In Re: SUSPENSION OF STATUTES, RULES AND DOH No. 18-277 ORDERS, MADE NECESSARY BY HURRICANE MICHAEL.

EMERGENCY ORDER

Pursuant to the authority granted by Executive Order No. 18-276, I find that strict

compliance with the provisions of certain statutes and rules regulated by the Florida

Department of Health will prevent, hinder, or delay necessary action in coping with the

emergency caused by Hurricane Michael. In order to effectively respond to the emergency

caused by Hurricane Michael it is necessary to promulgate the following:

For the purposes of responding to and mitigating any effect of Hurricane Michael, the

Prescription Drug Monitoring Program Manager is authorized to share Florida prescription

drug monitoring information, including allowing access to the Florida Prescription Drug

Monitoring Program, with the Alabama Department of Public Health, the Georgia Department

of Public Health, and the Mississippi State Department of Health in order to verify prescription

drug information for Floridians affected by Hurricane Michael that have evacuated to those

states. This paragraph exempts the Department from the requirement of additional

agreements with Alabama, Georgia, or Mississippi pursuant to Section 893.055(6), Florida

Statutes.

Because section 252.36(5)(a), Florida Statutes, allows the Governor to suspend the

provisions of “any regulatory statute prescribing the procedures for [the] conduct of state

business,” and because Section 4. B. of Executive Order No. 18-276 provides the State Surgeon

General with the authority to issue this Emergency Order, the requirements of sections 252.46

and 120.54(4), Florida Statutes, do not apply to this Order.

The effective dates of this Order shall correspond with the effective dates of Executive

Order No. 18-276.
