TERMS & CONDITIONS FOR THE SALE OF GRADED, TRADITIONAL, PURE AND
RARE BREEDS POULTRY AND WATERFOWL
1. The Sale will be conducted under the Melton Mowbray Market (MMM) terms and conditions which may be viewed in the Fur & Feather office. Entries will ONLY be accepted on the official entry form, which MUST be signed by the vendor.
2. All stock must be in place by 08:15 on the day of the sale. Grading will commence at 8:30am.
3. Neither the Auctioneers, nor any of their officers or servants, shall be in any way responsible or accountable for any loss or damage howsoever caused whilst on the market premises prior to, during or after the sale. Each vendor will be solely responsible for any consequential or other loss, injury or damage done to or occasioned by or arising from any bird entered by him and shall indemnify the Auctioneers against all legal or other proceedings in relation thereto.
4. The cost of any veterinary attendance or treatment before, during or after the sale shall be borne by the owner of the bird concerned.
5. Owners are responsible for the behaviour of their servants and for the consequences of any misbehaviour of such servants.
6. The Auctioneers reserve the right to refuse entry or to cancel any entry already accepted and will do so in respect of any bird which in their opinion does not conform to the required health or breed standard. Entry Fees will be forfeited in such cases.
7. Method of sale. A Lot will be the contents of a cage, and will be sold in £s. Lots will be sold in catalogue order unless otherwise announced by the Auctioneer.
8. Upset price. A minimum starting bid of £5 will apply to all lots. If the upset price is not bid, the Auctioneer will pass on to the next Lot.
9. Reserve price. A reserve price may be placed on any Lot. Such reserves must be included on the Entry Form.
10. Sales may be made privately, providing the Lot has first been offered by auction and the sale is booked through MMM and commission paid.
11. Buyers Numbers. Potential purchasers are reminded to collect a Bidder’s Number (in exchange for verifiable details of name & address) in the Auctioneers Office before making any bids.
12. Clearance. All Lots must be cleared from the market premises on the day of the sale by 4pm or 1 hour after the last lot has sold. Failure to do so will result in the Lot becoming the property of MMM. Purchasers may NOT remove Lots without first presenting proof of ownership (i.e. a receipted bill) to an official steward. Vendors with unsold Lots must also produce a PASS from the office before removing the Lots.
13. Animal Welfare. All birds must be transported in suitable containers. Sacks are unacceptable for this purpose. Supplies of water and bedding will be available, but owners must provide their own containers. OWNERS MUST ENSURE THEIR BIRDS HAVE ACCESS TO WATER AT ALL TIMES.
14. Settlement is due to the Auctioneers immediately at the close of the Sale. Payment will be made to vendors by BACS within two weeks of the date of the Sale. If a dispute is raised regarding a lot, payment may be delayed. Please ensure you provide MMM with you BACS details.
15. Commission. 15% commission will be charged on the sale price of each lot making up to £80. Any lot realising over £80 will be subject to 10% commission. At the Auctioneer’s discretion half commission may be charged on the reserve price of unsold lots if, in his opinion, the reserve price was intentionally set at an unrealistic level in order to deter bidders. Buyers will be charged a premium of 10% of the Hammer Price of each Lot.
16. If Vendors wish to supply additional information about a Lot this may be written on a card showing the Lot Number and displayed on the cage.
17. Substitute Lots of a different class will NOT be accepted in place of any Lots which are withdrawn by the vendor on the day of the sale, neither will entry fees for such Lots be refunded.
