Federal System Why is the United States considered a federal

system of government?

• Because the powers of government are SHARED between the national and state governments!

National Powers delegated powers: powers “given”/delegated to

the national government by the Constitution (expressed, implied)

* expressed - powers directly expressed in Constitution –

WRITTEN!!!!

 

* implied - powers the government needs to carry out expressed powers.

- NOT SPECIFICALLY LISTED!

- stemming from “Necessary and Proper Clause”

National PowersDelegated Powers = “given”

Expressed = “written”

Implied = “meaning”

Necessary and Proper Clause

* govt. can carry out actions that are “necessary” to fulfill expressed powers

Shared Powers Concurrent Powers = “shared”

- powers that both the national and state governments have

* Supremacy Clause = “supreme power”

- national govt. has supreme power over states in a conflict

Ex. Arizona’s immigration reform
