Analysis of 2016 STV Delegate Election Data(Write-ins/“Mentions”/Excludeds)

Overview

As part of her preparation to implement the 2016 Delegate Elections recount motion approved by the PNB on 12/13/16, the iED gave the PNB Secretary authority to obtain membership class (Listener-Sponsor or Staff) and membership status (valid membership between July 1, 2015 and June 30, 2016, the election “record date”) verification information from GMs on individuals whom voters from their respective stations chose to write-in on their ballots.

The PNB Secretary had been corresponding with Kenny Mostern, Vice President for Western US Operations for TrueBallot since early December to clarify the contents of the two disks TrueBallot had sent to her and learned that the individual write-ins were located in TrueBallot’s write-in report files and STV input files.

All the write-ins, their rankings and the specific filenames where they are located can be found below under the Data section below. The notations in blue were added by PNB Secretary Janet Kobren to the best of her knowledge.

Note that for the individual names sent to the GMs by the PNB Secretary only two GMs responded and provided membership information. Also note that the data provided below only addresses Write-ins and Excludeds and does not address other election irregularities like discrepancies on the election website or whether members were sent proper or multiple ballots, or other election issues.

Terminology

Write-in = an individual the voter wrote in on the write-in line of their ballot and gave a ranking to.

“Mention” = (a TrueBallot classification, not a Pacifica election term) defined by TrueBallot as individuals for whom voters did not give a “top” ranking to and who had only been ranked two or fewer times.

Excluded = An individual whose name was written in on a ballot who either did not have a verified membership status or whose name was written whose membership class did not match the membership class of the election or who was already seated on their respective LSB was EXCLUDED from being run through the STV tally.

Aggregated = multiple names (write-ins) lumped together as a single candidate and run through the STV tally as the ”Write-in (aggregate)” CANDIDATE; TrueBallot

created write-in report files containing the aggregated list of names, including how many times each individual was ranked and how many rankings the individual got.

Disaggregated = one or more individual names separated out from the aggregated list of candidates and included in the STV input file as either as an individual CANDIDATE or EXCLUDED.

Vetting write-ins

When it came to write-ins it was the NES’ responsibility to instruct TrueBallot before the STV tally was run to provide the NES or LES with all the names of the write-ins for verification. The NES or LES should have verified from the membership data that had been provided by management for sending out ballots that each write-in was a member of the correct membership class for the election and that the write-in’s membership status was within the year preceding the record date. Once this was done, TrueBallot should have been instructed to EXCLUDE any write-in who was not verified. TrueBallot with the help of the NES/LES should have also checked that a write-in was not a misspelling of or alternate name for a candidate on the same ballot, and if so, if the voter did not rank the candidate listed on the ballot the write-in vote should be combined with the candidate’s and tracked as belonging to the candidate. If not, the write-in should be considered a separate individual.

Disaggregating and Mentions vs. Write-ins

Per Article 15, Section 1.A.2. which says, “Vote counting shall start with a tabulation of each voter's first, or only, choice vote” means that if someone, a candidate or someone a voter wrote in on their ballot, is given any ranking by voter, the individual who was written in must be counted in the tally.

Apparently the NES did not notify TrueBallot of the Voting Methods in the bylaws and thus they were not followed by TrueBallot for either the original or re-run tally.

Of the 163 unique write-in names listed in the write-in report files, only three were disaggregated as reported in TrueBallot’s 10/28/16 Certification Addendum. The rankings for the remaining 160 individuals were basically excluded because they were considered by TrueBallot as “mentions”, not bonafide write-ins, and were counted as part of the “Write-in (aggregate)” CANDIDATE and did not appear in any of the round-by-round results. And although only 56 of these 160 names have since been vetted it is likely that many of the remaining 104 individuals were also valid and verifiable members of the appropriate membership class.

All should have been disaggregated and counted separately and included in the runners-up lists that have to last for two years in their respective election.

Furthermore, the voter(s) who wrote them in and ranked them were disenfranchised, the runners up lists for each station that need to last until the 2018 Delegates election are incomplete and even incorrect in some cases, and also there is a possibility in a few cases, especially at WPFW, some of the ELECTEDs might be incorrect.

WPFW Listener election

It is clear from the TreBallot files that WPFW was handled differently from the other stations, particularly when it came to the Listener election. There were 51 unique “mentions” in the write-in report for the Listener election of which 40 were not vetted and all were disaggregated. In addition, the STV input file contained 7 named write-ins who were not among the 51. The 51 write-in/“mentions” were likely lumped together in the “Write-in (aggregate)” CANDIDATE. It is not known if any of the 7 had been vetted, but 3 of them were listed as Listener electeds, 3 of them were Staff members who ended up being listed as runners up in the Listener election, and the 7th did not even appear as a runner up.

Summary of listings below

For the 10 elections, below is a listing of 176 write-ins/“mentions”/other documented on the TrueBallot disks including:• 160 unique individual names which were written in on ballots, designated by

TrueBallot as “mentions” (not write-ins) and not disaggregated,• 3 non-names written in all of which should have been excluded,• 3 unique individuals whose names were written in on ballots and disaggregated

(Ahmad Anderson, KPFA Listener; Jaime Rodriguez, KPFT Listener; and Ebon Charles, WBAI Listener), and

• 10 undocumented write-ins who were included in one of the tallies.
