Editorial
The 3rd edition of Volume II continues to keep up with the new
developments in the national criminal law field as well as in the international field.
The following three articles have been submitted for your enjoyment.
We deeply thank you for your support and we invite you to read and
comment upon the newest edition of our journal!
The first article takes on detainee conditons. The authors rethoricly asks: „Is
the detainee an object or a person?”. Without any hesitation we would promptly
reply that the detainee is a person. Thus, the author asserts: „in front of me I see a
person with his own identity or the object of my work? I invest a certain amount of
trust in him, I push him to become responsible, to demonstrate that he deserves a new
chance”. Undeniably, we cannot talk about social reinsertion if we relate „to a
detainee as to an individual without personality, forgetting that he or she has dreams
and needs, achievements and failures on a background of an aducation and a series of
experiencies oriented towards the personal scope of life”.
The second article draws attention to the importance of a clear and correct
interpretation of evidence in a criminal trial. For a fair awarding of a solution in
criminal cases, the evidence may not be enough (evidence that in some cases may
prove to be apparent evidence) and deemed necessary the opinion of specialists,
namely, expert appraisals. Thus, the second article is presented as a research report
focusing on the importance of a semantics expert appraisal.
The last, but not the least, article deals with two prison systems from two ex-
communist countries: Romania and Azerbaijan. When speaking of the penitentiary
systems of Romania and Azerbaijan it conjures up images of a multitude of
information for debate. Relying on the Criminal Codes, the laws regarding the
enforcement of sentences and the Internal Regulation Policies of penitentiaries of
both countries, we will identify weak points, strong points, as well as alternatives to
the identified confinement systems.

comment upon the articles in order to make your contribution to the developments in
the field of criminal justice.

Editorial
Numărul 3, vol. II continuă să Ńină pasul cu noutăŃile din domeniul justiŃiei
penale naŃionale, cât şi internaŃionale şi aduce în atenŃie şi de această dată, 3 articole
extrem de interesante.
Vă mulŃumim încă o dată pentru sprijinul continuu acordat şi vă invităm şi în
acest număr să ne citiŃi şi să ne comentaŃi!
Un prim articol abordează condiŃia de deŃinut, iar autoarea ne întreabă dacă
„Este deŃinutul un obiect sau o persoană?”. Indubitabil, am răspune prompt că
deŃinutul este o persoană. Întocmai cum autoarea susŃine, „în fața mea văd o persoană
cu identitate proprie sau obiectul muncii mele? Investesc o anumită doză de
încredere în el, îl provoc să devină responsabil, să demonstreze că merită o nouă
șansă”. Incontestabil, nu putem vorbi despre reinserŃie socială dacă ne raportăm „la
deținut ca la un individ lipsit de personalitate, uitând că are năzuințe și nevoi,
realizări și eșecuri, pe fundalul unei educații și o serie de experiențe orientate către
scopul personal al vieții”.
Al doilea articol ne atrage atenŃia asupra importanŃei particularităŃilor
probelor şi a complexităŃii lor în procesul penal. Pentru o justă soluŃionare a cauzelor
penale, nu sunt de ajuns probe ce se pot dovedi a fi “aparente de probe” ci este
necesar concursul unor specialişti, respectiv operaŃiuni expertale. Aşadar, acest de-al
doilea articol este prezentat sub forma unui raport de cercetare ce relevă importanŃa
unei expertize semantice.
Ultimul, dar nu cel din urmă articol aduce în prim plan două sisteme carcerale
din două Ńări foste comuniste: România şi Azerbaijan. Când vorbim despre Sistemul
Penitenciar din România şi Sistemul Penitenciar din Azerbaijan, însumăm deja o
pepinieră importantă de informaŃii pentru a le dezbate. Bazându-ne pe Codul Penal,
Legea de Executare a Pedepselor şi Regulamentul de Ordine Internă a penitenciarelor
din ambele Ńări, vom concluziona care sunt punctele slabe, punctele forte şi
deasemenea, alternativele din aceste sisteme penitenciare.

Avem încredere că şi acest număr vă va satisface deplin şi vă va impulsiona
să ne comentaŃi cu scopul de a creşte şi de a performa în justiŃia penală.

Abstract: In the prisoner’s approach, the vision of the specialist becomes essential:
“In front of me what do I see – a person with an identity of its own or simply, the
object of my activity”? It is desirable to give him credit in order to cause the
beginning of a certain responsibility, to give him the possibility to show himself
worthy of a new chance. The legal offence is actually, for the most part, an
expression of deep discontent. It is that terrible silent shout that tries to break the
other’s indifference – pain that is so often assimilated as a thoughtless gesture,
underneath which lies a whole history of wounds, repressed by the defendant. One
cannot speak of social reintegration if it relates to the prisoner that should only be
characterized as to an animal; which has no personality as an exteriorization of the
individuality. Generally, the prison is associated with the still image touched only of
the inevitable passage of the time under sentence, in a dreadful atmosphere of apathy
and chronic stress. What is, however, the prison role?

Abstract: În abordarea penitentului, esențială devine optica specialistului: în fața
mea văd o persoană cu identitate proprie sau obiectul muncii mele? Investesc o
anumită doză de încredere în el, îl provoc să devină responsabil, să demonstreze că
merită o nouă șansă. Delictul reprezintă expresia unor nemulțumiri, un strigăt mut
ignorat care caută să se facă observat, durerea, cel mai frecvent, confundată cu un
gest lipsit de discernământ în care se ascunde întreaga istorie a rănilor cumulate și
refulate de către inculpat. Nu pot vorbi despre reinserție socială dacă mă raportez la
deținut ca la un individ lipsit de personalitate, uitând că are năzuințe și nevoi,
realizări și eșecuri, pe fundalul unei educații și o serie de experiențe orientate către

scopul personal al vieții. Penitenciarului i se asociază o imagine statică impregnată
doar de amprenta timpului unde se execută sentința, într-o atmosferă de plictis și
stres cronic. Care este totuși rolul penitenciarului?

Penitenciar – sens și semnificație
Etimonul cuvântului penitenciar este de sorginte latină, de la poenitentia.
Semnificația sa derivă din limbajul creștin, cu referință la pocăință, stare de privare
(fizică, materială) percepută fie din partea unui preot, fie impusă sieși ca o auto-
îndreptare. Astfel, conceptul în sine, conține deopotrivă două valențe:
a. Părerea de rău, pocăință pentru o greșeală/păcat/delict comise cu intenție sau
fără;
b. Pedeapsa corespunzătoare acelui delict civic, moral sau duhovnicesc, transpusă în
privarea de orice fel (în limbajul eclezial omologul său este canonul de la
duhovnic, gr. kανών, „regulă, normă”, care deține rolul îndreptării).1
Observăm că penitenciarului îi revine atribuția de disciplinare, însă nu atât în
sens coercitiv, cât în sensul de a corecta abaterea morală. De altfel, dacă s-ar limita la
un sistem punitiv sever, rezultatele ar fi o rată crescută de recidivă și delincvență,
pentru că agresorul sau învinuitul nu ar putea fi reintegrat în comunitate, în mod real.
Îndreptarea reprezintă o conlucrare a penitentului, mai exact a voinței sale, cu
persoana care-l ajută să priceapă unde a greșit, rațiunea delictului (anumite nevoi
personale neîmplinite) și impactul asupra propriei persoane, a victimei, a altor
participanți indirecți (familia victimei, a agresorului, etc.). Cu alte cuvinte, se
urmărește o pricepere complexă din partea inculpatului pentru a nu repeta fapta
comisă.

Comportamentul delincvent – ecou al sinelui rănit
Dacă privim către diferite cazuri, de-a lungul experienței acumulate, vom
observa că întâlnim în incinta penitenciarului caractere dintre cele mai variate, de la
persoane foarte agresive și sensibile la cel mai nesemnificativ gest de apatie până la
oameni foarte calmi, blajini, încât ești uimit să-i găsești într-un asemenea cadru. Cum
au ajuns acești oameni să comită anumite delicte, cum s-au schimbat unii dintre ei pe
parcursul anilor petrecuți într-un mediu claustrat de libertate, cum se eschivează de
starea anostă care le pătrunde cugetele în fiecare noapte, cum se feresc de
frământările care le apasă conștiința și oare cum de pot înăbuși strigătul consecințelor
determinate involuntar de actul care i-a privat de libertate numai pentru a uita
temporar cine sunt. Toate acestea constituie întrebări ale căror răspunsuri se reflectă
în nevoile lor de bază.
Înainte de a evoca nevoile acute ale persoanelor deja private de libertate vom
căuta, în primă instanță, să ne orientăm atenția către actele, atitudinile și
comportamentele de suprafață. Din perspectiva behavioristă sesizăm o serie de
probleme, însă în lucrarea de față ne propunem spre expunere doar acele puncte de
criză a căror explicitare ne-a fost confirmată în experiențele directe cu deținuții,
astfel încât să nu ne reperăm la anumite presupoziții cvasi-științifice teoretizate:
a. Dezinteresul de a se implica în activități propuse de Direcția Penitenciarului (ca
alternative pentru petrecerea timpului în mod constructiv, cunoașterea unor noi
unghiuri de vedere – cărți, filme, schimb de experiență, jocuri de rol, etc.).2
b. Agresivitatea3 (fizică, verbală, non-verbală și para-verbală, alias legea pumnului,
limbajul de argou, expresivitate/gestică care exprimă furia, mânia, și tot ce
aparține spectrului vocal – ton, timbru, cadență, ritm, etc.) – sensibilitățile lor
sunt convertite întrucât nu sunt ascultați și luați în seamă în privința nevoilor lor,

astfel încât reacționează ca rebeli pentru a ieși în evidență, chiar dacă negativ. În
aceeași sferă se încadrează următoarele comportamente care se pliază pe
mecanisme de apărare: ironie, sarcasm, ofense, injurii, provocări, ș.a.4 La
extremă se află atitudini denigratoare prin ignoranță: indiferența față de durerea
sau opinia exprimată a unui coleg, monopolizare, deviere de la subiect, lipsă de
respect în convorbire (nu se ascultă până la capăt, taie fraza, vorbesc suprapus).
c. Duritatea sau apatia cronică – este cauzată de o continuă apreciere negativă din
partea celorlalți sau indiferența cu care sunt tratați (deopotrivă de către colegi de
celulă, personalul din penitenciar, vechii prieteni de afară);5 părăsirea lor ca
prezență de spirit și tratarea cu indiferență când au nevoie să fie sprijiniți
proiectează în ei un mecanism de apărare sub masca durității, rigidității și a unui
caracter singuratic, dar puternic, autonom. Potențează criza de identitate, de-
personalizare.
d. Lipsa de comunicare directă – vorbesc mult, însă prea puțini au cui împărtăși
ceea ce-i afectează (vorbesc ca să iasă din starea de izolare, însă nu se identifică
cu imaginea creată). Vorbim în acest sens de acuratețea comunicării.6
e. Lipsa încrederii în ceilalți7 – este răspunsul de conduită defensivă la
dezamăgirile, trădările venite din partea unor persoane dragi sau colegi în care au
investit un credit afectiv și informațional; în numeroase cazuri se întâmplă ca

aceste persoane dezamăgite de ceilalți să fi acumulat, în fapt, o pierdere treptată a
încrederii în sine care ulterior repercutează și în relațiile exterioare.8
f. Izolare9 – se închid în sine (introvertire), își convertesc sentimentele și propriile
stări sub diferite măști, își cosmetizează nemulțumirile, frustrările sub forma fie
unui râs isteric, a unei atitudini de ironie cronică sau indiferență față de ceea ce se
petrec împrejur, ș.a.
g. Lipsa încrederii în sine – nu sunt luați în serios și nu li se acordă încredere (ceea
ce determină, pe viitor, deficiențe în asumarea responsabilității). Etichetarea10
devine o eroare majoră frecvent comisă atât de către colegii de celulă, de către
foști prieteni sau cunoscuți și de cadrele din penitenciar. Persoanele private de
libertate observă că nu li se acordă o a doua șansă, deși, noi înșine, care ne aflăm
într-o libertate exterioară, fizică, nu suntem amendați cu pierderea încrederii
atunci când greșim. Primim un avertisment sau poate exista o ezitare temporară
vizavi de responsabilitatea asumată, însă elasticitatea încrederii celuilalt în noi
definește conduita care ne repune în drepturile inițiale.
h. Lipsa cunoașterii de sine11 – se conjugă adeseori cu introvertirea, ceea ce
determină o afundare a sinelui și postarea unor măști de suprafață, pe care ei
înșiși nu le mai conștientizează ca forme de apărare. După cum am mai precizat
deja, barierele ridicate în cunoașterea de sine devin balsamul care atenuează
durerile personale mute, de nimeni luate în considerare pentru că cel care
vorbește cu un deținut nu-l întreabă dacă a primit afecțiune în copilărie, dacă a
crescut alături de ambii părinți, dacă a iubit vreodată sau dacă a fost mereu
desconsiderat la școală sau în alte anturaje și astfel, determinat de context să se
angreneze în medii nocive edificării de sine. Astfel, persoana deviază de la
propriile stări și tinde să uite plăgile mai vechi. Spunem plăgi întrucât la nivel

interior s-a produs o ruptură de țesut afectiv (unde se integrează și încrederea
cultivată în sine și în ceilalți), iar nevoile aferente rupturii nu au fost atinse la un
nivel suficient persoanei (fiecăruia îi revine o doză specifică de împlinire).
Problemele lor principale expuse succint mai sus au fost plasate într-o
anumită ordine, respectiv de la comportamente și cauze vizibile, de suprafață (apatie,
agresivitate, duritate) până la punctarea specifică a unor sublime expresii ale
dinamicii interioare ale penitentului (forme pervertite și convertite de comunicare,
gradația încrederii în sine și în ceilalți, care se cuprind în stadiile cunoașterii de sine).
Însă, aceste probleme semnalează persistența unor nevoi neacoperite, dintre care
cele mai frecvente sunt următoarele:
• să fie ascultați;
• identificarea pasiunilor, hobby-urilor și abilităților de care dispun și pot fi puse în
valoare;
• recunoaștere, stimă: apreciere în ceea ce fac bine sau se străduiesc, valorificarea
talentelor și cunoștințelor lor;
• acordarea încrederii (respectarea părerii proprii) și responsabilizarea cu anumite
sarcini
• afecțiune;
• nevoia unui mediu curat pentru destindere, socializare directă, dezinhibare;
• activități antrenante fizic (nevoi de socializare, destindere și sănătate);
• afiliere (socializare, ascultare reciprocă, brainstorming, interacțiune);
• cunoaștere de sine (în contextul echipei, variate situații);
• comunicare directă în diferite modalități (participarea la activități, deschidere față
de un coleg, față de preot, față de psiholog).
Nerezolvarea sau omisiunea acestor nevoi acute determină reacțiile adverse
pe care le-am exemplificat sub forma problemelor enumerate mai sus. Dacă, însă,
luăm în vedere aceste repere în relația cu deținuții, respectiv nevoile și problemele
lor, atunci ei își vor schimba comportamentul față de ceilalți și față de ei înșiși.
Inițiativa noastră îi va încuraja să fie sinceri cu ei, să se cunoască treptat, să înțeleagă
și pe cel din fața lor după ce au fost ascultați în perimetrul afectat. Uneori ei simt
efectiv nevoia de a vorbi cuiva, de a-și exprima un simplu gând, de a auzi și pe
altcineva decât pe proprii colegii de celulă. Depinde, însă de situații. Există în

penitenciar persoane private de liberatate care se cunosc și sunt un punct de sprijin
pentru ceilalți, iar în acest caz, importantă devine comunicarea deschisă, spontană.
Așadar, avem un sistem de coordonate: axa comunicării pe verticală (de la
personalul penitenciarului către efectivul deținuților) și pe orizontală (între deținuți).
Dacă personalul, specialiștii sau voluntarii care vin în contact cu cei din penitenciar
comunică deschis, cu o dispoziție sinceră de a și asculta nevoile deținuților înainte de
a-i întreba ceva (depinde contextual, totuși), atunci vor primi un feed-back pozitiv,
chiar dacă nu întotdeauna din prima, astfel le vor câștiga încrederea. Încrederea
consecvent investită îi va determina pe ei să se simtă înțeleși, acceptați și să capete o
anumită încredere în ei înșiși. În acest mod ei scapă de etichete, de blamare, adică își
asumă execuția pedepsei cu pricepere prin conștientizarea rănilor adânci care i-a
constrâns să reacționeze agresiv.
Când își redobândesc încrederea în ei înșiși devin disponibili de a prelua
sarcini. Acesta este punctul în care îi putem responsabiliza cu tact și astfel, se vor
implica liber, adeseori și pe interes, în varii acțiuni. Se mobilizează, încep să miște și
devin deschiși spre noi orizonturi de cunoaștere (se pot implica în ateliere de creație
sau profesionale, lectură, cultură generală, dezbateri cotidiene). Ajunși în această
etapă, dimensiunea timpului își schimbă valențele și devine mai ușor suportabilă
pentru că fie au o țintă, un scop îndrăgit către care se îndreptează, fie găsesc
alternative plăcute și utile pentru petrecerea timpului.
Atitudinea se abordează personal, față de fiecare în parte: cu unii vom fi mai
rezervați în glume, la alții folosim inițial un limbaj mai dur și serios spre a tempera
insolența, cu alții vom discuta pe un ton mai moale, ș.a. Deși se recurge la diverse
maniere de comunicare, strategia în sine este unitară condusă de același scop, anume
de a-i face pe deținuți să se integreze în societate pe deplin. Mai întâi, se impune ca
ei să își înțeleagă vina și rădăcina acesteia, în același timp. Prin extrapolare, unii
dintre ei își vor putea regăsi în colegii lor cauzele comportamentului agresiv,
revoltător și nu vor mai reacționa după legea talionului.
Un rol semnificativ în educarea comportamentului deținutului revine altor trei
actori: personalul penitenciarului (nu doar psihologul), familia sau prietenii apropiați,
comunitatea în care urmează să se integreze. Așadar, se recomandă ca aceștia să aibă
o educație corepunzătoare care să le faciliteze acomodarea din punct de vedere

psihic. Există anumite cuvinte cheie care definesc o conduită adecvată din partea
actorilor anterior menționați, precum non-etichetarea, ascultarea nevoilor reale,
responsabilitate, cultură psiho-socială. Spre exemplu, dacă personalul și cei din afară
vor înceta să îi mai eticheteze, atunci deținuții se vor putea vindeca de povara purtată
deja în închisoare și nu vor mai acumula noi resentimente, cel puțin în privința celor
vechi. În caz contrar, ei vor resimți anularea libertății de a fi ei înșiși, de a primi
ocazia să arate că pot fi și altfel decât au fost percepuți până acum, iar consecințele
sunt nocive pentru ei și societate, deopotrivă. Există o serie de riscuri în lanț, între
care enumerăm câteva exemple: închiderea în sine, creșterea gradului de agresivitate
sub varii forme, creșterea ratei de recidivă, potențarea propriilor frustrări, etc.
Cauze ale recidivei
Am inserat între consecințele neglijenței atitudinale ale interlocutorului
multiplu12 al deținutului o componentă frecvent întâlnită în mediul recalcitrant –
recidiva. Vom surprinde succint doar câteva nuanțe ale cauzalității recidivei după
cum urmează.
Abordăm o perspectivă de sus în jos: potențialele cauze ale recidivei sunt
determinate de lipsa atenției, pe alocuri, din partea personalului avizat al
Penitenciarului13, urmată de conduita și conținutul comunicării în anturajul din
celulă14 și culminează cu fișa personală: propriile experiențe, temeri și năzuințe pe
fundalul educației imprimate în caracter.
12 Personalul care lucrează în subordinea Autorității Naționale a Penitenciarelor din România, familia, prietenii, colegii de celulă ai deținutului, societatea în mijlocul căreia trăiesc. 13 Cu referire la psiholog – acesta este dator față de fiecare deținut să-i aloce un timp personal, în care să se arate disponibil să-și asculte pacientul. 14 Adeseori, colegii de celulă își împărtățesc experiențele și se influențează în comiterea unui nou delict mai perfecționat, prevenirea riscurilor de a fi prins, etc.

Praxis psihologic: fără psihologie!
De recomandat este să nu venim la ei în calitate de specialiști, să nu le vorbim
în termeni prea formali, să nu teoretizăm sau să-i abordăm inconsistent15.
Experiențele lor sunt dureroase și în pofida menținerii imaginii de dur, deținuții își
regretă faptele și încearcă să le uite pentru că ele constituie răni deschise care
sângerează înlăuntrul lor și au ecou tocmai în apatia afișată sau cruzimea pe care o
postează refractar la ceea ce se află sensibil. Este o formă de menajare a eul-ui rănit,
o mască protectoare ca răspuns la lipsa de înțelegere și încredere survenită din partea
celorlalți. Mulți dintre ei, după ce au comis un delict mai grav sunt părăsiți de
prieteni, de soții/persoane dragi, ceea ce nu face decât să potențeze rana lor. Ca să se
vindece, au nevoie să comunice și au nevoie de oameni sinceri împrejurul lor, buni
receptori ai propriilor nevoi existențiale (de afecțiune în care se circumscrie și
încrederea). În penitenciar nu se găsește ușor o persoană căreia deținutul să îi poată
încredința taina sa, fapt pentru care discuțiile purtate între ei au un caracter
superficial, fad care le consumă energia.
Concluzie: penitentul – obiect sau persoană?
Am urmărit pe parcursul acestei lucrări abordarea deținutului ca om/ființă
umană, un organism aflat într-o permanentă dinamică, la care se adaugă și
dimensiunea sufletească: teama de a muri singur, sau viața care-și pierde sensul în
fața dezamăgirilor fie provocate celuilalt, fie resimțite față de comportamentul cuiva.
Dacă vrem ca ei să se schimbe, această schimbare trebuie să o pornim de la noi și din
perspectiva noastră față de ei. Noi să fim profunzi și atenți în fiecare gest al nostru,
iar ei văzând aceasta se vor modela în timp, în baza unui credit acordat nouă, o
fereastră către sinele lor. Să nu uităm că ne oglindim unii în alții, iar violența și
indiferența nasc agresivitatea cronică, în timp ce răbdarea, ascultarea și dăruirea de
sine generează noblețe și conștiință de sine.

Abstract: Taking into consideration the characteristics and the complexity of
evidence in a criminal trial, it is imperative that the methods of interpretation leave
little room for ambiguity that could lend to the inaccurate conclusions. Thus, for a
fair awarding of a solution in criminal cases, the evidence may not be enough
(evidence that in some cases may prove to be apparent evidence) and deemed
necessary the opinion of specialists, namely, expert appraisals. The present research
report focuses on the importance of a semantics expert appraisal that might lead to a
reinterpretation of the exhibits in the specific criminal case researched.

Abstract: Având în vedere importanŃa interpretării corecte şi a aprecierii probelor în
procesul penal, se impune ca modalităŃile de interpretare şi de apreciere a acestora să
nu lase loc de ambiguitate ce ar putea conduce la concluzii greşite. Însă, pentru o
justă soluŃionare a cauzelor penale, nu sunt de ajuns probe ce se pot dovedi a fi
“aparenŃe de probe” ci este necesar concursul unor specialişti respectiv, operaŃiuni
expertale. Prezentul raport de cercetare relevă importanŃa unei expertize semantice,
expertiză ce ar putea duce la redimensionarea ştiinŃifică a înscrisurilor din respectiva
cauză supusă cercetării.

Act juridic se numeste orice act făcut de un om în mod voluntar şi cu intenŃia
de a crea, a transmite sau stinge un drept sau de a produce un anumit efect juridic.
Cuvântul act are un dublu înŃeles, anume atât cel de negotium, adică fapt
juridic, cât şi cel de instrumentum, adică înscrisul probatoriu.
Pentru ca un act juridic să ia fiinŃă şi să aibă efect, este necesar să existe o
voinŃă care să-l creeze; în plus, această voinŃă trebuie să se manifeste, deoarece
dreptul nu se ocupă de voinŃa internă, ci numai de cea declarată sau exteriorizată.
Se poate întâmpla ca voinŃa să existe şi să se manifeste, însă să fie lovită de
un viciu. În acest caz actul juridic are o existenŃă de fapt, însă legea refuză să
recunoască unui asemenea act efecte juridice normale şi dă autorului actului, a cărui
voinŃă a fost viciată, dreptul de a cere în justiŃie anularea actului.

Constatări I
Înscrisul înregistrat sub nr. 106/P/2007 semnat Tureanu Ileana nu reflectă
voluntariatul persoanei notificatoare cu privire la intenŃia încunoştiinŃării despre
săvârşirea unei infracŃiuni, întrucât în cuprins nu se face descrierea unei fapte
prevăzute de legea penală, nu este indicat un făptuitor şi mijloace de probă20. Acest
înscris poate fi apreciat ca o relatare a unor fapte despre care persoana notificatoare a
fost întrebată.
Înscrisul intitulat “AutodenunŃ“ (înregistrat sub nr. 106/p/2007) atribuit
numitei Crăiniceanu Gabriela nu poate fi apreciat ca un înscris probatoriu având în
vedere imposibilitatea lecturării conŃinutului acestuia pentru a se stabili eventuale
fapte juridice la care putea face referire notificatorul.
Acest înscris poate deveni un înscris probatoriu dacă va fi supus unor
operaŃiuni expertale grafice având ca obiect stabilirea conŃinutului de idei, a
voluntariatului scriptorului sau scrierii după dictare. Se poate pune în discuŃie
deghizarea scrisului sau intervenŃia unor factori pasageri, oboseală, stres. Putem deci
să deosebim între acŃiunea unor factori permanenŃi (boli, traumatisme, pareze)
voluntari (deghizare) şi cea a factorilor aleatori. Faptele şi împrejurările stabilite prin
operaŃiunile expertale vor putea fi apreciate ca fapte şi împrejurări ce nu au fost
cunoscute de instanŃa la soluŃionarea cauzei.

Probatoriul este un fascicol de acte procesuale relative la invocarea şi
propunerea de probe/admiterea şi administrarea acestora. Legea reglementează în
detaliu atât conŃinutul cât şi mecanismul probatoriu.
ConŃinutul probei este ceea ce dă în vileag proba, adică datele informative sau
elementele de informare pe care le propune proba (substantia probationis).
20 DenunŃul este încunoştiinŃarea făcută de către o persoană fizică sau de către o persoană juridică despre săvârşirea unei infracŃiuni. (2) DenunŃul trebuie să conŃină aceleaşi date ca şi plângerea. (3) DenunŃul scris trebuie să fie semnat de denunŃător, iar în cazul denunŃului oral, acesta se consemnează într-un proces-verbal de către organul în faŃa căruia a fost făcut. Plângerea trebuie să cuprindă: numele, prenumele, calitatea şi domiciliul petiŃionarului, descrierea faptei care formează obiectul plângerii, indicarea făptuitorului dacă este cunoscut şi a mijloacelor de probă. 21 Corpus iuris

ConŃinutul probei urmează să corespundă obiectului probaŃiunii, trebuind să conducă
într-o măsură oarecare la confirmarea sau infirmarea acesteia din urma. În caz
contrar nu există probe, ci numai aparenŃa unei probe.
În procesul penal funcŃionează principiul libertăŃii probelor, principiu care se
manifestă pe de o parte sub aspectul libertăŃii de a produce probe, pe de altă parte sub
aspectul aprecierii acestora.22
Inadmisibilitatea unei probe în procesul penal poate decurge din contradicŃia
ei cu cunoştinŃele ştiinŃifice.23
Constatări II
În conŃinutul probatoriului întâlnim o serie de acte procesuale Ńinând de titlul
III cap. II sectiunea V – a Codului de Procedură Penală “interceptările şi
înregistrările audio sau video”. Relativ la acestea ne atrage atenŃia redarea în formă
scrisă a conŃinutului înregistrărilor convorbirilor telefonice, mai precis stilul
comunicării verbale care nu se bucură de claritate, simplitate, naturaleŃe şi
corectitudine, cuvintele nu sunt potrivite cu ideile pe care le exprimă, nu sunt logic
înlănŃuite pentru a fi înŃelese24. În concret din lecturarea comunicărilor verbale în
conŃinutul şi forma prezentată, în rechizitoriu nu pot fi desprinse date informative sau
elemente de informare care să confirme obiectul probaŃiunii (fapte şi împrejurări care
ar putea împlini conŃinutul infracŃiunii de luare de mită).
Pornind de la acest argument se poate afirma că la data soluŃionării cauzei,
dacă instanŃa nu a solicitat concursul unor specialişti nu a fost în posibilitatea de a
cunoaşte forma logică a exprimărilor şi în consecinŃă nu a avut posibilitatea
aprecierii acestor mijloace de probă.

expertale ce Ńin de semantică, ramură a lingvisticii care studiază sensul cuvintelor şi
propoziŃiunilor. Raportul expertal privind transformarea în forme logice a

Concluzie
Având în vedere mecanismul probator indicat de Art. 63 (2) C.pr.pen........
“Aprecierea fiecărei probe se face ............. de instanŃa de judecată în urma
examinării tuturor probelor administrate, ...........“ se impune ca apărarea să procure
redimensionarea ştiinŃifică a înscrisurilor la care a făcut referire prezentul raport de
cercetare.

Abstract: Speaking in regards to one penal system it is complicated enough;
however, discussing two systems simultaneously and providing a sound analysis is
even more complex. Still, we can learn something from observing what works in
these systems and what doesn’t and also, what we have to learn from issues and
strengths. When we speak of Romanian Prison System and Azerbaijani Prison
System we compress a lot of important information to debate. Based on the Criminal
Code, carriage of sentences law and regulations for internal disciplines in prisons
from the both countries, we will conclude the weaknesses and strengths and also,
alternatives in prison system.

Abstract: Când vorbim despre un sistem penal, este deja complicat, însă atunci când
avem în vedere două astfel de sisteme şi le analizăm în paralel devine mai mult decât
complicat. Totuşi, putem să învăŃăm ceva dacă observăm ce funcŃionează în aceste
sisteme şi ce nu funcŃionează şi deopotrivă, să învăŃăm din punctele lor slabe cât şi
din cele forte. Când vorbim despre Sistemul Penitenciar din România şi Sistemul
Penitenciar din Azerbaijan, însumăm deja o pepinieră importantă de informaŃii
pentru a le dezbate. Bazându-ne pe Codul Penal, Legea de Executare a Pedepselor şi
Regulamentul de Ordine Internă a penitenciarelor din ambele Ńări, vom concluziona

care sunt punctele slabe, punctele forte şi deasemenea, alternativele din aceste
sisteme penitenciare.

Introduction
During the six months spent in Azerbaijan; the main purpose was not for
research of the criminology, I successfully read, reviewed, analyzed, and held
meetings with experts in the area of criminal justice to summarize the functions of
the criminal justice system in comparison to the prison system of Romania. The end-
state of the research and analysis provided input on courses of actions for
improvements to each system.
The intent of the article is not meant to summarize and/or compare the prison
systems of Azerbaijan and Romania, but instead to annotate direct lines for the
implementation of strategic and long-term projects. PROBATION junior is a journal
encouraging discussion, critique and suggestions I believe presenting this article will
provide substantial benefits to the research, analysis, and conclusion.
I might add, Azerbaijan is an amazing country, very different than
Romanian, culturally. This substantial difference of culture brings many advantages
to those enthusiastic about the potential partnership between Romania and
Azerbaijan.
To begin with, I invite you to review the larger picture regarding these two
prison systems:

According with the new Criminal Code, still not
adopted, but beginning to be implemented in
specific areas, through a series of laws, the
prisons in Romania reconfigured: we do not find
anymore prisons including all the regimes in one

Romania for 10 years has Probation System,
which is the alternative system to detention.
Meaning that those criminals receiving a
suspended sentence under supervision (for adults)

Conditions for Probation regarding suspended

a) the sentence applied is prison no more
than 4 years
b) the criminal wasn’t condemned before to
a sentence more than 1 year
c) based on one evaluation report at the
judge’s request26
Azerbaijan has adopted in 2007 a law which
regulates European conditions for sentences and
carriage of sentences. Also, the Criminal Code
supports alternatives methods to detention. Still,
the sentences are carried into prisons!
Prison National Administration (PNA) is a public
institution of national interest, with legal
personality, subordinated to Ministry of Justice.27
Under Minister of Justice there are 2 Deputy
Ministers and one of them is also the Director of
the Penitentiary Service. The Penitentiary Service

Under PNA are subordinated all the prisons in
Romania.
Besides PNA, there is Probation Direction under
Ministry of Justice which coordinates Probation
System in Romania.
Institution within the structure of the Ministry of
Justice carries out the Penitentiary Facilities and
other Units.28
“In order to ensure transparency and public
supervision over the penitentiary a Public
Committee composed of the famous human rights
defendants and NGO members was established. It
has been already for 4 years that the Committee
realized effective activity constantly visiting all
penitentiary facilities.”29

regarding public participation to rehabilitate
inmates and public control over prisons.
“Coordination of activities of the Public
Committee on supervision over penitentiary and
correction of prisoners, is solely also carried out
by the Department of Human Rights and Public

consulted regarding jobs. The place is still
unfunctional.
Without a concrete reintegration program for offenders, rehabilitation in prison is useless!
Methodology
Utilizing content analysis as the method and content key as the instrument,
this paper is presented as qualitative research. Materials used during research include
Criminal Codes from the both countries (Romania and Azerbaijan), with regard to
Romania, considerations include the ongoing revision to the current Criminal Codes
(to date not adopted however, laws have been implemented). Additionally, research
included carriage of sentences laws from the both countries, taking special
consideration to include the new law which modifies and completes the current law
regarding carriage of sentences in Romania; and the regulations for internal
discipline in prisons from the both countries. Also, I used other electronic and paper
materials, as well as information received during my term in Azerbaijan meant to
help improve the quality, relevance and transparency of the present paper.
The indicators I followed include: alternatives methods to detention; cultural
differences; specificities of prison systems; opportunities for social intervention. The
following analysis is based on the above mentioned indicators.
As a special note, due to my expertise over the past five years with the
Romanian prison system the paper’s perspective may include Azerbaijani prison
system’s information, preponderantly. Additionally, the intent of this paper is not to
compare the Prison systems Romanian and Azerbaijani Prison System and the
deficits they have, but an analysis high lightning the potential and future
collaboration that can be done, because personally I am deeply interested to continue
practically this paper approaches.

Data analyze
1. Alternatives methods to detention
Taking in consideration the Azerbaijani Criminal Code we can observe the
leaning toward a democratic approach of their criminal system: “punishment is
applied with a view of restoration of social justice, correction of condemned and
prevention of committing new crimes by condemned and other persons”.31 This is a
good statement for future projects if we will have in consideration. Still, one must
wonder, right now, what this sentence means and how does it been implemented?
Going further with the Azerbaijani Criminal Code, at kind of punishments we
can observe beyond “imprisonment”, sentences like “public works” and “corrective
works”.32 But what does that mean? We take in consideration that Azerbaijan does
not have Probation System and even the sentences carried inside of a Community
(Settlement) Penitentiary Institutions mean imprisonment. Well then, it is obvious we
are talking about a carefully attention to this kind of conception we call
“rehabilitation”. Even so, we are focusing on work and not also on professional
activities. Still, into the Azerbaijani law for carriage of sentences we find out that
“the sentence of public works shall be carried out by the officer of justice in public
places identified by the competent executive authority with jurisdiction over the
convict’s place of residence”.33 So theoretically they do have alternative measures,
but practically there is no applicability of this so called “officer of justice in public
places”.
Also, interestingly, the following kind of punishment, “restriction of
freedom” means “maintenance of the condemned, which has reached eighteen at the
moment of adopting the court decision, in special establishment without isolation
from the society, but in condition of implementing supervision on him”.34

- for those at the first conviction for “deliberate crimes” for which they
receive 1-3 years of sentence,
- crimes committed on imprudence, 1-5 years of sentence,
- replacing “public works” and “corrective works” for which they receive
no more than 1 year of sentence.35
Still based on Azerbaijani Criminal Code, we can observe the attention of the
actors from criminal justice system for a restorative justice instead of retributive
justice as the following: “the person who committed a crime for the first time, not
representing big public danger, can be released from the criminal liability if he has
voluntary pled guilty, actively promoted disclosing of a crime, has indemnified or
has otherwise removed the harm caused as a result of a crime”.36
Also, “if the court appoints compulsory medical treatment of a convict for
alcoholic or drug addiction as well as mental disorders, such treatment arrangements
shall be made by the institution or agency carrying out the sentence during the period
of sentence”.37 The question exists, do these specification apply, because in Romania
it does not? Many mentally ill offenders can be found in prison.
In the same Azerbaijani law for carriage of sentences we can read about
carriage of sentences of custodial restraint, which take place “near their (i.e. inmates)
place of residence”38 which, yes, is an alternative sentence to prison. But how much is
it used?
So, at least on the paper, the power of implementing programs applied on an
alternative sentence to detention basis. Even more, when we do have written in the
law of carriage of sentences, section VII regarding “Supervision of Convicts on
Probation”, I can not wonder, how much availability the Azerbaijani Criminal Justice
System preserve for a practical alternative?

2. Cultural differences
“Convicts shall wear identical uniforms at penitentiary institutions. The form
of such outfit shall be specified in the Internal Disciplinary Policy”.39 More than that,
“convicts shall be prohibited from keeping and using cash, securities and valuables
as well as other items specified by the penitentiary institution’s Internal Disciplinary
Policy, in order to enforce compliance with the terms and conditions of carriage of
sentence”.40 Inmates use a personal account at penitentiary institution on a non-cash
basis. This non-cash basis concept is a little misunderstood when we look at the types
of penitentiary institutions and we find that inmates, as a privilege by being in a
specific type of penitentiary institution, they are allowed to “may spend cash”.
What is really interesting is that “convicts of working age, convicts that
receive wage or pension shall pay for clothes and nutrition provided. Convicts
deviating from work shall be deducted this amount from their personal accounts”.41
We can find this statement also in the law for carriage of sentences: “capable
convicts of age paid salaries or pensions shall pay for the food and clothes provided
except for special food products or special clothing. […] The cost of food and clothes
shall be paid monthly within the limits of actual monthly expenditures”.42 The rest of
inmates are receiving all this on the state’s expenses.
Also, important is the fact that Azerbaijani inmates have the right to use
phone and send letters on the prison’s expense, of course with some limitation and in
some conditions. But, the “penitentiary institution’s management shall censor written
communications/correspondence sent and received by convicts except
correspondence to and from their counsellors or other persons duly authorized to
provide legal assistance and counsel”.43 “Convicts letters sent to state institutions,
non-governmental organizations and officials shall be accompanied by cover letter of

penitentiary management. Cover letter shall reflect on view of penitentiary
management on the described matter”.44
Making a short comparison with Romania, inmates do not need to wear
identical clothes, they have the right to use their own clothes and if they don’t have
they will receive from prison.45 Also, they have the right of using money inside of
prison, do not pay for the food they eat and they use phone and send letters as many
they want, on their expenses. Also, the correspondence is private.
“Rejection to work or disruption of professional activity without a legitimate
reason shall be deemed a breach of the rules for carriage of sentences and shall
constitute grounds for application of disciplinary actions against, or holding convicts
financially liable”.46 This statement appears in the newest Romanian law which
modify and complete the law regarding carriage of sentences, presenting the
following phrase: “inmates can be asked to work based on their physical, mental
ability and according to the doctor advice”.47 This is a reconfiguration to the
following text which was changed and saying: “inmates, with their permission, can
work”.48 NGOs on human right already fired a warning because of this inflexibility
by obliging inmates to work despite of do not have proper condition for work and
choices regarding types of work that can fit on the inmate’s ability.
For those inmates under age (juveniles) “parental committees may be
established at rehabilitation institutions composed of parents or other close relatives
of the convicts in order to increase the effectiveness of the rehabilitation effect on
convicts and assist the rehabilitation institution’s management in
rehabilitation/reformation work. Operation of the parental committee shall be

governed by the normative legal act approved by the competent executive
authority”.49 I might say this sentence is a pretty important legal base for the parents.
If in Romania, the new inmates follows a 21 days of quarantine and at the
very beginning of their arrival they “need to wash and, as appropriate, cutting
measures and deworming will be taken”50, in Azerbaijan “newly admitted convicts
shall undergo comprehensive sanitary disinfection. During disinfection hair and
beards shall be shaved off”51, without exception.
What Azerbaijani inmates are not allowed to do, also?
- sell, present or give in another way personal items and other goods to
other convicts
- play gambling games
- make tattoos either on own body or on other convicts
- use foul language and profanities
- put or hang photos, pictures from newspapers, magazines on walls,
beds or doors,
among others similar, this time, as in Romanian prison system.
For example, for somebody used with the Romanian prisons, making a tattoo
being seen as prohibited, might be, at least, comic.
Also, people in Azerbaijan can be exiled from Azerbaijan Republic according
to their Criminal Code.52
A special approach has Azerbaijani military units53 carrying our military
felonies. And this is because, I suppose, of the unwonted war situation between
Armenia and Azerbaijan.

Another interesting fact is abortion. In Azerbaijan abortions are considered a
felony, if the abortion is made by a “doctor who is out of medical institutions”54 or
“by a person who does not have special medical education”55. While in Romania,
besides those two crimes, “if the pregnancy stage exceeded 14 weeks” is still a
crime. After those 14 weeks, it is considered that the fetus had developed the brain
and he can feel pain.
What we should ask more here is that Azerbaijan gives a closer attention to
gangs, hooliganism and ecological crimes on its Criminal Code, aspects that
Romania does not approach too much, neither in the present Criminal Code, nor in
the new one.
3. Specificities of prison systems
This indicator used, preponderantly, based on rehabilitation and reintegration
aspects observed in those two prison systems.
We do observe even from the beginning of the Law of Carriage of Sentences
of Azerbaijan, that its objectives are to “ensure rehabilitation of convicts”56, “identify
tools for rehabilitation of convicts”57, apply “of rehabilitation tools with respect to
convicts”58 and “ensure and promote involvement of competent executive
authorities, other institutions, agencies or organizations, public funds and individuals
in rehabilitation of convicts”59. Consequently “sentences shall be carried out,
rehabilitation tools shall be applied to convicts and assistance shall be provided to
persons released from conviction in accordance with the then-current applicable
laws”.60
What means rehabilitation in Azerbaijan? “Rehabilitation of convicts is a set
of measures with an aim to stimulate convicts to abide by the law and to form the
sense of respect and esteem with respect to people, society, labour, traditions and

customs of social co-existence. Described below are the principal convict
rehabilitation tools:
- pre-determined order (regime) for carrying out and serving sentences
- educational work
- socially useful work
- general education
- vocational training
- social influences
Rehabilitation tools shall be applied to convicts on a case-by-case basis given
the kind of the offence, degree and nature of social risk of the committed offence,
personality and behaviour of the convict”.61 More, “the officer of justice shall be
responsible for carrying out inflictions involving rehabilitation practices”.62
As in Romania, Azerbaijan encourages working with public organizations
(NGOs in Romania).63
If you look carefully at the following statement making reference to “the
sentence of rehabilitation activities shall be carried out at the place of the convict’s
principal employment”64 you might think it has something to do with work action.
And basically, this mean, at least in this article. Rehabilitation = Work. But from my
personal knowledge, only 15% of inmates in Azerbaijan work in prisons. So, I might
ask, where is the rehabilitation applying?
“Prison area shall be divided into restricted and production areas”.65 Even
“medical treatment penitentiary shall be divided into treatment restricted area and
production area”.66 So, again, taking in consideration the remark we had at the
previews indicator regarding obligation to work, we might confirm that rehabilitation
= work. Not adding that besides supervising staff in Azerbaijan prisons, there are no
permanent specialists working there. So, the fact that “penitentiary staff shall […]

conduct education/correction work with convicts”67 proves us the need of a new
approach.
In what concerns Romania, there are a lot of rehabilitation programs into
prisons, implemented either by the specialists inside of the prisons (social workers,
psychologists, educators), or by the civil society through NGOs. The main issue in
Romania remains, evaluation of all those programs. And another part of this issue is
the lack of connection with the reintegration actions. Unfortunately, the inmates after
release have nothing. And this is a fact. Fortunately, PNA started a year ago a
National Strategy for Social Reintegration calling all those social actors involved in
working with offenders. Still, hoping for concrete results, beside applaud the
initiative.
Through the law 83/2010 in Romania inmates are encourage to work
voluntary in change of free days from sentence.68 Also there is a multi-disciplinary
team working determine a better type of carriage of sentence by the inmates and also,
determine a better, theoretical, reintegration strategy into society.69
Education (school) in prison is encouraged from both parts, Romanian and
Azerbaijani.
As was written at the beginning of the present paper, theoretically, on papers,
Azerbaijan does have and Adaptation Centre. Romania unfortunately, can not speak
about something similar, not even on papers.
Azerbaijani system, as Romanian system, does have parole and those
convicts release on parole “shall be supervised by the officer of justice of the court
having jurisdiction over the convict’s place of residence”.70 In Romania, only in the
new Criminal Code (still not adopted, but started to be implemented in specific arias,
through a series of laws) it is approached supervision in the context of parole and the
supervision should be made by the probation officer (from Probation System).
According to the current Criminal Code, there is no supervision of those releasing on
parole.

4. Opportunities for social intervention
Based on what we discussed already, further I will insist over the followings:
- Alternatives methods to detention
- What can be done on rehabilitation and reintegration?
It is known nowadays the inclination over restorative measures in what
concerns criminal justice. Every concept, even just written on the papers and
documents, counts because it denotes a possibility for social intervention. So, when
we find “restoration of social justice” in Azerbaijani Criminal Code we have the
proof of a potential intervention here based on restorative principles. In Romania,
because of the existence of its Probation System combine with the speed of changes
in the prison system we have the entire free road for creation in the field of social
intervention.
As we can find concepts like “public works” and “corrective work” in
Azerbaijani laws, it is well known also, the tendency toward community work in
Romania. These kinds of tendencies are very approached by the social scientists that
preserve this measure, either in prison, or in probation. So, let’s just focus attention
on creating, preparing and take action in this specific field, of providing work places
for offenders.
What about “officer of justice” as mentioned in Azerbaijani laws, or
“probation officer” as mentioned in Romanian laws? I might not be much clarified
with the concept in Azerbaijan and its application, but still need to exercise it and if it
does works, we need to evaluate its work: if it is better than the “officers” from
prison? If it is better, so let’s focus on it!
“Restriction of freedom” and “sentence of custodial restraint” in Azerbaijani
laws are, as we can understand, alternative measures. Still, I came with the same
question, or questions: Are they implemented?; If yes, are they evaluated?; If yes, do
they work?; If yes, how much they are used? etc.
Also, if we do have the legal basis in using probation, so let’s use it
completely!
Now, stepping forward to what can be done on rehabilitation and
reintegration, again I will focus on the fact of having the “rehabilitation” concept in

laws and “rehabilitation tools” as form of implementation the concept. So, basically,
it is accepted that rehabilitation consist of education, social sphere, vocation, work
and a proper context for all of this. Still, how does rehabilitation exist and how is it
understood it is a crucial view, either for Romanian prison system, or for Azerbaijani
prison system. And more than that, as already expressed in the above, how
rehabilitation is evaluated and also, how rehabilitation is putted in connection with
reintegration actions?
Because if we will refer to reintegration and we will observe in the laws from
the both countries the existence of so called “officer of justice” (Azerbaijan) or
“probation officer” (Romania) as a supervisor on parole, we can’t not ask our self,
what this officer really can do if he/she is not aware of what the offender had been
through in prison? If I look deeply I might say, we can not evaluate any of these
rehabilitation programs if there is not, I will call, a rehab-reintegration program.
Therefore, in my opinion, it is wrong to speak of rehabilitation and reintegration
programs as two different interventions or different designed programs. We must
start to refer to rehab-reintegration programs!
As we can observe, even from the bases of prisons’ existence “work” activity
was the most important and required activity. But, we must not forget, that in order
to have a well work activity, we need, a proper place and different job offers in order
to speak about relevance, human rights and effectiveness. Just a division “into
restricted and production areas” is not enough.
More over, let’s use an extreme important and with huge and unexpected
results tool, called voluntary. Voluntary concept brings more benefits that you can
imagine! It will develop an offender at the personal and professional level in an
amazing way. And plus, the benefits those offenders will bring back to the
community, are, let’s just call, a paying back, which, I believe, community will
appreciate, more than redemption injury through imprisonment.
In order to build a rehab-reintegration program or a rehab-integration
program (for offenders that carried the sentence into community) we must assure that
out there, into community, there is an Adaptation Centre, as prescribed in
Azerbaijani laws. And even have a practical National Strategy of Social
Reintegration, involving all those actors who deal with offenders in all stages, as

Romania implement. With such concrete measures that can really work, I personally
believe in the power of these rehab-reintegration programs. But for this, we must
have specialists as social workers, psychologists, educators, sociologists, working in
prisons and/or in probation and also, we must open widely our doors for a transparent
partnership with the civil society, otherwise it will be in vain all our efforts.
Conclusions
What I wished through this article was to shed a light on the general situation
regarding those two prison systems and to emphasize with what there isn’t and it
should be done in working with offenders. Based on these related it can be created
many niches of social intervention. Personally, I really believe in a partnership
between Romania and Azerbaijan regarding prisons, because it prevails many
opportunities.
Forward, I will based my conclusions on giving an interpretation to those
analysed till now, taking in consideration the fact that I was only analysing the
information and not interpret them. Even so, my interpretation will summarize the
relevant facts.
First aspect must be followed in implementation of working places, inside of
prison and outside of prison (outside concept either that mean, for inmates to work
outside of prison while imprisonment, or for offenders from probation). Appropriate
working and I already explained what it supposed to mean, offers to offenders a sens
of utility for him/her self or for society and also a help for passing time, it helps also
in keeping and improving skills and it is a source of money. May be we can add
much more at the importance of a job as an offender but I will stop here. Also, I must
add the importance of other type of activities as beyond work, offenders must acquire
their crime effects and by default finding methods for change. And for this you need
specialists.
If we don’t have specialists or we don’t know how to use them, may be a
solution can be an experts’ exchange in order to look for options, methods, skills,
know-how etc. Accessing experts and their experience, involve a way of improving

of what we have or find resources for what we don’t have and so, if we don’t have an
alternative, we can create it, or if we have it, you can improve it.
Therefore, rehab-re/integration programs must be performed in order to have
a realistic and purposely evaluation to improve criminology field, regarding
recidivism. Once, Mister Professor PhD Gheorghe Florian told me that relapse is not
such a big issue comparing with new criminals generation. Once you have the same
criminals flowing into your prisons, prove that your society is, basically, safe and do
not create new criminals. But is that so? Once, even if you deal with the same
criminals in a continuous relapse, means that you are absolutely incompetent in re-
finding them the place, from which they came from. And personally, I thing this is a
very big issue, because it does prove the irrelevance of the specialists intro prisons
and even the irrelevance of the prisons existence. Having issue with the same
offenders prevails an example for new potential criminals in start being criminals
while they see how easy is for notorious criminals to return into prisons. The
sentence with imprisonment will be not seen as a serious and un-wanted measure
may be, in order to discourage offenders. Working in the same time, prevent new
crimes, it is already another story! So, yes, I believe relapse is a social disease as the
new criminals’ existence and yes, we do need rehab-re/integration programs!
Another subject I must insist over is encouraging alternative measures to
detention in providing all types of projects to determine the efficiency of those
measures despite imprisonment. Because many developed countries use probation
and alternative sentences in general, increasingly more and improved in a much
humanized way, it has a logically base.
I already said above about the importance of an Adaptation Centre and a
Strategy in reintegration, without which rehabilitation programs would be useless
and also, it could not be implemented a real evaluation.
Lastly, if in Romania there is a ground of more than 20 years of civil society,
implicitly in justice aria and personally, I showed last year the importance of a Team
Work between the Prison and Probation systems and civil society, in Azerbaijan this
relation is been build for 4 years already, through this Public Committee. Personally,
I admire the initiative and I encourage improving it more!
