Department of Justice Blocks Anticompetitive Health Care Merger

In a closely watched antitrust matter, U.S. District Judge Amy Berman Jackson ruled in favor of the U.S. Department of Justice (DOJ), blocking the proposed merger of Anthem and Cigna, the second and third largest health insurers in the U.S. Dr. David Dranove, an affiliate of Analysis Group, testified multiple times during the trial as the DOJ’s economic expert, supported by a team of Analysis Group consultants in Boston and Chicago. As the DOJ’s primary expert witness, Dr. Dranove testified on market definition, the impact on market concentration, competitive effects including the loss of innovation, the impact on medical costs, and entry. In her opinion, Judge Jackson concluded that the merger would substantially lessen competition in the national accounts market and in at least one local market. On appeal, the Second Circuit upheld the ruling. Anthem announced shortly afterward that it was abandoning its plan to merge with Cigna.

As an analyst with Analysis Group, you will

Assessment of the Impact of Opioid Abuse

Analysis Group senior consultants have assessed the burden of illness of opioid abuse and developed budget-impact analyses, epidemiological studies, prescription risk assessment models, and suspicious order monitoring algorithms, all related to aspects of this major societal problem. Our researchers have evaluated the impact of abuse-deterrent formulations of drugs that can provide pain relief to patients and help to mitigate the adverse effects and substantial costs of opioid abuse. In connection with litigation and other investigations, we have also assessed liability and damages issues related to prescription opioid sales and distribution.

We assist clients large (Citibank, Coca-Cola, Disney, Google, Johnson & Johnson, MasterCard, Microsoft) and small (entrepreneurial startups, artists, inventors) in determining the value of key factors that drive their businesses.

Online Retailer False Advertising Matter

Analysis Group was retained to support our academic affiliate on behalf of a major online retailer defendant in a case in which the government alleged that the defendant had made untrue and misleading comparative advertising claims about the prices of its products. At issue was the use of specific reference pricing conditions, including advertising terms that the plaintiff asserted were misleading. Our affiliate conducted an online experiment and an Internet panel experimental survey to assess the impact of the advertising language on consumer perception and behavior. In the first study, consumers were randomly selected to view versions of the defendant’s website with either “MSRP” or “Compare” labels throughout their shopping sessions. Consumers who made purchases during the study period showed no difference in recall of the product price, reference price, or term used with the reference price across conditions. Our affiliate conducted a second survey to determine whether consumers’ understanding of reference prices changed based on the labels used. Consistent with the first study, no differences were found.

Arbitration Involving Greek Government Bonds

In an International Centre for Settlement of Investment Disputes (ICSID) arbitration initiated by a Slovak bank and its former Cypriot shareholder, claimants sought payment based on their interests in Greek bonds (GGBs) that were restructured in Greece’s 2012 sovereign debt exchange following multinational negotiations to reconcile Greece’s sovereign debt crisis. The claimants’ interests in GGBs were reportedly more than €500 million prior to the debt restructuring in 2012. An ICSID tribunal found that it did not have the jurisdiction to rule on the matter because the GGBs were not protected investments under the bilateral treaty between Slovakia and Greece. A team from Analysis Group was retained on behalf of Greece to support two academic affiliates, who testified at the arbitration. One affiliate testified on issues related to the primary and secondary markets for GGBs, as well as the evolution of the risk characteristics of the at-issue GGBs over time. Another affiliate testified on the bank’s accounting treatment of the GGBs.

DISH Network Copyright Infringement Matter

A California federal judge found that Analysis Group client DISH Network’s innovative Hopper set-top box and DVR does not infringe the copyrights of Fox Broadcasting Company’s television programming. In her decision, the judge cited the findings of Analysis Group’s academic affiliate to conclude that the use of the Hopper’s “PrimeTime Anytime” and “AutoHop” features were fair use under U.S. copyright law. An Analysis Group team supported our academic affiliate and counsel for DISH, analyzing viewer behavior from various perspectives and using a wide variety of industry and survey data. Our affiliate also rebutted opinions and surveys offered by the plaintiff’s experts. The judge in this case ruled for Fox on certain contract claims, but significantly reduced the scope of liability and damages. DISH’s general counsel has praised the decision as having “far reaching significance.”
