premium & submitted to the Govt. for its sanction, a modification proposal to
the regulation no.18.1 of the Revised DC Regulations-2009, after completing
the legal procedure under section 37(l) of the MR & TP Act, 1966.
The Govt. has also declared the New Industrial Policy-2013 for
Maharashtra State vide Resolution no. III-Policy 2010lCF.-7681 Industry-2
dt.22 Feb 2013, wherein the State Govt. has announced its decision to permit
additional 0.5 FSI for MIDC arcaby charging premium.
After consulting the Director of Town Planning, Maharashtra State, the
Government has sanctioned the proposed modification with some change" .,i.lo' r v r u v , c ' \

2013. (copy enclosed).
In exercise of the powers conferred by sub-section (2) of the Section 37 of
the said Act, the Government has sanctioned following modification and also
fixed the date of publication of the said notification in the Official Gazette as
the date of coming into force of this modifications.
Regulation 18.1- The following Note (vi) is added in the Notes below
Table 3.
vi) Additionat FSI upto 0.50 may be permitted over and above the basic
FSI of 1.00, subject to payment of premium for such additional FSI as per
the rates and conditions decided bv the MIDC from time to time.

Provided that no condonation shall be permissible in the marginal
distances, as well as requirements of parking and amenity space for
utilization of such additional F.S.I.
Provided further that, the users for which additional FSI up to L00
7o is permissible under other relevant provisions of these Regulations shall
be governed by those Regulations.
With reference to above notification, some of the SPAs were requested
toprovideinformat ionregardingcr i ter iafol lowedinCIDCo.&some.,of the
Corporations and premium rates of CIDCO and some major urban local bodies
for different land uses. Accordingly, some SpAs have submitted the
information. As per information provided by SPAs, there is no provision of
allowing 0.5 additional FSI for industrial unit (please see the enclosed
annexure).
Now with reference to the sanction accorded by the Government,
premium for such additional FSI is to be decided by MIDC. In this regard, it is
submitted that following are the rates of premium already decided by MIDC for
additional FSI.
1) Additional FSI for private/public IT Park i 25%o of Ready Reckoner
rate or MIDC industrial rate, whichever is higher, for IT use,75vo of
MIDC Residential rate or R.R. Rate, whichever is higher for IT
Residential use & 100% of MIDC Commercialrate/Avction rate or R R
Rate, Whichever is higher, for IT commercial use.
2) Star category Residential Hotels - l5oh to 20o/o (depending on Star
Category of Hotel ) of MIDC rate or Ready Reckoner rate, whichever
is higher.
3) 0.20 additional FSI for Industrial Plots upto 1000 Sg.ffi, as per rule
no.18.2 of DCR :- 25% of MIDC rate or Ready Reckoner rate.
whichever is higher.
4) 50% additional FSI for Pharma Industrial as per rule no. 18.2 of DCR:-
25%o of MIDC rate or Ready Reckoner rate, whichever is higher.
5) 50% additional FSI for Government, Semi Government & Public Sector
undertaking.- 25o/o of MIDC rate or Ready Reckoner rate, whichever is
higher.
6) 100% additional FSI for a Gems & Jewellery Independent plots
SEEPZ, Marol as per rule no. 18.4.2 or DCR.:- 25Yo of MIDC rate
Ready Reckoner rate, whichever is higher.
Recently, vide Government Notification dated 0710112014, 100%
addition FSI for Residential buildings on independent residential plots in
declared IT/BT Parks is sanctioned by the Government with a condition that, in
case of additional FSIIFAR allowed, as aforesaid,.premium at the rate decided
by MIDC from time to time as per its pricing policy for residential purpose
shall be charged which shall, in any case, not be less than l00Yo of the current
MIDC auction/tender rate.
However, at many places, MIDC is unable to provide land for
expansion, particularly for MSMEs. The additional FSI is given to economize
the land use and charging heavy premium may defeat the very basic objective
of provision of additional FSI. It is hence proposed to recover premium as
under -
1) Additional premium for industrial activities / industrial plot :25 Yo of
prevailing industrial rate of MIDC in that area.
2) For residential use : 50 % of prevailing residential rate of MIDC in
that arca.
3) For commercial use :75 o/o of prevailing commercial rate of MIDC
or R R Rate, whichever is hieher.
Accordingly, a draft Board item is prepared and enclosed herewith for
favour of approval & further orders please.

With reference to decision taken in MIDC's meeting no. 335 dt. 10 June
2010 vide resolution no. 4947, a proposal regarding enhancement of basic FSI
from 1.0 to 1.5 for MIDC area was submitted to the Govt. for its sanction, after
completing the legal procedure under section 37(l) of the MR & TP Act, 1966.
After consulting the Director of Town Planning, Maharashtra State, the
Government has sanctioned the proposed modification with some changes vide
Notification no. TPS 43l2l2IIlCP.-2512012ND-ll dated 20th November.
