Fair Labor Standards Act (FLSA)
Law includes:
● Overtime, Minimum wage
● Equal Pay Act, Child labor restrictions
Key employee protection:
● Employees must be paid time and ½ for all overtime hours worked, unless eligible for exemption
● unless an explicit exemption from overtime pay applies
Overtime Exemptions effective December 1, 2016
● Teaching professionals remain exempt from overtime
○ Perform “exempt” work, and
○ Not subject to weekly minimum salary provisions
● Non-teaching must satisfy all three criteria to qualify as exempt:
○ Primary position duties are executive, professional, or administrative as defined by the Department Of Labor
○ Employee paid on a salaried basis, and
○ The salary is at least $913 per week (equivalent to $47,476 12-mo annual)
Who does this apply to at PSU?
Overtime Exempt:
● Full and part-time instructional faculty
● Graduate teaching and research assistants
● Employees who perform “exempt work” AND are paid a salary of no less than $913 per week
Who does this apply to at PSU?
Overtime Eligible:
● Employees who DO NOT perform “exempt work” regardless of their salary
● Employees who are paid a salary of less than $913 per week, including those who perform exempt work
● All employees who are paid by the hour
Please Note: Overtime eligible may include research faculty.
FTE does not alter the minimum $913 salary requirement.

● Must report their time worked by the week, even if part-time
● Time worked includes: work-related phone calls, text messages, or email during off-work hours
● Must take rest and meal breaks
● Must have pre-approval to work overtime
