ORDINANCE NO. 2012 -SZ

AN ORDINANCE AMENDING TOW AMENSING TOWNSHIPORDINANCE NO. 80-2, ENTITLED "AN ORDINANCE PROVIDINGFOR THE COLLECTION, CONVEYANCE AND REMOVAL BY THETOWNSHIP OF TOW AMENSING OF GARBAGE, RUBBISH ANDASHES; DEFINING MEANING OF TERMS AS USED IN THISORDINANCE; IMPOSING CERTAIN DUTIES UPONHOUSEHOLDERS AND OTHERS AND PROVIDING PENAL TIESFOR VIOLATIONS THEREOF."

BE IT ORDAINED AND ENACTED by the Towamensing Township Board of

Supervisors, and it is hereby ORDAINED and ENACTED by the authority of the same, that the

aforementioned Ordinance be amended as follows:

l. A new Section 7(b) entitled "Termination of Service" shall be added and shall

provide as follows:

Notwithstanding anything to the contrary in this Ordinance, the Board ofSupervisors reserves the right, at their sole discretion, to stop collectingrefuse from any person who violates any of the provisions of thisOrdinance, or any of the rules or regulations made by the Board ofSupervisors under the provisions of this Ordinance, including, non-payment of fees. The Board of Supervisors also reserves the right todetermine whether or not to resume collection of refuse after theviolation has been corrected. If the Board of Supervisors terminatesservice under this Section 7(b) of the Ordinance, said person for whomservices was terminated shall contract with a Licensed Collector tocollect and dispose of their refuse. Upon written request from theTownship, such person shall provide the Township with:

1. A copy of an agreement or letter signed by aLicensed Collector, stating that it will collect and dispose of allrefuse produced or accumulated by such person for the Township'sentire garbage collection year;

2. Proof that the Licensed Collector has been paid infull to provide the services described in paragraph (b) 1 above forthe Township's entire garbage collection year; and,

3. Such other documentation or information as may bedeemed necessary by the Township to ascertain or confirm that therefuse produced or accumulated by such person will be collectedand disposed of in accordance with the terms of this Ordinance andthe terms of any other relevant laws or regulations.

2. Section 2, ("Definitions") shall be amended by adding thefollowing:

(f) "Licensed Collector" means a refuse collector or haulerpossessing a current, valid license issued by CarbonCounty.

3. The Ordinance is amended in no other way.

4. This Ordinance shall become effective five (5) days after its enactment.

This Ordinance is ENACTED and ORDAINED this 5th day of April, 2012.
