And if you thinkthe city can’t enforce that, then you haven’t metthe toilet police. OK, so the title “Toilet Police” probably doesn’tappear on any city worker’s business card, butthat’s what they are.

But let’s not blame city building inspectors foran odd law — or even the Chico City Council. Foronce, this ridiculous save-the-world concept doesn’tcome from the council, but rather from the busybodiesin the state Legislature. They passed a law that tookeffect Jan. 1 that requires water-conserving plumbingfixtures on any home built before 1994. How will that be enforced? Well, if a property hasany work done that requires a building permit froma city or county, that entity’s inspector must verifythat the home has low-flow toilets, showers and faucets. To make it even more disturbing, the low-flowinspection doesn’t occur if you’re getting plumbingwork. It occurs if you’re getting any work that requiresa building permit, such as getting a new heater, newwindows or converting a garage into a den. Uh, maybe. So under the letter of the law, if a homeowner buysa new water heater or fireplace insert for a couplehundred dollars, he or she might spend considerablymore than that converting all toilets, faucets andshowerheads to low-flow devices. City and county building inspectors don’t want to betoilet police. We can’t imagine them wanting to spendtime checking a person’s toilet when they’re thereto check an air conditioner. They’re taking a looseinterpretation of the law for now, and won’t inspecttoilets during projects like repairs and maintenancethat don’t involve plumbing. But there’s no guarantee the state, which passedthe law, won’t require cities and counties to enforcea strict interpretation. With all the uncertainty, it entices a homeowner toignore the government requirement to get a building

permit for minor home improvement projects. Governments should be concerned if fewer people takeout building permits. It means less revenue forcash-strapped local governments. The building industry is concerned that residentsmay put off rebuilding and home improvement projectsbecause they would include this unwanted expense.With the building industry and contractors finallyshowing signs of recovery from the recession, wedon’t want to see new obstacles. Once again the state passes a goofy law withoutthinking about the consequences, since somebody elsehas to enforce it. To that end, SB 1 will grant eachAuthority unprecedented powers.” Eminent domain has gradually grown to be one of themost oppressive government policies. Since theSCOTUS’ decision in Kelo v. City of New London,eminent domain continues to be the enemy of propertyowners. Homeowners have lost their homes to privatedevelopment projects. Such is the story of oyster farmer Anthony Bavuso and hisfamily. After years of working corporate and office jobs,Bavuso and his wife took a short hiatus from the day-to-daydrudgery and returned with a new perspective: they wanted tobecome contributors to the economy of raw materials by producingsomething that people needed. Bavuso moved his family back to their home state of Virginiawith the dream of becoming food producers. Having access to awaterfront property, and a background in oyster gardening, itmade sense to start an oyster farm. Like other types of farming,oyster farmers have to manage the growth of their oysters — alabor-intensive process requiring a high level of experience.An added benefit, for Bavuso, was the knowledge that oystersclean the water. As a lifelong Virginian, the health of theChesapeake Bay is never far from his mind. (Oysters eat algae,which proliferates in the pollution of the bay, and turn thealgae into usable protein for humans.) So the Bavuso familystarted Seaford Oyster Company in Seaford, Virginia. York County maintains a set of zoning ordinances regulatingvarious aspects of farming. There are a list of things thatare allowed, and if an activity is not on the list, the countyprohibits it. Penalties include steep fines and possibleincarceration. Small changes to the zoning ordinances caneasily disrupt industries and people’s livelihoods. In 2010, Bavuso followed regulatory procedure within his zoning

district for an oyster farm. He established a lease with theCommonwealth of Virginia that gave him the “rights” to thesection of the bottomland in the Poquoson River adjacent tohis property. (The bottom lease gives farmers access toshellfish only.) Additional regulations and permits involvedfood safety. Wanting to show his interest in producing thesafest food possible, Bavuso complied with the entire permittingprocess. Prior to starting the farm, the family looked at this list ofzones and restrictions. In the Bavuso’s zone, farming is “permittedby right.” This means for people to farm the land, they need noadditional land use permits from the county. According to thedefinition of aquaculture in the code, what Bavuso is doing isconsidered part of what is “permitted by right.” By 2011, after more than a year of farming, refining his expertiseand growing his customer base, Bavuso read in a local newspaperthat the county was planning on rezoning to remove agricultureactivities from Bavuso’s “zone.” A “zone” is any area that thecounty designates. Within each zone, the county stipulates whatparticular activities can take place. Once designated, the countyapplies regulations and restrictions. For example, one commonzoning requirement is that if an area is zoned for residentialbuilding, there are restrictions and regulations determininghow from the property line a structure can be built. Bavuso wanted to make sure that he would be grandfathered in andthat these changes would not affect his farming operation. The agency is threatening to hit the family with up to $75,000 aDAY in fines. Johnson said he’s not paying them a cent: “I have not paid them a dime nor will I. I will go bankrupt if Ihave to fighting it. My wife and I built [the pond] together. Weput our blood, sweat and tears into it. It was our dream.” Of course, the EPA isn’t backing down. They argue that Johnsonneeds to either restore the land or pay the fines. On January 30,

the agency gave Johnson 30 days to hire a consultant to assess theimpact of the supposed unauthorized work and to create a restorationproposal. That proposal has to be approved by the EPA, of course,and it must contain a schedule. All work would have to be completedwithin 60 days of the plan’s approval. If Johnson does not comply with those terms, the EPA is going tofine him $37,500 per day in civil penalties, along with $37,500 moreevery day for statutory violations. Johnson is fighting back and has gained the support of three Republicansenators – John Barrasso and Mike Enzi, who both represent Wyoming —and Louisiana Sen. David Vitter, Fox News reports: The Republican lawmakers sent a March 12 letter to Nancy Stoner, theEPA’s acting assistant administration for water, saying they were“troubled” by Johnson’s case and demanding the EPA withdraw thecompliance order. “Rather than a sober administration of the Clean Water Act, theCompliance Order reads like a draconian edict of a heavy-handedbureaucracy,” the letter states. The letter also questions the EPA’s claim that Johnson’s pond isactually a dam: “Fairness and due process require the EPA base its compliance orderon more than an assumption,” they wrote. “Instead of treating Mr.Johnson as guilty until he proves his innocence by demonstrating hisentitlement to the Clean Water Act section 404 (f)(1)(C) stock pondexemption, EPA should make its case that a dam was built and that theSection 404 exemption does not apply. “If the compliance order stands as an example of how EPA intendsto operate after completing its current ‘waters of the United States’rule-making, it should give pause to each and every landowner throughout

InAustin v. U.S. (1993), and again in U.S. v. Bajakajian (1998), theU.S. Supreme Court explained that “[t]he Excessive Fines Clauselimits the government’s power to extract payments, whether in cashor in kind, as punishment for some offense,” and held that civilsanctions that do not serve solely remedial purposes are subjectto the Excessive Fines Clause. The EPA has been flexing its regulatory muscle under dictator Obama,collecting more fines each year and hitting individuals with costlypenalties for violating environmental rules, including recentlyslapping a $75,000 fine on Wyoming homeowner Andy Johnson forbuilding a pond on his rural property. “The EPA has a history of overreaching its authority. It seemslike once again the EPA is trying to take power it doesn’t haveaway from American citizens,” Sen. John Barrasso, Wyoming Republican,said when he learned of the EPA’s wage garnishment scheme. Others questioned why the EPA decided to strengthen its collectionmuscle at this time. Critics said the threat of garnishing wages would be a powerfulincentive for people to agree to expensive settlements rather thanfight EPA charges. EPA officials did not respond to repeated questions by The WashingtonTimes about why they thought it was necessary to garnish people’s wages. The EPA announced the plan last week in a notice in the FederalRegister, saying federal law allows it “to garnish non-Federalwages to collect delinquent non-tax debts owed the United Stateswithout first obtaining a court order.” The agency cited authority under the Debt Collection ImprovementAct of 1996 that centralized federal collection operations underthe Treasury Department, which oversees garnishments of wages ortax refund checks. Under the law, every federal agency has the authority to conductadministrative wage garnishment, provided the agency adoptsapproved rules for conducting hearings where debtors can challengethe amount of debt or terms of repayment schedule, a Treasury

official said. Still, the rule would give the EPA sweeping authority to dictatehow and whether Americans could dispute fines and penalties, evenas the amount of EPA fines collected from individuals, businessesand local governments steadily increase. The amount of fines raked in by the agency has jumped from $96million in 2009 to $252 million in 2012, a more than 160 percentincrease, according to EPA annual reports. Putting the collection powers on a fast track, the agency announcedit in the Federal Register as a “direct final rule” that would takeeffect automatically Sept. 2, unless the EPA receives adverse publiccomments by Aug. 1. The EPA said it deemed the action as not a “significant regulatoryaction” and therefore not subject to review. The negative reactions began almost immediately. In a comment letter submitted to the EPA, the conservative HeritageFoundation faulted the rule for giving the government “unbridleddiscretion” in controlling the process for challenging fines andwage garnishment, such as dictating the site of a hearing withoutconsideration of the time and travel expense placed on the accuseddebtor. The rule allows the EPA to decide whether a debtor gets a chanceto present a defense and then picks whomever it chooses to serve asa hearing officer, even someone not trained as an administrativelaw judge, wrote David S.
