1.0 Introduction Directive 2010/75/EU on industrial emissions (integrated pollution prevention and control) contains various requirements for the protection of land and groundwater under a permitted installation, namely: Article 14(1)b appropriate requirements ensuring protection of the soil and groundwater and
measures concerning the monitoring and management of waste generated by the installation.
Article 14(1)e appropriate requirements for the regular maintenance and surveillance of measures taken to prevent emissions to soil and groundwater pursuant to point (b) and appropriate requirements concerning the periodic monitoring of soil and groundwater in relation to relevant hazardous substances likely to be found on site and having regard to the possibility of soil and groundwater contamination at the site of the installation.
Article 16(2) The frequency of the periodic monitoring referred to in Article 14(1)e shall be determined by the competent authority in a permit for each individual installation or in general binding rules. Without prejudice to the first subparagraph, periodic monitoring shall be carried out at least once every 5 years for groundwater and 10 years for soli, unless such monitoring is based on a systematic appraisal of the risk of contamination.
Permit XP3336NN has various conditions imposed to ensure compliance with the above Articles of the IED, namely: 3.1.4: The Operator shall carry out monitoring of groundwater at least once every five years; and of
soil at least once every ten years unless such monitoring is based on a systematic appraisal of the risk of contamination; to the protocol agreed in writing with the Environment Agency under Pre-operational measure PO 7 in Table S1.4.
PO6: Prior to the commencement of commissioning, the Operator shall submit a written report on the baseline conditions of soil and groundwater at the installation. The report shall contain the information necessary to determine the state of soil and groundwater contamination so as to make a quantified comparison with the state upon definitive cessation of activities provided for in Article 22(3) of the IED. The report shall contain information, supplementary to the already provided in the Application Site Condition Report, needed to meet the information requirements of Article 22(2) of the IED.
PO7: The Operator shall submit the written protocol referenced in condition 3.2.4 for the monitoring of soil and groundwater for approval by the Environment Agency. The protocol shall demonstrate how the Operator will meet the requirements of Articles 14(1)(b), 14(1)(e) and 16(2) of the IED. The protocol shall be implemented in accordance with the written approval from the Agency.
2.0 Objectives This report may be taken as section 5 of the Site Condition Report (SCR), submitted in Appendix D of permit application EPR/XP3336NN/A001 dated August 2013. Its intent is to demonstrate compliance with these permit conditions, and hence the relevant Articles of the Directive. 3.0 Other Reports A Baseline Condition Report “TV2 Baseline Condition Report FINAL Aug 15” has been produced as part of this submission, to comply with pre-operational condition PO6. In addition, a Site Protection and Monitoring Programme (SPMP) Design report has been produced as part of this submission, setting out the measures being taken to protect land under the installation. The SPMP document also sets out in Appendix C the monitoring programme that will be undertaken to ensure that the risk of contamination of land and groundwater at the installation is minimised, in compliance with pre-operational condition PO7.
SCR Section 5 – Measures Taken to Protect Land
This SCR Section 5 document, along with the Baseline Condition report and the SPMP, together demonstrate that the risk based monitoring programme proposed will comply with Articles 14(1)(b), 14(1)€ and 16(2) of the Industrial Emissions Directive, and that therefore permit conditions 3.1.4, PO6 and PO7 are also satisfied. 4.0 Monitoring Programme for the Installation 4.1 Environmental Monitoring Programme It is not proposed to carry out any ongoing environmental monitoring (groundwater / soil analysis) at the installation. From the nature of the potential contaminants and that main activities are situated on concrete hard standing and appropriate bunding is provided with appropriate systems and procedures for environmental protection. The risk assessment of the chemicals of concern as described in Appendix C of the SPMP concluded that environmental monitoring for the installation is not required. As far as we can ascertain from the safety data sheets none of the chemicals used on site are considered persistent, bio accumulative and toxic (PBT) and or very persistent and very bio accumulative (vPvB) 4.2 Infrastructure Monitoring Programme An infrastructure monitoring programme is proposed in Appendix C of the SPMP, and is reproduced below for ease of reference. The purpose of the infrastructure monitoring program is to demonstrate the effectiveness of pollution prevention measures at the site throughout the life of the Permit. This occurs through a process of planned inspection, testing and maintenance of infrastructure. If any loss of containment results in land contamination / groundwater then appropriate remediation is undertaken to restore the land / groundwater to its previous condition (see baseline site condition report). Documentary evidence of the remediation will be retained as part of the evidence required at site closure that the land / groundwater is in the same condition as when the permit was granted.
