AMERICAN ACADEMY OF PSYCHIATRY AND THE LAW2015 ANNUAL MEETING

GOALS: To inform attendees about current major issues in forensic psychiatry and afford them opportunities to refresh skills in the fundamentals of the discipline, engage in discussion with peers on the standards governing the profession, and update their present knowledge.

CME TARGET AUDIENCE:Psychiatrists and other physicians working at the interface of law and psychiatry.

OBJECTIVES:Participants will improve their competence or performance in forensic psychiatry in the following three areas:

1) Service, including treatment of forensic patients, development of service delivery strategies, and enhance-ment of consultative abilities at the interface of psychiatry and the legal profession;

2) Teaching, including new methods of training of forensic psychiatrists and classification of the tasks and func-tions of forensic psychiatrists; and

3) Research, gaining access to scientific data in areas that form the basis for practice of the discipline.

ACCREDITATION:The American Academy of Psychiatry and the Law is accredited by the Accreditation Council for Continuing Medical Education to provide continuing medical education for physicians.

The American Academy of Psychiatry and the Law designates this live activity for a maximum of 31.75 AMA PRA Category 1 Credits™. Physicians should claim only the credit commensurate with the extent of their partici-pation in the activity.

David P. Farrington, O.B.E., is Emeritus Professor of Psychological Criminology, and Leverhulme Trust Emeritus Fellow at the Insti-tute of Criminology, Cambridge University. His major research interest is in developmental criminology, and he is Director of the Cambridge Study in Delinquent Development, which is a prospective longitudinal survey of over 400 London males from age 8 to age 56. He is also co-Investigator of the Pittsburgh Youth Study, which is a prospective longitudinal study of over 1,500 Pittsburgh males from age 7 to age 35. In addition to nearly 650 published journal articles and book chapters on criminological and psycho-logical topics, he has published 96 books, monographs and government publications.

Brian D. Hodges MD, PhD, FRCPC is Professor in the Faculty of Medicine and Faculty of Education (OISE/UT) at the University of Toronto; the Richard and Elizabeth Currie Chair in Health Professions Education Research at the Wilson Centre for Research in Education and Vice President Education at the University Health Network (Toronto General, Toronto Western Princess Margaret and Toronto Rehab Hospitals). He leads the AMS Phoenix Project: A Call to Caring, an initiative to rebalance the technical and compassionate dimensions of healthcare. De-Stigmatizing Patients: A Filmmaker’s Prescription John Kastner

One of Canada’s most acclaimed documentary-makers, John Kastner has won four Emmys and five Emmy nominations, more than any other individual in the history of Canadian television. The honours were for his feature-length documentaries “Life with Murder” “Four Women” Fighting Back” and “The Lifer and the Lady.” In 2007 he was honored by the Academy of Cana-dian Cinema and Television with its Achievement Award. His most recent films, NCR: Not Criminally Responsible (2013) and “Out of Sight ,Out of Mind” have been hailed by mental health and criminal justice professionals as a ground-breaking portrait of forensic psychiatric patients. “Life with Murder” (2010), produced in co-production with the National Film Board, focuses on parents struggling to reconcile with their son after he murders his sister. As well as an Emmy, the film won Canada’s Donald Brit-tain Gemini for Best Documentary, gold and silver Hugo awards at the Chicago Film Festival, and several other awards including a Special Jury Prize at the Houston International Film Festival. His documentary, “Monster in the Family” -- a 2-part film for CTV about an offender’s war with his mother who is campaigning to keep him locked up for life -- won the same award, among others. His films have been screened at major film festivals including Berlin, Los Angeles, Chicago, San Francisco, Sheffield and, of course, Hot Docs. In recent years both Hot Docs and the Cinematheque Quebecoise in Montreal have run retrospectives on his work. Note: Mr. Kastner is also presenting a workshop on Friday, October 23 at 4:15 p.m.

Psychological tests are an important adjunct in forensic assessments, especial in assessment of malingering and personality structure. Collaboration with psychologists can bolster forensic opinions. Psychiatrists can administer standardized personality and malingering tests that have strong psychometric properties and that are capable of withstanding Daubert challenges. Previously presented at AAPL, this course has been redesigned to incorporate 1) instruction on the administration of standardized personality tests, 2) gold-standard scoring, 3) interpretation of results, and 4) their incorporation into the psychiatric report and testimony. A brief review of cognitive test-ing will be enhanced by instruction on use of effort measures that can be incorporated into disability evaluations. Specific instruction will be provided on the administration and interpretation of the MMPI, MCMI, and PAI personality inventories and on effort and ma-lingering tests including the VIP, TOMM (malingered memory) and the MFAST. The intent of this course is to enable forensic psychia-trists to administer and interpret standard testing and to consult and partner with psychologists. The course will also address pitfalls in psychological testing, the relevance of collateral, effective ways to explain testing results in testimony and common challenges on cross-examination. Case examples will and audience interactive responding will support the teaching.

This is a practical course on developing and optimizing a private forensic practice. Some basic forensic principles will be addressed, but from an operational or business viewpoint, drawing from the faculty’s substantial experience in the subject areas. Topics include client needs and relationships; qualities most important to attorneys and retaining entities that seek experts; practi-cal issues in working with lawyers, judges, and other clients; marketing; ethics in private practice; practical “pearls” for record review, interviews & examinations, reports & affidavits, and testimony; fees, billing & collections; and office operations & business procedures. In addition to the core faculty, several other experienced practitioners from the Private Practice Committee will act as advisors during discussion periods. Committee members will provide contact information for, and encourage, follow-up or mentor-ing after the course and the AAPL meeting. The course will be fast-paced and intensive. This course will provide practical advice on how to make a psychiatric presentation with punch, passion, and polish. Instruction will be given on planning a scientific paper presentation, a lecture, and a half day course. The course leader will cover the selec-tion of a title through to the choice of closing remarks. Teaching techniques to hold the audience’s attention include the use of humor, anecdotes, and vivid images. Participants will be taught to involve the audience by breaking them into pairs to solve prob-lems with recently acquired knowledge. Participants will be told that they should never (1) read while lecturing; (2) display their esoteric vocabulary; or (3) rush through their talk, no matter what the time constraints. Tips will be given for making traditional word slides and innovative picture slides. Pitfalls of Powerpoint will be illustrated. Advice will be given on the effective use of vid-eotape vignettes. A videotape will be used to illustrate common errors made by lecturers. The course will also cover preparation of handouts. Finally, participants will be strongly encouraged to make a three minute presentation with or without slides and receive feedback from workshop participants. Participants should plan to bring Powerpoint slides on a flash drive.

Psychological Testing of Claimed Amnesia: A Guide to Remember Charles Scott, MD, Sacramento, CABarbara McDermott, PhD, Sacramento, CA

Malingered amnesia is one of the most common claims in both civil and criminal forensic evaluations. For example, of defendants who have committed a violent offense, 20% to 30% claim amnesia for their crime. Despite the high frequency of malingering, structured, evidence-based assessments of evaluee’s amnesia claims are rarely used in many civil and criminal forensic evalu-ations. This course will provide direct training for the participant on structured assessments useful in the detection of feigned memory and/or cognitive deficits. Several screening instruments useful in the detection of feigned memory or cognitive deficits will be presented, to include the Structured Inventory of Malingered Symptomatology (SIMS). Two instruments that use performance validity testing will be reviewed: the Test of Memory Malingering (TOMM) and the Medical Symptom Validity Test (MSVT). Relevant scale development information will be presented for each assessment, including validity, reliability and details of the normative samples. The administration of each instrument will be demonstrated with opportunities for attendees to receive supervised admin-istration experience. Mock courtroom testimony will be conducted with audience participants with potential pitfalls highlighted when these instruments are used in forensic evaluations. This course is open to psychiatrists and psychologists only.
