LEGAL
The legal structure will briefly comprise an initial 5 year licence to
enable the selected bidder to secure planning permission for, and
construct a scheme of development on the site. This will be
followed by the grant of a long 300 year lease on practical
completion. Bidders will be asked to specify the proposed licence
fee and the base rental (increased annually in accordance with
CPI) for the long lease. As an alternative, CIE will be entitled to
collect 10% of the gross rents received from the property if this
exceeds the base rental specified.
This transaction is not deemed to be a public works contract,
public works concession contract or any contract covered by
European and/or Irish public procurement legislation.
TENDER PROCEDURE
The closing date for the receipt of tenders is 12 noon on
Wednesday 22nd April 2015. Proposals prepared in accordance
with the requirements of CIE are to be be submitted to the offices
of Lisney, 6th Floor, St Stephen's Green House, Earlsfort Terrace,
Dublin 2 in a sealed envelope marked “Project Tara”.
There is a two round selection process the details of which are
contained in the Request for Proposals document incorporating
an agreement for lease, a 300 year lease together with the
contract documents.
The tender procedure will first comprise a shortlisting as set out
in the documentation. The shortlisted bidders may then be invited
to confirm their best and final offer for the interest in the site one
month later. A decision will be considered by CIE based on the
award criteria as set out in the Request for Proposals.
