WHEREAS, Finger Lakes Community College has updated its position roster that lists position titles determined by the

Finger Lakes Community College Board of Trustees in the professional service as defined by §6306 (2) of New York State

Higher Education Law as approved by the Chancellor of the State University of New York; and

WHEREAS, the following is a new job description for Finger Lakes Community College:

RESOLUTION TO AUTHORIZE AN AGREEMENT WITH BETWEEN FINGER LAKES COMMUNITY COLLEGE, ONTARIO COUNTY AND THE FRIENDS OF THE CONSTELLATION BRANDS – MARVIN SANDS PERFORMING ARTS CENTER, INC.

FOR THE EMERGENCY EVACUATION AND FENCING PROJECT

WHEREAS, Ontario County (the County) is the local sponsor of Finger Lakes Community College (FLCC), as set out in New York Education Law §§ 6301, et. seq. and as further set out in 8 CRR-NY 604.1 title to all real property shall vest in and be held by the local sponsor in trust for the exclusive use and purposes of the college, as determined by the local board of trustees ; and WHEREAS, the County and the Friends of The Constellation Brands – Marvin Sands Performing Arts Center, Inc. (Friends) entered into a ground lease (the “Ground Lease”), dated August 1, 2005, and as amended thereafter, wherein the County conveyed to the Friends certain rights in about 7.8 acres of land and the existing performing arts center (hereinafter the “Constellation Brands – Marvin Sands Performing Arts Center” or “CMAC”) and other improvements on that property (collectively the “Property”); and WHEREAS, the overall management and operation responsibilities of the Property are defined in the Ground Lease and more particularly in the Second Amended and Restated Operations Agreement, dated as of December 3, 2014 (the “Operations Agreement”) between FLCC and the Friends; and WHEREAS, the parties desire to remove the existing fence and gates located adjacent to parking lot D just uphill and east of the leased area and construct a new fence with gates and removable panels in order to provide exiting capacity in compliance with recent updates to the New York State Fire Prevention and Building Code, and provide exit signage in a size, type and location required by said code (collectively the “Improvements”); and WHEREAS, The Ground Lease and the Operations Agreement require the County and FLCC’s prior written approval for improvements to the Property; and WHEREAS, the parties believe it to be in their best interests to cooperate in the design, funding, and implementation of said Improvements, subject to the terms and conditions of this Agreement; and NOW, THEREFORE BE IT RESOLVED, that the FLCC Board of Trustees hereby grant authority to the Vice President of Administration & Finance to execute an agreement between FLCC and the Friends to permit the removal of the existing fence and gates located adjacent to parking lot D just uphill and east of the leased area and construct a new fence with gates and removable panels in order to provide exiting capacity in compliance with recent updates to the New York State Fire Prevention and Building Code, and provide exit signage in a size, type and location required by said code (collectively the “Improvements”); and BE IT FURTHER RESOLVED, that certified copies of this resolution be sent to the FLCC Vice President of Administration & Finance, the Friends of CMAC, and Ontario County.

RENEWAL OF DEMAND CONTRACTS TO PROVIDE ARCHITECTURAL & ENGINEERING SERVICES

WHEREAS, resolution 24-18, dated June 6, 2018, awarded contracts for architectural & engineering services at Finger Lakes Community College, RFP R18057; and WHEREAS, the specifications allow for up to two additional twelve-month periods for a total of three years if mutually agreeable by both parties; and WHEREAS, this would be the first of two renewals available for an additional twelve-month period from June 6, 2019 through June 5, 2020; and WHEREAS, Advanced Architecture and Planning, P.C., Dwyer Architectural, PLAN Architectural Studio, P.C. and TYLIN International have indicated a desire to extend the contract for a twelve-month period at the current price structure indicated in the proposal; and WHEREAS, the FLCC Board of Trustees Finance & Facilities Committee has reviewed and approved this resolution; NOW, THEREFORE, BE IT RESOLVED, that the FLCC Board of Trustees hereby renews proposals for RFP R18057 from the following firms, for the period June 6, 2019 through June 5, 2020: Architectural and Engineering Services: Advanced Architecture and Planning, P.C., 2801 Long Pond Rd, Grand Island, NY 14072

APPROVE MAY 16, 2020, AS THE DATE OF THE 52nd COMMENCEMENT CEREMONY FOR FINGER LAKES COMMUNITY COLLEGE

WHEREAS, in compliance with NYS Education Law, §355 (1) (e), Part 604, the Finger Lakes Community College Board of Trustees has the authority to designate the official day of the Finger Lakes Community College Commencement ceremonies; and WHEREAS, it is the intention of the Finger Lakes Community College Board of Trustees to designate the third Saturday of the month of May 2020 as the official day for the 52nd Finger Lakes Community College Commencement ceremonies in conformance with the days of instruction required by the approved 2019-2020 academic calendar; NOW, THEREFORE BE IT RESOLVED that the FLCC Board of Trustees hereby designates Saturday, May 16, 2020, as the official date for the 52nd Finger Lakes Community College Commencement ceremonies.
