The U.S. Supreme Court accepted an appealled by National Right to Work Foundation
attorneys in Davenport v. Washington Educa-
tion Association (WEA) or 4,000 Washington
non-union teachers orced to pay union dues.
Oral argument was heard on January 10, 2007;
a ruling is expect by June.
The High Court reviewed the Washington State
Supreme Courts outrageous decision creat-
ing a dangerous new precedent that union
oicials somehow have a First Amendment
rightto spend on politics the mandatory dues
paid by non-union members. The Washingtoncourt used this novel rationale to strike down
the last operative provision o the well-meant,
but ineective, state campaign nance law
sometimes called paycheck protection, which
intended to limit the misuse o orced dues or
certain political activities.
The dismal track record o state paycheck
protection laws makes it increasingly clear
that this regulatory approach is imprudent,
and now Washingtons law has become a
platorm to create an even larger problem.
I upheld, the Washington State Supreme
Court decision in Davenport v. WEA may
open the door or union lawyers to under-
mine 22 states Right to Work laws, which
make union ailiation and dues payment
strictly voluntary.
While the appeal is primarily a legal rescue
mission that should never have been nec-
essary, Right to Work attorneys ound an
opening and went on the oensive askingthe High Court to clariy that its 45-year-old
dissent is not to be presumed statement
does not apply to non-union members. Union
ofcials have exploited that phrase rom a
1961 ruling to justiy orcing employees, who
resign union membership, to take the addi-
tional afrmative step o objecting annually to
prevent the use o their orced dues on politics
and other non-bargaining unctions. A victory
on this argument would signicantly advance
the battle or employee reedom: Thousands
o non-union members in non-Right to Workstates would automatically be entitled to
annual dues rebates o hundreds o dollars
