 were identified as probable Chamber or Committee cases (an increase of 100%).
B. Applications disposed of judicially and pending applications 38,505 applications were disposed of judicially, a decrease of 16% in relation to 2015 (45,574). The number of cases allocated exceeded those disposed of by almost 15,000 (i.e. a monthly deficit of around 1,250). As a result, the stock of allocated applications pending before the Court increased over the year, by 23% from 64,850 to 79,750.
C. Processing of applications
1. Pre-allocation
As at 31 December 2016 the number of applications pending at this pre-judicial stage stood at 13,800, an increase of 38% in relation to the same date the previous year (10,000). The number of applications disposed of administratively in 2016 was 20,950, a decrease of 35%. 65% of these files were disposed of for failure to comply with the requirements of Rule 47 of the Rules of Court (Contents of an individual application).
2. Inadmissibility or strike out decisions
In 2016 36,579 applications were declared inadmissible or struck out of the list of cases by a Single Judge, a Committee or a Chamber, a 15% decrease compared with 2015 (43,133).
The Single-Judge formation decided 30,998 cases in 2016, a decrease of 15% compared with 2015 (36,308).
3,772 applications were struck out by a Chamber or a Committee, in a decision or a judgment, following a friendly settlement or a unilateral declaration, a decrease of 18% (4,628 in 2015). Friendly settlements (2,005) increased by 21% (1,658 in 2015) and unilateral declarations decreased by 41% (1,767 compared to 2,970 in 2015).
The remainder of the applications were declared inadmissible by a Chamber or a Committee or struck out by these formations on other grounds.

3. Communicated applications
In 2016 9,534 applications were communicated (a decrease of 40% compared to 2015 when 15,964 applications were communicated).
4. Judgments
Judgments were delivered in respect of 1,926 applications (compared with 2,441 in 2015 – a decrease of 21%). A lower proportion of these applications were joined with the result that the number of judgments actually delivered was 993, an increase of 21%. 310 judgments (in respect of 971 applications) were adopted by a three-judge Committee formation. These judgments accounted for 50% of the applications decided by a judgment (65% in 2015).
5. Requests for interim measures (Rule 39 of the Rules of Court)
The total number of decisions on interim measures (2,286) increased by 56% compared with 2015 (1,470). The Court granted requests for interim measures in 129 cases (a decrease of 20% compared with 161 in 2015) and dismissed them in 1,103 cases (75% more than the 629 in 2015). The remainder fell outside the scope of Rule 39 of the Rules of Court. 67% of the requests granted concern expulsion cases.
D. Priority policy 2 The essence of this policy is to concentrate more resources on the most important cases, namely the cases falling within the top three categories (“priority applications”). At 31 December 2016 there were 19,870 applications in these categories.
The number of priority applications dealt with at different stages of the procedure in 2016 increased by 58% compared to 2015 (3,763 in 2015 and 5,937 in 2016). 66% more priority applications were communicated to the respondent Governments in comparison with 2015 (2,392 in 2015 and 3,972 in 2016). The number of priority applications declared inadmissible or struck out of the list of cases by a Chamber or Committee decreased by 57% (680 in 2015 and 1,067 in 2016). The number of priority applications struck out following a friendly settlement or a unilateral declaration increased from 304 in 2015 to 715 in 2016. The number of priority applications giving rise to a judgment increased by 30% in 2016 (691 in 2015 and 898 in 2016).
E. Conclusion With the elimination of the backlog of manifestly inadmissible applications, the figures of overall productivity were bound to decrease since it was the disposal of large numbers of these applications which drove those figures up. The focus on more complex and time-consuming applications also means fewer cases are decided. This coupled with the higher volume of incoming applications has resulted in an increase in the stock of pending cases, after two years of decrease. Higher numbers of priority applications being processed and adjudicated is a positive development, but this will not be sufficient for the Court to make substantial inroads into the backlog of Chamber cases. This is why in 2017 the Court and its Registry will continue to reflect on new working methods and approaches to further streamline the proceedings for different categories of applications.
