building contract will be in the form of the standard formof Building contract issued under sanction of the N.I.Aadapted for use in Nigeria.

Schedule of ConditionsM The Contractor will be deemed to have read each of the

clauses in the schedule of Conditions of which only themarginal heading together with such additionalinformation as is required is stated below and he is toallow opposite to the number and title of each clausecarring a monetary value for carrying out the clause inits entirety.

4. Statutory Obligations, Notices, Fees and ChargesAllow for payment of all fees and charges legallydemandable in respect of the works including offices,sheds and other temporary structures but excepting thecost of making permanent connections to sewers, waterand electricity. Appendix to Schedule of Conditions

A The following will be inserted in the appendix to schedule of Conditions of Contract:

i. Defects Liability Period - To include one completeraining season and not less than 6 months from the daynamed in the certificate of practical completion of theworks, whichever is the longer.

Should the priced Bills ofQuantities of the Tenderer recommended foracceptance show (after a complete arithmetical check)a difference between the tender figures and thearithmetically correct figure, the prices of the builder'swork") (that is the arithmetically correct figure less allPC and provisional Sums and Contingencies) shall beadjusted either by amending individual rates byagreement or by a percentage adjustment calculatedupon the total amount of such errors in relation to thevalue of "builder's work" so that the original tender figureshall remain unaltered. Variation of "builder's work" willbe subject to the same amended rates or percentageadjustment. Two additional copies of the priced Bills willbe required to be made by the Contractor and depositedwith the Architect before the signing of the contract.

Definitions of Abbreviations:

A Abbreviations have been used in the Bills of Quantities for the units of measurement and the contractor should take due notice of the undermentioned:

Contractor to provide:

Plant and equipmentB The Contractor is to provide all labour, mechanical and

other plant, Transport, tools, tackle scaffolding, staging,instruments, implements and equipment of everydescription necessary for the full and completeexecution of every part of works. All work in connectionwith plant scaffolding, staging, working accommodation,etc is to be executed in accordance with therequirements of all Local and other Authoritiesconcerned and the Architect.

Welfare:C The Contractor is responsible for the welfare of all

workmen engaged upon the works and shall maintain allsafety measures for their protection.Amenities are to be provided of a suitable standard andare to be in accordance with any statue applicable. TheContractor is to recognize and allow all nation statutoryand religious holiday and rites

Employment of Labour:D Rule for the Building Industry and Guaranteed Time.

Allow for all costs including Transport in sending out orimporting labour to the site. Allow for payment in respectof the National Provident Scheme, National Insuranceand Pensions and for Building and Civil EngineeringHolidays with Pay Scheme. Allow for all costs arisingout of the application of any bonus scheme and for allovertime and incentives which the contractor may offerin order to attract and retain the necessary labour on thesite and to achieve the date of completion.

Fair Wages:E The Contractor is to pay rates of wages and observe

hours and conditions of labour which are not lessfavorable than the general level of wages, hours andconditions observed by other employers whose generalcircumstances in the industry are similar.

Police RegulationsF The Contractor shall allow for all costs arising from

restrictions that may be imposed by the police or otherauthorities upon the execution of the works

ProgrammeG Within one week of the order to commence the work,

the Contractor is required to produce a Time andProgress schedule and a schedule of critical activities tothe approval of the Architect. Should circumstancesbeyond the control of the contractor affect the progressof the work, the schedule is to be modified as theArchitect shall direct. The Contractor is to supply copiesof the schedule to the Architect and retain a further copyon the site and is to ensure that such copies are kept up-to-date. The progress of the work is to accord with theschedule.

Keep RecordsA The Contractor is to keep accurate dated records of the

weather, (particularly rainfall) temperature, visitors, andany other events influencing the progress and quality ofthe works.

B The Contractor is to supply to the Architect suchinformation as he may require in connection with theworks including a statement showing the number of menemployed in all trades daily and delivery notes (statingthe name of the project) for all materials delivered to thesite.

Site MeetingC The contractor is to attend periodic meetings with the

Architect on the site and the Architect is to prepare anddistribute minutes of the meetings to the contractor andany sub-contractors and any interested parties.

Temporary Building and ShedsD The Contractor is to provide all temporary buildings and

sheds for the purpose of storage of materials andworkshops. He is also to provide any temporarybuildings required for the workmen. A proper office is tobe erected for the General Foreman which is to beequipped with desk and plan chest. The Contractor isalso to make provision for providing proper sanitaryconveniences for the use of the workmen.

E The Contractor shall provide and maintain suitableseparate office on site for the use of the Architects,Structural Engineers, Services Engineers, QuantitySurveyors, Resident Staff, and Employer'srepresentative (African Development Bank) in a positionapproved by the Architect. With all necessary finishing,fitting, artificial lighting, separate toilet, accommodationunit, air conditioners and a refrigerator.

F The contractor shall provide and maintain the following offices on site:-1. Consultants' Office and Project Co-ordinators(FMEHUD) must be equipped each with the following items:a. 1No Display Boardsb. Drawing Racks c. Plan chests/workTopsd. 1 No Toilet to be maintain by the contractor.e. 4 No 13 Amp socket outlet

f. 1 or 2 A/C Unit (12,000 BTU/hr) g. Tables for the resident consultants.h. RefrigeratorI. Two (2) intel celeron core 2 duo Laptops with A3 colour plotter for design teams, laser jet coloured printer

G The Contractor is to allow the cost for visit abroad to inspect materials to be imported before importation by all principals of all consultants with the Bank project coordinators. (At least 1 trips)

A The contractor shall provide and maintain a suitable separate office on site for the use of a Project Secretariat for the Secretary and Clerk with all necessary finishing, fitting, artificial lighting, separate toilet, air conditioners, tea/coffee making facilities, water refrigerator and a refrigerator.

1. Project Secretariat must be equipped with the following Office equipment:a. Computers & Softwareb. Stationeryc. Printerd. Internet Connectione. Copier

Removal of Temporary Buildings and ShedsB The whole of the foregoing temporary buildings and

sanitary conveniences are to be cleared away atcompletion, and all trenches, holes, etc. filled in a propermanner. In the case of the sanitary conveniences, theground is to be disinfected and the whole left in a cleanand orderly condition. In the event of buildingprogramme being altered, amended or enlarged, orthrough any unforeseen circumstance alterationsbecome necessary which may cause the removal or re-erection of any temporary buildings or sheds, suchremoval and re-erection is to be executed without extracharge to the Employer. The insurance maintenance orre-erection of such temporary buildings and sheds to beeffected at the Contractor's sole cost.

C Upon the removal of the temporary buildings, sheds etc.all foundations are to be broken up, all debris clearedaway and the site left in a clean and orderly condition.

D Temporary Fencing etc.The Contractor will be held responsible for the securityof the site while in possession, both by day and nightand he is to allow for all necessary watching and forproviding lighting, barriers or hoarding for protection ofthe works and for the safety of the Public.

E The Contractor is further to take away any otherprotective measure necessary to prevent unauthorizedpersons entering the site.

TrespassingF The Contractor must prevent his men from entering any

adjoining land or property other than that in which he isactually employed and the Contractor will be heldresponsible for any loss or damage which can beascertained and proved to have been occasioned by hisworkmen.

Working DrawingsG Working drawings for all works are to be kept at site at

all times, pasted on approved flat boarding andprotected from damage.

Sign Boards A The Contractor is to allow for providing a 1.30 x 1.80m

timber notice board at the entrance of the site bearingthe names of the Contractor, Architect, StructuralEngineer, Quantity Surveyors, and Services Engineersand that of the Contract. The size design and colour ofthe notice board is to be approved by the Architect. TheContractor is not to display any other notice oradvertisement in any form on any part of the site,building, hoarding or adjoining ground without the priornotice of the Architect.

Protection Against Damage:B The Contractor is to allow for providing all fans,

gantries, hording, guard rails, special protection andother means to all sides of the buildings and site asnecessary to fully and efficiently protect adjoiningproperty, persons, vehicle and the like from damage, orinjury and as required for the proper execution andcompletion of the whole of the works, and is toindemnify the Employer against all such damage orinjury and reinstate and making good any damagecaused to adjoining buildings consequent upon theexecution of the works.

C The Contractor is to provide and maintain all necessarytemporary warning lighting and notices in connectionwith scaffolding, fans, gantries, guard rails, hoardingsand the like. All fans, gantries hoardings, etc and allother means of protection are to be constructed andmaintained to the requirements of the Local and anyother Authorities concerned, and to the satisfaction ofthe Architect.

Protection of MaterialsD All materials brought on site to be properly stored under

cover and completely protected from the weather, allsteel work is to be raised at least 300mm off the groundon wooden blocks and all cement is to be stored on adry wooden blocks and all cement is be stored on a drywooden platform at least 300mm off the ground

Temporary Storm Water DrainageE The Contractor is to ensure that the site of the work is

kept free of storm water, flooding and is to provide suchtemporary drainage, etc necessary. Any damagearising by default of the Clause is to be made good bythe Contractor at his own expense

Temporary RoadwaysF The Contractor is to provide roads, path, track,

walkway, etc, into or about the site that may be requiredfor the execution of the works for the use of himself andSub-contractors. Such temporary roadways, etc., areto be executed to the satisfaction of the Architect, andthe Contractor is to alter, adapt, maintain and reinstatesame as ordered by the Architect and is to remove atcompletion and make good all work damaged ordisturbed.

Temporary Lighting and PowerG The Contractor is to allow for providing all necessary

temporary electric light and power for the worksincluding that required by the Sub-contractors and forthe connection to mains and temporary metered branchmains. All such electrical work is to be executed toconform to the requirement of the Local Authorityconcerned. All electric current used for the works,together with the costs of the temporary equipment areto be borne by the contractor and all electricalequipment should be removed at the completion of thework and cleared away, and all trenches, holes, etc filledin a proper manner, and any other work damaged ordisturbed properly made good.

Telephone/Telecommmunication/Internet services

H The Contractor shall arrange for the installation,maintenance and removal of telecommunication andInternet services for use in the site and is to allow forpaying all charges for such installation, maintenanceand removal and for all calls made.

Transportation (TO BE PASSED ON TO THE BANK)

I Purchase of 2No. 2.7litres engine Toyota Pick-Up 4WDvehicles for the Supervision Consultant's, Engineer'sRepresentatives and support staff as specified inspecification Cost to include insurance and registration.

J Purchase of 2No. 1.8litres engine Toyota CorollaAutomatic Transmission vehicles for the SupervisionConsultant's, Engineer's Representatives and supportstaff as specified in specification Cost to includeinsurance and registration.

Water for the WorkA The Contractor is to allow for providing all water

required for the Works including that for Sub-contractors. The water must be clean, fresh water.Execute all necessary temporary plumbing and pay allfees charges including connection to mains supply allrequisite host, tanks, taps, etc., as may be necessaryfor the due execution of the Works. All work inconnection with the water supply is to be executed inaccordance with the requirement of the Local WaterAuthority. All temporary water piping tanks and otherwater equipment are to be removed and cleared awayat completion of the work, and all trenches, holes, etc.,are to be filled in proper manner.

SamplesB The Contractor is to submit to the Architect for approval

samples of any material and workmanship proposed tobe used in the Works. Provide cupboards for thedisplay of the approved samples of materials on site.

C Allow for testing materials on site.

Prime Cost and Provisional Sums.D Prime Cost (or P.C.) Sums included in these Bills of

Quantities for work to be done by Nominated/DomesticSubcontractors shall be understood to mean the netamount expended in favour of such persons afterdeducting all discounts other than discounts for cashnot exceeding 21/2%. Prime Cost (or P.C) Sumsincluded in these Bills of Quantities for materials orgoods to be obtained from Supplier to be nominatedshall be understood to mean the net cost to be defrayedas a Prime Cost after deducting all discounts for cashnot exceeding 5% and shall include the cost of packingcarriage and delivery.

E Where Provisional Sums not qualified by the wordsPrime Cost (P.C.) are included in these Bills ofQuantities, they shall be deemed to include Contractor'sProfit. Such sums shall be expended as described bythe Architect and deducted wholly or in part if notrequired. The value of any work done under such itemshall be ascertained in the manner provided underclause 11 of the Conditions of Contract.

F The Contractor is to produce for inspection when required all invoices, receipts and vouchers in respect ofpayments for which prime cost (P.C.) or provisional sums are provided in these Bills of Quantities.

Fixing of P.C. Goods of Materials:G The prices in the Bill of Quantities for fixing goods or

materials for which prime cost (P.C.) sums are providedwill be deemed to cover unloading, getting in,unpacking, storing, protecting, hoisting, assembling andfixing, and also returning empties whenever a reductionof a Nominated Supplier's charges can be secured byso doing.

IncompetenceH Any person employed on the work who in the opinion of

the Architect is incompetent or who may act in animproper manner shall be immediately removed fromthe work by the Contractor when called upon to do so byArchitect.

Attendance on Sub-Contractors and Specialists Tradesman.

A The Contractor is to price where indicated later in theBills of Quantities for attendance uponNominated/Domestic Sub-Contractors and SpecialistTradesmen employed by the Architect. Suchattendance is to include for the provision of full sizesetting-out templates, giving all necessary dimensions,taking responsibility for the accuracy of all necessarydimensions, taking delivery of materials, etc., unloading,getting on site, storing, hoisting and placing materials inposition, affording use of all erected scaffolding and forproviding, erecting, moving and dismantling allnecessary additional scaffolding, working platforms,etc., required solely by Nominated/ Domestic Sub-Contractors for the execution of their work and formaking available all necessary plant and working space,and supplying water, artificial light and electric power,including that required for Test services andinstallations, latrines and other facilities and ascertainingfrom the Nominated/Domestic Subcontractorsparticulars of chases, holes, mortices and the like whichthey required to be formed or left in connection withtheir workNote: Items of "General and Special Attendance" asdefined in the Standard Methods of Measurement ofBuilding Works are both expressly deemed to beincluded in this Clause

AttendanceB The Contractor is to allow for providing attendance by all

trades on all trades.

Removing WaterC Allow for bailing, pumping or otherwise removing all

water which may accumulate in the excavations, orelsewhere on the site during the progress of the works,whether arising from ground water, surface water;weather spring, drains or any other source

DayworksD Should it be found in the opinion of the Architect, that by

reason of their intricate nature of exceptionalcircumstance, works ordered by him cannot be fairlyvalued at the schedule rates for measured works, hemay order these to be carried out on a time andmaterials (Daywork) basis in accordance with theprovision in the Appendix of the Bills of Quantities

E The Daywork sheets in connection therewith are to besubmitted to the Architect's representative by Tuesdayfollowing the week in which the work is executed.

Protect WorksF The Contractor is to allow for protecting in an approved

manner all concrete work, pavings, blockwork and otherwork, fittings or building equipment liable to damage bythe effect of sun, rain, drying winds, other inclemency ofweather and shall further include for casing or otherwisesuitably protecting all work of any kind or descriptionfrom any injury or damage. Should any work becomedamaged, it must be reinstated to the Architect'ssatisfaction and at the Contractor's expenses

H The Contractor shall if required by the Architect searchfor the cause of any defect, imperfection or faults in theWorks and the cost of searching as aforesaid shall beborne by the Contractor and he is to repair, rectify andmake good that defect, imperfection or fault at his owncost.

Material DeliveriesI The Contractor will be responsible for ensuring that all
