“Management Services: Operation & Programming of the KiMo Theatre”

• The Proposal Due Date has been changed to Tuesday, January 9, 2007 at 4:00PM. The following questions were asked at the mandatory pre-proposal meeting for RFP2007-006-SB “Management Services: Operation & Programming of the KiMo Theatre”. 1. What is the seating capacity of the KiMo?

• The Fire Dept. official maximum Occupant Load of the auditorium and lobby is 666, the number of seats / tickets available to sell is limited to 650 to allow for the required Front-of-House staff and remain within the maximum legal capacity.

2. How many circuits does the auditorium have?

• Attachment A contains the most currently available inventory list for the KiMo Theatre. This list also states shared assets that may be transferred or shared by other City departments.

4. Insurance

• The City self insures the KiMo Theatre facility. Offerors are required to provide additional insurance as stated in the solicitation.

5. Can a list of current technical employees be made available including which employees currently are

included in a collective bargaining agreement?

• No KiMo Technical Staff participate in a collective bargaining agreement.

8. How will intellectual rights be handled within this contract?

• The City of Albuquerque will not be held accountable for property or artistic rights violations caused by the Contractor.

9. What is the cost breakdown for utilities, electrical and gas?

• This question will be answered in a later addendum. 10. Does the City plan on making capital improvements to expand program options and/or is it

appropriate for these elements to be included in a response to the RFP?

• Capitol improvements through the General Obligation Bond Program can only be initiated through the City of Albuquerque’s Cultural Services Department with concurrence from the Administration and City Council. The Contractor is recommended to work with the Department Director or designee in addressing building or equipment deficiencies and to include requests for capitol funding through the General Obligation Bond processes.

11. How long a transition period does the City plan for its current level of involvement in terms of staffing,

maintenance, and management once the contract for operation and programming is issued.

• Offerors should submit as part of their proposal a plan and schedule for the transition period. 12. There are many definitions of and expectation for “public-private partnerships”. What is the City’s

definition of “public-private partnership” in relationship to operations and programming of the KiMo Theatre?

• It is the responsibility of Offerors to define the partnership between the City and the awarded

contractor. 13. Is there a list of existing executed contracts through Fiscal Year 2007 and 2008?

• See Attachment B 14. Is the KiMo compliant with the newly adapted International Fire Code?

• The Fire Prevention Bureau conducted an inspection of the KiMo Theatre on December 5, 2006. The City will make any necessary upgrades to the KiMo. It will be the responsibility of the awarded contractor to meet current and future fire codes. The December 5, 2006 inspection report is in Attachment C.

15. Is there an existing liquor license?

• The KiMo Theatre does not have permanent liquor license. 16. Is there a sound upgrade currently in the works?

• Yes, surround sound for video and film as well as addition of main PA speakers and amplifiers. 17. Are there any structural issues with the KiMo in regard to production and rigging?

• The main support structure of the stage house / fly loft was seriously damaged in a 1961 fire. Flown loads are limited to 1000 pound gross per truss but not all trusses may be loaded to maximum at the same time. Other attachment points on the ceiling are very limited in capacity, usually 100 pound maximum.

18. Is there an existing ticketing agreement? Is it transferable?

• The City currently has an agreement with Ticketmaster and it is transferable. It is recommended that the Contractor negotiate its own agreement with either Ticket Master or another ticketing system provider.

19. Is the KiMo an enterprise fund?
