In our ever changing market, Realtors are finding themselves shouldering more & more responsibilities with each transaction. Negotiating a short sale payoff with their client’s lender should not be one of them. Although, it may seem as if you are the logical choice to discuss short sale payoffs, the truth is drastically differ-ent. Negotiating any type of settlement or short-sale pay-off is considered the practice of law in the state of Geor-gia. The practice of law without a license is illegal with consequences ranging anywhere from a fine to jail time. As an agent, you may be in touch with your client?s lender & help expedite the process of a short sale and per-form ministerial acts without committing a crime. Just remember, that the actual negotiation is between the seller and their lender. If your client does not feel comfortable negotiating on their own behalf, they may hire an attorney to represent them.
