As a property owner within 150 feet of my property line, I would like to inform you that I have filed an application before the Zoning Board of Appeals of the Town of Trumbull for a Variance for my deck on my property.

My application Is to allow: Obtaining a variance for extending an existing deck (-10' x 14') Easternly (8') and Southerly (2-4'), into the Southern setback zone of 20' off my property line (Abutting the PLO lot). The deck, ~ 7 .5' off the ground level) is along the dike's downhill spillway; the deck is hardly visible to any of my abutting neighbors.

Please accept the following responses as part of the variance application to the Trumbull Zoning Board of Appeals for the property located at 6033 Main Street (the "Site") in the Residence A Zone:

Section of Zoning Regulation for Variance and Description of Proposal

A variance of Article I, Section 4.3.1 and Article III, Sec. 1 of the Regulations to reduce the minimum side yard from Twenty feet (20') to Seventeen and 80/00 feet (17.8') to construct a proposed breezeway and connected garage.

Proposed Development

The Applicant proposes to construct a breezeway to connect a currently detached accessory garage to a principal dwelling, and, therefore, converting it into a part of the principal dwelling on the Site in the Residence A Zone. The Site, in its entirety, contains 77,078 SF, which is significantly more than triple the lot area requirement in the Residence A Zone. The lot is irregularly shaped with uneven sides at odd angles. The Site is surrounded on one side and its rear by the Holy Cross Lutheran Church property.

In 2012, the roof of the longstanding dated garage was severely damaged by a snowstorm. The Applicant's insurance company refused to pay for the repair of the roof. The Applicant was able to temporarily support the roof, but a heavy snowstorm finally collapsed the roof. The Applicant reconstructed the detached accessory garage on the same existing foundation as the prior garage. Therefore, the garage is the same Seven hundred and eighty-eight+/- square feet (788+/- SF) footprint as the prior garage. A portion of the existing foundation crosses the side yard setback, so a portion of it is located outside the setback and another portion is within the side yard setback, which requires the variance.

The Applicant proposes to now connect the existing principal dwelling to the detached garage through a proposed breezeway. Said connection will convert the detached garage to an attached garage and a part of the principal dwelling as stated in Article I, Sec. 3 .15 of the Regulations. It will allow residents to park their vehicles and stay covered all the way into the principal dwelling. This proposed connection and conversion of the status of the garage is fully conforming to the Regulations except for the aforementioned side yard setback variance.

Hardship

Granting the Applicant said variances will not substantially affect the comprehensive zoning plan of the Town of Trumbull and adherence to the strict letter of the Trumbull Zoning Regulations will cause an unusual hardship to the Applicant as the Applicant reconstructed the garage in the same exact location and the same foundation as the prior garage that was severely damaged from a storm. The replacement is a significant improvement from the dilapidated prior garage with a pitched roof, which is in character with the surrounding neighborhood. There will not be a negative impact on the neighborhood as the garage is significantly set back from the street line at Ninety-eight and 10/00 feet (98.1 0'). The neighbor that shares the relevant side property line supports the Application. Therefore, the proposed variances will not have a detrimental impact on the neighborhood. The Site is uniquely oversized for the area due to its irregular shape and depth as it is more than triple the lot area requirement of the Residence A Zone. The reconstruction and connection will be a tremendous improvement from the prior conditions. The Site will remain significantly below building coverage and FAR standards.

For these above-stated reasons, the Applicant respectfully requests approval for the stated variance at the Site.

As a property owner within 150 feet of our property line, we would like to inform you that we have filed an application before the Zoning Board of Appeals of the Town of Trumbull for Variances for our property.

Our application is to allow:

A variance of Article I, Section 4.3 .1 and Article In, Sec. I of the Trumbull Zoning Regulations to reduce the minimum side yard from Twenty feet (20') to Seventeen and 80/00 feet (17.8') to construct a proposed breezeway and connected garage.
