56.4 K. Kovacs K. Kovacs distributed and reviewed meeting minutes of meetings with the Police
Department, dated 9/24/15 and Logistics Working Group, dated 6/17/15, both attached
herein.
K. Kovacs to schedule the final design review meeting with the Fire Department.

3. B. Tolson asked if the model can be updated to reflect the final interior
materials?
K. Kovacs indicated yes the model will be updated for the next Committee
meeting.
4. J. Day asked how big were the corridor porcelain ceramic wall tiles?
K. Kovacs indicated each tile is approximately 36” high by 8” wide.
5. D. Moriarty asked if all the exposed structure and MEP piping/ducts/conduit at
the gymnasium ceiling are painted?
K. Kovacs indicated yes.
6. J. Day asked if the backs of the auditorium chairs are a plastic molded shell?
K. Kovacs indicated yes.
7. T. Taylor asked what are the types and percentages of attic stock material?
K. Kovacs indicated FAI will provide direction at the next Committee meeting.
A motion was made by P. Mahoney and seconded by J. Day to approve the Final
interior Materials Color and Patterning. No discussion, motion passed unanimous.
56.8 K. Kovacs K. Kovacs distributed and reviewed the analysis of potential new roads at the existing
wetlands to the north and east of the site, attached, that FAI developed and presented
during the Schematic Design Phase.

56.9 Record K. Kovacs distributed and reviewed the floor plans indicating the distribution of single
user and multiple user toilet rooms throughout the building.
Committee Questions:
1. P. Coppola-Lugo asked how many Nurses Suites are there?
K. Kovacs indicated two; one in each Academic Wing.
56.10 Record C. Riordan reviewed the bid tabulation form for the Masonry Trade Bids, attached, and
reviewed Consigli Amendment No. 3, dated 10/7/15 for Package No. 3 – Masonry
Work, attached, in the amount of $4,940,517.00. The Amendment is below the
Construction Budget.
A motion was made by P. Mahoney and seconded by B. Davis to approve Consigli
Amendment No. 3, dated 10/7/15 in the amount of $4,940,517.00 and recommend
signature by M. Moore. No discussion, motion passed unanimous.
56.11 C. Riordan C. Riordan to submit the credit for using the surplus furniture from the Town Hall.
56.12 Record C. Riordan provided a construction status update. The Baseball and Softball Outfields
work is nearing completion, however the topsoil final grading and seeding has been
impacted due to the inadequate capacity of the irrigation wells. The topsoil final
grading and seeding will be installed in the spring 2016. The concrete foundations are
nearing completion in Wing B and have commenced in Wing A. All foundations are on
target for completion in December. Structural steel is on schedule for December
delivery and masonry bearing walls are scheduled to commence the end of October.
C. Riordan asked that all visitors to the site fill out a Visitor Release Form, attached.

J. Seeley reviewed the condition with the irrigation well. GMP Amendment No. 1
included drilling one irrigation well to 400 feet, with a unit rate adjustment of $11 per
lineal foot for every lineal foot above or below this depth needed until adequate
capacity was reached. The first well was drilled to 1,000 feet near the ballfields,
yielding inadequate capacity. A second well was drilled to 1,000 feet in a location near
the concession stand, yielding inadequate capacity. The costs incurred to date, plus a
third well are defined in CR014-P1, attached. Prior to drilling a third well, J. Seeley
asked the Committee to provide direction.
Committee Questions:
1. S. Towne asked if the geotechnical engineer can provide insight into an
optimal location for a third well?
K. Kovacs indicated the geotechnical engineer is reviewing the results of their
borings, however they are only approximately 20 feet deep.
2. J. Day asked if there was a service that can help provide an optimal location
for a third well?
K. Kovacs indicated they are researching and will provide direction.
3. P. Mahoney indicated two irrigation wells were drilled for Sumner Fields, as the
first well yielded inadequate capacity. The second well is located on the
southern side of the property.

4. M. Bolger asked what is the back-up plan if a third well is unsuccessful?
J. Seeley indicated the project would need to seek relief from the Irrigation
Use Restrictions. P. Mahoney indicated the authority might be the Tri-Town
Water Board.
A motion was made by P. Mahoney and seconded by J. Day to drill the third well. No
discussion, motion passed unanimous.
56.14 Record M. Bolger reviewed the condition of the existing bleachers. The bleachers, scheduled
to be demolished, are in a state of disrepair and deterioration. He has asked town
departments if they have a need for them, so far no department has responded
positively.
M. Bolger asked the Committee to provide direction.
A motion was made by P. Mahoney and seconded by J. Day to continue with the
demolition and removal of the bleachers. No discussion, motion passed unanimous.

1. P. Mahoney asked if a Maintenance Plan and Budget can start to be
developed by the School.
K. Kovacs and M. Bolger to meet and review the GGD HVAC equipment
maintenance overview provided to the Committee during the Design
Development Phase as a starting point.
2. B. Tolson requests a followup tour of the West Bridgewater school.
K. Kovacs will organize a followup tour.

Section 03 45 00 – Precast Architectural Concrete Furnish and install

11. At locations shown on the structural drawings, interior footings are lowered to avoid under slab piping. Include additional CMU as required to reach these dropped footings.
12. Include false work for masonry headers 13. Include provisions for blocking out for access panels in masonry walls per quantity stated above.
Coordinate with full drawing set for sizes of ductwork, electrical conduits, fire protection, structural steel and other materials requiring block-outs in masonry walls
14. Include provisions for blocking out openings for MEP penetrations greater than 12” round per quantity stated above. Coordinate with full drawing set for approx. sizes and locations.
15. Include provisions for control and expansion joints in masonry walls. It is mutually understood that structural reinforced/grouted walls will not have any control joints.
16. Provide for rough openings for elevator frames, tooth in CMU and grout frames after installation of elevator door frame by others.
17. Include provisions for all bond beams and install of loose lintels at masonry openings. Provide rough openings for new hollow metal door frames. Tooth in CMU and grout fames after install of frame by others.

OWNER – CONSTRUCTION MANAGER AGREEMENT
Authorization of Compensation for Services Rendered for Bid Package 3 – Masonry - Prior to
Guaranteed Maximum Price Approval
Amendment Three to the Owner – Construction Manager Agreement is executed this 7th day of
October, 2015, in the not-to-exceed amount of Four Million Nine Hundred and Forty Thousand, Five
Hundred and Seventeen Dollars and Zero Cents ($4,940,517.00), by the Awarding Authority, Town of
Holbrook, hereinafter referred to as the “Owner,” by and through the Holbrook Permanent School
Building Committee, and Consigli Construction Co., Inc., hereinafter referred to as the “Construction
Manager” or “CM.”.
The parties hereto agree that the provisions set forth herein shall supplement, by amendment, the
previously stipulated provisions of the Owner – CM Agreement and General Conditions.
Whereas , the Owner and the CM are presently engaged in the process of determining the Guaranteed
Maximum Price (“GMP”) for the project within the Agreement, and no agreement has yet been reached
regarding the date by which the CM shall submit a proposed GMP to the Owner in accordance with
Article 6.5.1 of the Agreement; and
Whereas, the Owner has authorized the CM to commence certain construction services associated with
Package 3 in advance of the Owner’s approval of a GMP, and, in conjunction therewith, the Owner
wishes to implement a procedure to authorize compensation of the CM for such services upon
satisfactorily performance thereof;
Therefore, pursuant to Article 6.5.2 of the Agreement, the parties hereby stipulate that compensation
for services rendered by the CM prior to the Owner’s acceptance of the GMP shall be authorized upon
the following terms and conditions:
1) Prior to the submission of first application for payment, the CM shall submit a schedule of values for
all construction activities authorized, in such detail as the Owner shall require, pursuant to Article VIII.1
of the General Conditions.
2) The CM shall submit periodic application for payment, which shall comply with and be processed in
accordance with the provisions of Article VIII.4 of the General Conditions, for work completed in each
respective payment period.
3) Payment for authorized services rendered prior to approval of the GMP shall be made by the Owner
subject to and in accordance with applicable provisions of the Contract Documents.
Upon acceptance of a GMP by the Owner, the provisions of the Contract Documents relative to
submittal of a schedule of values, applications for payment, and payment for services rendered shall
apply without regard hereto, and the terms of the Amendment shall expire.
Except as provided herein, all other provisions of the Owner-Construction Manager Agreement shall
remain in full force and effect.
IN WITNESS WHEREOF, the parties hereto have caused this instrument to be executed under seal as of

Meeting Notes DATE: September 24, 2015 PROJECT: Holbrook PreK-‐12 School PROJECT NO: 1314.00 PRESENT: Chief William Smith – Holbrook Police Department Doug Faria – Edvance Technology Vincent Dubé – Flansburgh Architects Kent Kovacs – Flansburgh Architects DISTRIBUTION: Attendees Police Department Technology (10:30am-‐11:00am)
• The purpose of this meeting was to followup a meeting with the Police Department in February 2015, to review the new school security camera access for the police.
• Edvance reviewed the basic functionality of the three systems (intrusion, card
access and video surveillance)
• The security system will have a web-‐‑based interface that will allow the police to view cameras at the new school real time.
• Discussion on connectivity between the police station and the new school. There is
a slight chance that a direct fiber connection will be made at some point. For right now, connectivity to the system will be via the web.
• Edvance will specify a computer workstation to be installed and configured at the
police station Squad Room by the security vendor for this purpose.
• The school and police will need to coordinate firewall and other network security components.
• The Chief mentioned a program that the State requires to have a Resource Officer at each school. In the future, the Chief expects the new school will have a Resource Officer at the school.
• The Resource Office will be provided with a security computer workstation with full
system access and control. The workstation will be in the Resource office, location to be determined.
• Kent mentioned that there were some traffic issues at the school recently.
• The Chief indicated that the issue of traffic at the school was somewhat affected by
the timing used by the crossing guard. The department feels the corrective action they suggested should help with traffic.
• Also, the Chief indicated that the department has an officer that routinely goes to the
schools on his motorcycyle to observe traffic. The officer has been on vacation recently, but will return soon.
• The new school will have a Resource Officer at the school which could also affect
traffic control.
• Kent indicated that the project team had revisited the bus stop location and has decided that not to moving the bus stop would be best, since there was no better alternate location identified. If the town still wants to relocate the buss top they would need to coordinate this with the MBTA.
• The Chief noted that the construction gate seemed too far from the street, he does
not want trucks parking in the drive in front of the gate. Kent noted that the contractor has directed the subs that deliveries are restricted at certain times of the day (7am – 8am and 1:45pm – 2:45pm during the next 2 school years) and the contractor has a couple of holding locations near the site where the trucks can park if they arrive during the restricted times.

October 6, 2015 District Responses to the 90% Construction Documents Review Comments District: Town of Holbrook School: PK-12 School Submittal: 90% Construction Documents Submittal Date: September 3, 2015 Review Date: September 4, 2015 – September 15, 2015 Reviewed by: Gienapp Design, Christina Strid, Karl Brown, Lee Deveau, Rich Hudson, Paul Fowkes MSBA REVIEW COMMENTS:
I. Summary Comments: a. The submission appears to be consistent with the 90% Construction Document
requirements. There is some concern that the Plumbing and Fire Protection drawings are lagging behind the level of completion of the remaining project. This is reflected in the comments herein as well as the OPM’s review of the documents contained within the submission documents. RESPONSE: The Plumbing and Sprinkler drawings are continually being updated and will be consistent with the other drawings.
b. As indicated in the comments below, the Designer and OPM should review and confirm there is adequate documentation on the construction of the existing building to result in competitive and accurate bidding. RESPONSE: See attached HM-01 through HM-05 for Existing Building hazmat removal. These drawings will be included in the final set for demolition and hazmat removal.
II. OPM Deliverables: a. Project scope, schedule & budget:
§ Independent construction cost estimates pursuant to Section 8.1.2.2 of the Contract for Project Management Services, for comparison with the Designer’s cost estimate, based upon 90 percent progress documents. Although an OPM cost estimate was not required because the construction manager provided an estimate, the OPM provided a cost estimate, by A.M. Fogarty, with a Total Construction Cost of $79,596,791. A separate cost estimate for the Designer, by PM & C, with a Total Construction Cost of $79,081,226, is included. Also included is a construction cost estimate by Consigli, the Construction Manager, with a total construction cost of $79,969,084. The Cost Estimate Comparison sheet indicates a Construction Cost of $79,563,879 but no information was provided to indicate how this amount was determined. No specific construction cost reconciliation analysis or information was included with the documents. Please clarify in the District’s response to this review. RESPONSE: The Consigli cost estimate of $79,969,084 is the reconciled estimate from the reconciliation meeting of the 90% estimates from Consigli, PM&C and AM Fogarty. The Reconciliation analysis for the 90% set is contained within the budget section Tab A and follows immediately after the Consigli estimate comparison between the 60% and 90% sets. The Cost Estimate Comparison sheet uses the project cost for the school building only, and does not include the cost associated with the Concessions Building near the football field. The cost for the Concession building is $405,206 which is listed

in the Ineligible Work section just below the School Building total. When combined, these two numbers add up to the 90% CD Estimate of $79,969,085. The Reconciliation Analysis included with the package did not include the totals from the other estimators. A new Reconciliation Analysis is included with this response that includes the totals.
III. Designer Deliverables: 1. General Requirements:
a. Submit updated work plan: There is an updated Work Plan statement included with the documents. However, it is very general in nature and does not provide a specific checklist or itemized strategy for completing the documents. This should be more carefully reviewed to determine a management path for completion and resubmitted in response to this review. RESPONSE: The Work Plan statement refers to the Project Schedule included in Section 1A for additional details which includes specific dates. The Work Plan includes additional meetings with the Building Committee and local agencies, as well as further plan coordination meetings with the design team members.
b. Submit updated environmental permitting assessment, building code analysis, ADA/MAAB analysis, and list of all required testing and permits. Provide a certification that all applicable local, state and utility officials have been contacted by the designer regarding each utility connection. There is a statement regarding environmental permitting included in the submission documents. However, it does not state whether this identifies and includes all necessary permitting. The submission documents include a two-sentence paragraph identified as Testing and Surveying Summary. However, this document only refers to hazardous materials. The Testing and Surveying Summary should include tests required during construction of the new building and other critical information. This should be updated for use during construction. RESPONSE: The permitting process has been completed. All applicable local, state and utility officials have been contacted. Site work has been started including utilities. The existing buildings have been tested for hazardous materials. JT Turner has been retained to perform on site testing during constriuction as necessary. See attached testing information from the early site construction phase.
2. Drawing Requirements:
§ Demolition drawings and temporary work required. There are no demolition drawings of the existing building. While there are specification sections for hazardous materials, Section 024116 Structure Demolition, appears limited in specificity regarding the existing building construction (including size) and the procedures for demolition. Review and confirm that adequate information is provided for accurate bidding for removal of the existing building. It is noted that 024116 Structure Demolition is responsible for filling below grade areas resulting from demolition (Article 3.7.A) in accordance with 312000 Earthwork. However, it is not specifically stated which materials (Ordinary Common Fill, Processed Gravel, etc.) and whether compaction

and compaction testing is required the same as for other work. It is unclear why backfilling should be performed by demolition rather than 312000 Earthwork. Review and include additional information and clarifications regarding demolition of the building and restoration of the site, as may be needed, prior to bidding. RESPONSE: Hazmat Drawings will be included in the final set. They should have been included with the 90% set. See attached reduced size plans (HM.01 – HM.05) for the format of the proposed plans for the final set. The Building demolition is indicated on the civil plans and will be noted on the Phasing plans, including the square footage, and is indicated in specification section 024116. Demolition procedures are generally indicated, but the means and methods will be by the demolition contractor. The demolition contractor is responsible for visiting the site and becoming aware of the existing building construction. The existing building does not have a basement, however, the site contractor is responsible for cuts and fills within the existing school footprint. The demo contractor is responsible for removing foundations and below-slab piping. The demo sub will remove loose soil that results from the demo and compaction of existing soils to remain. This information will be included in the CMR's supplemental instructions. The specifications will be revised to reflect this arrangement of work.
§ Architectural drawings shall include: 1. Roof plans including equipment. The roof plans do not appear to be adequately
developed, including the absence of HVAC equipment. These need to be further developed for bidding. The designated area for future photovoltaic panels is not included on the roof plans as commented in the last submission. This should be added prior to bidding. RESPONSE: The Clerestory Plans show all of the rooftop equipment as well as roof drains and other rooftop items. The roof plans do not repeat this information but reference the appropriate Clerestory plan. Additional information such as PV locations are indicated on the gym roof plan, in segment B. The clerestory information will be repeated on the roof plans for the final drawing set.
2. Building elevations. All building elevations, including hidden elevations, fully developed. The term “Alucobond”, (left over from prior submissions), still appears on the exterior elevations such as Drawing A3.01. Review drawings and omit the brand-specific reference, as needed. RESPONSE: Elevations will be revised to remove references to brand-specific items.
3. Reflected ceiling plans coordinated with fire protection, mechanical and electrical drawings, and ceiling details. The HVAC supply registers do not appear on the ceiling plans on interior rooms. This should be added before drawings are issued for bidding (it is recognized much of the supply air is done through sidewall registers). Sprinkler heads are not shown centered or otherwise coordinated with the ceiling tiles. Update as appropriate before being issued to bid (this was noted in the last submission). RESPONSE: The Reflected Ceiling Plans will be updated to coordinate with the MEPFP drawings prior to issuing.
§ Structural drawings shall indicate the following: 1. Floor and roof plans of structural systems including framing, grades of finished
floors and depressed areas, with locations and dimensions for all openings. Also

indicate design floor loads. Finished floor grades are not shown on the structural drawings. Consider adding for clarity. RESPONSE: The structural drawings have been issued for early bid. Finish floor elevations are shown on the architectural drawings.
2. Complete details and section with dimensions for all construction including expansion and construction joints, reinforcing and other embedded items. Expansion joint details are not yet shown on the drawings and should be added prior to bidding. This was noted in the 60% CD review. RESPONSE: The expansion joint details will be included in the architectural drawings. Some expansion joint details were issued as part of the Masonry bid addendum #1 which will also be included in the final set. The structural drawings indicate expansion joint locations.
3. General notes including the following information: class and 28 day strength of concrete for each portion, structural steel and concrete reinforcing design stresses for each type of structural member, concrete cover for each type of structural member, shrinkage and temperature steel requirements, reinforcing laps for main reinforcing and temperature steel; bend point, cutoff, and hook locations for all members, minimum beam and lintel bearing. The General Notes on Drawing S1.03A are obscured because they are too close to the edge of the paper and stapled within the binding. Review and graphically shift to provide more margin space. RESPONSE: The structural drawings bid set has been issued, but the general notes will be shifted on the drawings for the final submission
§ Fire protection drawings shall indicate the following: 1. All piping, equipment, fixtures and devices shall be located and sized. Piping sizes
are not shown on the Fire Protection drawings and need to be added before being issued to bid. RESPONSE: Pipe sizes will be added to drawings for final submission.
§ Plumbing drawings shall indicate the following: 1. All work done by the Plumbing Subcontractor, which includes all water, gas, air,
vacuum, medical gases, sanitary and storm wastes, and accessories. The boiler breaching is shown on the enlarged mechanical plan on Drawing M1.01C and is designated as being provided by 220000 Plumbing. The breaching is only single line on the enlarged plumbing plan on Drawing P3.01, within the room. Breaching outside Mechanical Room B165 is not shown on the Plumbing drawings and should be coordinated before being issued to bid. RESPONSE: All breaching will be shown on drawings for final submission.
2. Trapping and venting of all plumbing fixtures including floor drains. Trap details are not included on the drawings and should be added before being issued to bid. RESPONSE: Trap details will be shown on drawings for final submission.
3. All piping sizes shall be indicated on drawings and riser diagrams. Indicate all directions of flow and pitch on piping. The riser diagrams do not appear adequately developed. These need to be enhanced prior to issuing to bid. RESPONSE: The riser diagrams will be completed for the final submission.
4. Acid waste, vents and neutralization systems for laboratories. There is a graphic issue with the plumbing drawings in the science wing. The drawing appears as a

single black square. Therefore, these drawings have not been reviewed and this issue needs to be corrected before being issued to bid. RESPONSE: The Science room graphic issue will be corrected for the final submission.
5. Plumbing riser diagrams. The riser diagram is not fully developed and annotated. This needs to be completed before being issued to bid. RESPONSE: The riser diagrams will be completed for the final submission.
6. Domestic water booster pumps, boiler feed water, meter location, hose bibbs. The water meter is shown, but not labeled, on the enlarged mechanical room plan on Drawing P3 1 (and the symbol used is not shown in the legend). It appears the enlarged plans need additional annotation as well. This should be further developed before bidding. RESPONSE: All items and annotations will be shown on drawings for the final submission.
7. All required access panels. Access panels are not shown on the drawings and should be added prior to being issued to bid. RESPONSE: Access panels will be specified and shown on drawings for the final submission.
§ Heating, Ventilating and Air Conditioning Drawings shall indicate the following: 1. All directions of flow and pitch on piping, and direction of flow, volumes for duct
systems shall be indicated. The direction of flow and pitch on piping is not shown. This should be added prior to being issued to bid. RESPONSE: In general, HVAC piping does not require pitch. Therefore, pitch is not indicated. Condensate piping will be provided with condensate pumps and also will not require pitch. However, notation may be provided to allow contractor to use discretion for gravity draining in lieu of pumped condensate. This will incorporate a 1/8” per linear foot pitch of condensate piping. Flow arrows and piping system identification will be elaborated on in the final submission.
2. All equipment shall have sufficient servicing and/or replacement space indicated on drawings. Service areas and work clearance for replacement components are not included on the plans and should be indicated before being issued to bid. RESPONSE: Service clearances are indicated for major pieces of equipment as provided by manufacturer recommendation. In some instances, there is no specific clearance requirement given as the equipment is inherently accessible, such as unit heaters, through manufacturer provided access panels. Further clarification of existing access/ maintenance clearance will be provided and additional clearances will be shown in the final documentation as allowable.
3. All equipment, accessories, valves and dampers with all necessary access panels, identified as to type and size. Access panels, where required for access to valves and dampers shall be indicated on drawings. Access panels are not shown on the drawings and should be added prior to being issued to bid. RESPONSE: Typically access to valves and dampers will be located in areas with ACT ceilings as majority of the project consists of acoustical tile ceilings. It is the responsibility of the mechanical contractor to coordinate final location and size. Final location of valves and dampers will be field determined therefore, the HVAC contractor shall determine the necessary location as required. Refer to division 23 specification section 2.27 for more information.
§ Electrical Drawings shall indicate the following:

1. General arrangement: Outline layout of each floor. Typical sections through the structure, floor and ceiling heights and elevations, and type construction, including concrete pads shall be indicated. Indicate interface with other systems. Identify any work by general contractor or other trades. There are no sections, and no floor or ceiling heights shown on the electrical drawings. Consider adding this to the drawings for clarity before being issued to bid. There are “revision clouds” on Drawing T2.10. Presumably these should be removed prior to bidding. RESPONSE: Electrical plans will indicate outline layout of each floor. Lighting and other electrical equipment will be coordinated with structure, floor, ceiling heights and elevations. Equipment requiring concrete pads will be outlined and indicated. interfacing of systems will be indicated on risers and plans. Work by General Contractor or other Trade Contractors will be identified. Architectural plans will be coordinated with Electrical plans for cross sections and elevations. Ceiling heights will be indicated on lighting plans.
2. Interior lighting system: Light fixture schedules, circuiting location and mounting heights of all fixtures, receptacle and switch outlets, sizes and types of all lamps, conduits, all other accessories and riser diagrams shall be indicated on drawings. Indicate details and method of supporting electrical fixtures and conduits. Designer shall specify that all electrical lighting fixtures be supported from the building structure, and shall be independent of ducts, pipes, ceilings and their supporting members. Comply with seismic design criteria. There are no mounting heights included in the fixture schedules. Provide as required before being issued to bid. RESPONSE: Light Fixture Schedule will indicate type of lamps and mounting designation. Locations and mounting heights of lighting, receptacles, and switch outlets will be indicated on plans. Riser Diagrams will indicate conduit sizes and will outline origination and final locations of equipment. The means and methods of supporting light fixtures and conduits will be indicated on the specifications. All light fixtures and electrical conduits will be indicated to be supported from the structure and not depend on the ceiling or members of other trades. The plans and specs will reference compliance with seismic and vibration guidelines. Fixture mounting heights have been coordinated with Architectural sections. Suspended fixtures will maintain minimum of 18” suspension.
3. Emergency system details including transfer switch, type of fuel. The transfer switch for the emergency generator is not clearly shown on the drawings. Review and add additional information, if determined necessary, prior to bidding. RESPONSE: Additional information has been added to the transfer switches shown on the Riser Diagrams, Drawing E3.00.
3. Project Manual Requirements:
a. Provide an updated list identifying all proprietary items (if any) with an affidavit which shall indicate an elected body of the district (school committee, city or town council, or selectmen, - but not an ad-hoc building committee) has been presented with proposals for proprietary requirements approval action, has had an opportunity to investigate, or to require staff or consultant investigation upon each item so proposed, and has majority voted in an open public session that it is in the public interest to do so. Provide MSBA with a certified copy of the vote of the elected body. For each item of material or equipment, the specifications shall provide for a minimum of three named brands of material or equipment and the words “or equal” or a description of material or equipment which can be met by a minimum of three manufacturers or producers, and

the words “or equal”. Proprietary products shall not be specified except as provided by M.G.L. c. 30, § 39M; however, when they are specified, proprietary specifications are subject to the “or equal” provisions of c. 30, § 39M. No proprietary products are included in the specifications; presumably none are intended. Verify in response to this review. RESPONSE: The intent is to not have any proprietary items in the specifications or on the drawings. Brand-specific names on the drawings will be revised to generic descriptions to match the specification sections.
b. Unit price items, if permitted or ordered by the Owner, shall be properly described in the Specifications. In item “O” Unit Prices of the Form for Bid-Trade Contractor, it states that the unit price is the “exact net amount” of the change, and continues to say that it is the total amount with no additional adjustment. Consider whether the phrase should be “exact gross amount”. This is a language preference to be reviewed by the Designer and edited if determined necessary. RESPONSE: The word gross or net does not matter as the unit price is a defined number. It either includes or excludes overhead, profit, insurance, etc. regardless, that is the price used to add or credit the work. No additional adjustments will be made.
c. Staging, scaffolding cutting and patching, refuse collection and disposal, demolition work and cleaning task, allocation policy and proposed language shall be carefully assigned to avoid duplication or omission. The specifications are consistently written throughout that all subcontractors are to provide their own scaffolding and staging. While this is technically allowable, it could result in a duplication of cost in bidding by trades requiring similar staging at similar times (e.g. masonry, windows, sealants, etc.) Review and evaluate if any trade should be required to share staging provided by the Construction Manager. In 014523 Testing and Inspecting Services, Article 1.2 Contractor’s Responsibilities, states “The Contractor shall provide free and safe access to the work…”. As written, the Construction Manager/General Contractor will not be providing any staging and scaffolding. Review and determine whether this reference should be changed to state that the “… applicable subcontractors need to provide free and safe access….” RESPONSE: For many years it has been the industry standard for subcontractors to provide their own staging. They are better suited to know what type of staging is safer, more efficient and cost effective. Furthermore, it requires that each sub takes personal responsibility for the condition and safety of their own work space.
There are exceptions when multi-trade staging makes sense. The CMRs supplemental instruction state that Consigli will provide a “dance floor” below the ceiling of the auditorium for use by all trades. However, language in the supplemental instruction and/or individual spec section that require that subs own their own scaffolding/staging shall remain as is. The free and safe access to the site is ensured since the site is a large rural site and scaffolding will not interfere with any public way. The CMR will still maintain access to the site.
d. Specify materials mined or manufactured in Massachusetts first and the United States
of America second whenever possible. This reference does not appear to be included and should be added prior to bidding. RESPONSE: The “manufactured in Massachusetts first and the US second” reference is made in the 016000 Product Requirements section 2.1 B.1.

4. Additional Findings / Comments:
a. Division 0 and Division 1 are written to require all subcontractors to perform coring up to 12 inches. Openings beyond that are classified as cutting. Most specification sections are written accordingly. In 230001 HVAC, in Article 3.1.A, it states that coring is to be performed by HVAC. However, in the subsequent paragraphs, it refers to laying out openings in masonry for performance of the coring by Section 042000 Unit Masonry. The same language is in Article 3.12 Cutting and Patching of Section 26000 Electrical. Review, update and edit as determined appropriate. RESPONSE: Section 230001 indicates coring done by the HVAC Sub, while the Division 0 and 1 defines coring as up to 12". The reference to the mason is a coordination note only, as the larger openings will be provided by the mason. The reference in #3 to cutting openings will be revised. 260001 will also be revised.
b. It appears it is intended for Sections 078413 Penetration Firestopping and 078443 Joint Firestopping to set the standards and requirement for materials for firestopping. But, the majority of Firestopping is to be installed by the trade creating the penetration. Most of the sections are written accordingly. However, the Description of Work in those other sections does not make it clear that firestopping is not furnished and installed by those Sections (078413 and 078443). Review and determine whether this should be clarified in all of the sections. Note that 281000 Integrated Security System is not written to be consistent with the other sections. It indicates firestopping is by that Section (Article 3.2). The section should be updated to be consistent with the others. RESPONSE: It is the intent that the trade creating the opening is responsible for fire sealing the opening. Sections 078413 and 078443 describes the products to be used. Section 281000 will be revised to also include a reference to the sections 078413 and 078443.
c. The requirement for Coordination Drawings, and their organization, is included in 013100 Project Management and Coordination. As written, that section includes the requirements of what is to be shown for various trades but does not specifically indicate who is required to produce those drawings and the procedure for accomplishing coordination. In the MEP sections, there are references to following the “Detailed procedures for coordination drawings…” as contained in Division 1. However, the procedures (versus the requirements) do not appear to be stated. Furthermore, it appears that the requirement for format, such as AutoCADD, BIM, or paper, is not stated. The requirements for coordination drawings also do not appear to be in the Construction Managers general requirements. Review and provide additional language as determined appropriate. RESPONSE: The Coordination procedures will be stated more clearly. See attached BIM / Coordination Supplemental Instructions to be included in the final Project Manual.
