SUBJECT: APPROVE CONTRACT INCREASE FOR GENERAL MAJOR MAINTENANCE AND TENANT IMPROVEMENT PROJECTS: JOB ORDER CONTRACT (JOC) PROJECT NO. 10035, PROCUREMENT CONTRACT NO. 5762; MASTER CONTRACT NO. 900821; GENERAL MAJOR MAINTENANCE AND TENANT IMPROVEMENT PROJECTS, AMOUNT: $2,000,000; JOB ORDER CONTRACT (JOC) PROJECT NO.1 0036, PROCUREMENT CONTRACT NO. 5764; MASTER CONTRACT NO. 900822, GENERAL MAJOR MAINTENANCE AND TENANT IMPROVEMENT PROJECTS, AMOUNT: $1,500,000

RECOMMENDATIONS:

A. Approve an amendment to increase JOC Project No. 10035 (Procurement Contract No. 5762; Master Contract No. 900821) to Sea Pac Engineering, Inc. (John Lee, President), 3325 Wilshire Boulevard, Suite 305, Los Angeles, CA 90010 in the amount of$2,000,000, increasing the contract amount from $1,000,000 to $3,000,000, for additional general major maintenance and tenant improvement projects;

B. Approve an amendment to increase JOC Project No.1 0036 (Procurement Contract No. 5764; Master Contract No. 900822) to Agbayani Construction Corporation (Alfonso Garcia, Vice President), 88 Dixon Court, Daly City, CA 94014 in the amount of$1,500,000, increasing the contract amount from $1,000,000 to $2,500,000, for additional general major maintenance and tenant improvement projects; and

C. Authorize the Director of the General Services Agency (GSA) to issue change orders, as necessary to accomplish the remaining work.

DISCUSSION/SUMMARY:

On September 28,2010, your Board authorized (Item #24, File #26640) the award of two (2) contracts in the amount not to exceed $1,000,000 per year with possible extensions up to the sum authorized by Public Contracting Code, Section 20128.5, to a value of $3,000,000 per each contract.

The current work under these two contracts (seven job orders) total $751,000. These job orders include # 11 0001 replacement of fence at 409 Jackson Street in Hayward, # 11 004 jaiI ceH door modifications at Santa Rita Jail, #11 003 replacement ofHVAC equipment at Santa Rita Jail, #11 007 replacement of boiler at Animal Control in Dublin, #11 010 Auditors tenant improvement at II 06 Madison in Oakland, # 11011 re-asphalt parking lot at Winton building in Hayward, and #11012 Juvenile Justice Center security fence repairs in San Leandro. Additional job orders are anticipated before the end of the contract term for repairs of the roads and parking lots at Fairmont Hospital and Santa Rlta Jail, elevator modernization at Lakeside Plaza building in Oakland, boiler replacements at 400 and 401 Broadway in Oakland, HVAC upgrade at OES in Dublin, drywall installation on the 3rd and 4th floors at 1111 Jackson in Oakland, replacement of windows at Peralta Oaks building in Oakland, painting a water storage tank at Santa Rita Jail in Dublin, installation of electrical vehicle charging stations at various County facilities, and replacing three roofs at Santa Rita Jail. Two additional work orders by the Public Works Agency are anticipated as pilot projects for the removal and replacement of 150' of a 30" stonn drain at Crow Canyon road and de-silting culverts and creek at Eden Canyon road.

SELECTION CRJ1ERJAIPROCESS:

On July 13, 2010 (Item #33. File #26404) your Board authorized GSA 10 issue bidsfor Job Order Contracts and on September 28,2010 (Item #24, File #26640) approved the award of Job Order Contracts to two (2) businessesfor general contracting services. Sea-Pac Engineering Inc. andAgbayani Construction Corporation were the two (2) lowest responsive bidders and were awarded the contracts in the amount not to exceed $1, 000,000 per year with possible extensions up to the sum authorized by Public Contracting Code, Section 20J28.5, to a value of $3,000,000 per contract. The Enhanced Construction Outreach Program (ECOP) was applied under the contractual requirement ofcompliance faT the overall Job Order Contracting contract. Current ECOP participation based on current job orders of$751,000 awarded. for Sea Pac Engineering reflects 62% LocalBusiness Enterprise (LEE), 32% Small Local Business Enterprise (SLBE), J2% Minority Business Enterprise (MBE), and Agbayani Construction reflects 52% LBE, 52% SLBE, 31% Women Owned Business Enterprise (WEE).

FINANCING:

Appropriations for these Job Order Contract increases are included in the Approved FY 2010-11 Major Maintenance Capital-Budget. Appropriations are also included in the Approved FY 2010­11 Auditor's and Public Work's Agency Budgets for specific work orders.

There will be no increase in net cost to the County.
