Th•· owners of the surrounding properties are the Applicants, Mr. Guy H. Tidwell and Mr. William Woodward. The adjoining property of Mr. Tidwell is used for single family residential purposes. The propert es of the Applicants and of Mr. Woodward are vacant.
What ch nged or changing conditions make the passage of this amendment necessa:y?
The market demand for upscale apartments in the City of Oxford has continued to increase. Suitable locations and lands that historically have been under-used or unused are now the subject of intensive activity. The properties in question have not been utilized in the past for any productive purpose, but rather have lain idle. Pressures of the marketplace now demand that these properties be put to a reasonable use, in keeping with the surrounding area.
The subject properties are presently zoned for agricultural uses. As such, the properties are not properly zoned, in that the highest and best use for the properties would be that of multi-family residences/apartments. Due to the adjoining H.C. Highway Conunercial and R.C. Multi-family residential zones, as well as the adjoining Bypass, the properties are not suitable for any other residential classification.
What other circumstances justify the proposed change?
The access to the properties is not of sufficient width to allow the construction of a street to City specifications. Therefore, a subdivi:;ion of the properties, which would be necessary for single family residences, is not possible.
The amendment of the Zoning Map as requested is necessary to permit the use of the subject properties in a manner that is reasonable and compatible with the uses permitted and present in the surrounding lands.
What errors in the Zoning Map would be corrected by the proposed amendment?
The subject properties, along with adjoining lands, were given the A. Agricultural classification years ago. At that time and at present, the lands in the A. Agricultural zone in the area are isolated, being completely surrounded by a barrier to development, the Bypass, and conunercial and multi-family zones. An inspection of the zoning map coupled with a visit to the area will yield the inescapable conclusion that the subject property has been inversely ~spotu zoned by mistake.
In conclusion, the allowance of a reasonable use of the subject properties commensurate and in harmony with the activities allowed upon the surrounding properties, and subject to the same guidelines, would provide a fair and equitable solution, and would promote the general welfare of the City of Oxford by allowing an increase in the tax base, while not unduly impinging upon the concepts and concerns of public health or safety.

Please be advised that I own real property joining the property of Mr. and Mrs. Ash that forms the subject of their pending request for a zoning change.
According to my understanding, Mr. and Mrs. Ash desire to have their property rezoned in order to permit them to construct apartments. I am familiar with the construction practices of Mr. Ash and of their management capabilities, and I do not have any objection to the proposed apartments being built by Mr. and Mrs. Ash.

BE IT ORDAINED BY THE MAYOR AND BOARD OF ALDERMEN OF THE

WHEREAS, on April 13, 1998, the Oxford Planning Commission, in accordance
with public notice,· held a public hearing at the request of Ken Ash to rezone the

After hearing statements of the Petitioner, and considering the Petition and
information presented, including objections thereto, if any, the Oxford Planning
Commission determined to recommend to the Mayor and Board of Aldermen that the
property described above be rezoned from Agricultural to RC as requested; and,
WHEREAS, at the regular April 21, 1998, meeting of the Mayor and Board of
Aldermen, the Petition of Ken Ash and the recommendations of the Oxford Planning
Commission to rezone the above described property from Agricultural to RC together
with supporting documents was presented; and,
WHEREAS. such change in the zoning of said property is reasonably necessary
to the promotion of the public health, safety, and general welfare and the maintenance
of sound, stable and desirable development within the territorial limits of the City of
Oxford, Mississippi.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND BOARD OF
ALDERMEN OF THE CITY OF OXFORD, MISSISSIPPI, AS FOLLOWS:
Section 1. That the Official Zoning Map for the City of Oxford, Mississippi,
1971, be, and it is hereby amended by changing the zoning classification of the above . described property from Agricultural to RC zone.
• • Section 2. That the above change shall be made upon the official zoning map
promptly, and the following entry shall be placed thereon uBy Official Action of the
Board of Aldermen, This Map Was Amended as Authorized by Ordinance as Listed

Section 3. That all ordinances, or parts of ordinances in conflict herewith,
shall be, and the same are hereby repealed.
Section 4. That this ordinance shall take effect and be in force from and after
the time required by the Mississippi Code of 1972, as amended, provided, however,
that such change or amendment made by this ordinance shall not become effective
until such has been duly entered upon the Official Zoning Map of the City of Oxford,
Mississippi, 1971.

Re: Pending Zoning Change Application Mr. Ken Ash
Dear Ben:
By way of confirmation of our previous conversation in the above referenced matter, I was retained last Thursday by Mr. Ash to represent his interests in the presentation of his pending application for a zoning change with regard to a 4.2 acre, +/-, tract of land.
As I understand the situation, the application is not as complete as it could be, and might require supplementation.
Regardless of the present state of the matter, I have not had sufficient time to fully study Mr. Ash's situation. Consequently, I would appreciate a continuance of the application until the April meeting in order that I may be in a better position to represent my client's interests.
If this request presents a problem, please do not hesitate to contact me. As always, your cooperation and understanding is sincerely appreciated.
