TOP 5 POINTS TO CONSIDER WHEN SELLING RESIDENTIAL REAL ESTATE

1. Listing Home vs FSBO. You will be signing a listing agreement. The listing agreement is a contract between you and the real estate broker. It outlines the fee for professional services (usually 6% of the sales price), when payment is due and what each parties duties are. Your Realtor® will be there to market the property, assist you with the contract, arrange for showings and inspections, and walk you through the closing process. If you decide to try to sell your home by yourself as “For Sale By Owner” (FSBO), then you will need to evaluate the price, determine if you are willing to pay a buyer’s broker (usually 3% of the sales price) if he/she brings you a buyer, and have a contract readily available so that the terms of the deal may be memorialized. You should consider work-ing with a title company who can assist you with providing you an estimate on closing costs, providing you a contract form, and who can act as the escrow agent. 2. The Contract. The purchase and sale agreement is the contract between you the buyer. It states who the parties, are, what is being purchased, when the closing will occur, and other duties each party has. The contract requires consideration, that is, an earnest money deposit, to be posted to be held in good faith for the closing, and also as collateral for damages to the seller if the buyer breaches the terms of the agreement. If the buyer is obtaining financing, then the lender will require a copy of the contract. The contract will outline an inspec-tion period, if a seller is obligated to make any repairs, and who pays what closing costs at closing. Typically the seller pays real estate commission (if any), title insurance, deed documentary stamp taxes and typically a proration for real estate taxes.

a. Disclosing Latent Defects. In Florida, home sellers are required by law to disclose latent defects. If there is a problem with the house that is not readily observable, then it is best practice to disclose, disclose, disclose. Your Realtor® will have a seller disclosure form for you to complete where you can disclose what you know about the property. If you are selling your home yourself, you should prepare a written document and have the buyer sign a receipt acknowledging it.

b. Permits. Permit problems have become a widely contested problem in Alachua County in recent years. Permits are not a title concern and are not found in a routine title search. Recently, the County has required that any old open permits be closed prior to obtaining a new permit. It may be possible that your home has an open permit from a previous owner that was not disclosed. Further, if you know you have done work to the house that was not permitted, but should have been, you should disclose this. If you know of open permits, you should disclose to the buyer. You can search online with the County’s online permit tracker for the builder department by entering your tax parcel number or name to find out if you have open permits. The county can also perform a formal search for you if you want to find out yourself before selling. If you opt for not knowing and thus not disclosing, that is fine. However, be aware if the buyer finds out there is an open permit, they may want to cancel, or negotiate you to pay toward closing it.

3. Buyer Obtaining Financing. The federal government recently changed the financing laws for buyers under CFPB (Consumer Finance Protection Bureau). The new rule changes under TRID (TILA- RESPA Integrated Disclosure) have strict deadlines and guidelines for individual borrowers obtaining financing. Most of borrower information is now treated as if it is private information. You should be aware thatlenders frequently need delays and your closing may not occur on scheduled date. 4. Title Insurance. When you purchased your home, you most likely obtained what is called an “Owner’s Title Insurance Policy.” The seller most likely paid for this. This Title Insurance Policy insures to you that you had good marketable title when you purchased the property. If you have a policy that is three years or less, you should give it to your closing agent for a discount called “re-issue.” You are also entitled to a re-issue discount if you ever refinance the property. Title insurance is based on the sales price. If the buyer is getting a loan, then his/her lender will require a title policy as well that the buyer will pay for. The closing agent will evaluate your title—search the public records to confirm record title holders, any outstanding mortgages, liens, judgments, and payment of real estate taxes. 5. The Closing. At closing, you will review a closing settlement statement which will outline all of your title costs and give you your net proceeds. You will also be required to sign a warranty deed, an owner’s affidavit confirming there are no other liens, a 1099 SMS determination statement to confirm if a 1099 is required, as well as some other forms. Typically a seller’s closing takes about 15-20 minutes because the paperwork is very light as compared to buyer signing a mortgage which takes about an hour. You will receive your funds when the closing company “funds”—that is it has received all of the fund and has authorization from the borrower’s lender that it is ok to disburse. FILING FOR HOMESTEAD EXEMPTION

Florida law allows permits homeowners to apply for homestead exemption by filing an application with the property appraiser where the they reside by March 1st. According to Florida law, January 1 of each year is the date on which permanent residence is determined. Florida’s Constitution provides for an exemption, which is deducted from a property’s assessed value if the owner qualifies. To properly qualify for homestead, applicants must file on or before March 1, possess title to the real property, and are bona fide Florida residents living in the dwelling and making it their permanent home as of January 1st (closed on or prior to 12/31/2015). Properties granted Homestead Exemption also automatically receive the “Save Our Homes”, Amendment 10, benefit, which will cap the assessed value up to 3% annually.

Applicants can apply online (https://heats.acpafl.org/ApplyOnline/WebForm1.aspx) or in person at the property appraiser’s office (Alachua County: 515 North Main Street, Suite 200 , Gainesville, Florida). If you file online, it is important to print a receipt of your application. Sometimes, an in-person application is required in certain circumstances, such as:

• Property ownerships not posted to your name• Adding additional exemptions to an existing homestead exemption• Adding additional applicants to a parcel that already has an existing homestead exemption• If the property is owned in a trust, and you are not listed on our records as having a beneficial interest or as trustee of the trust.

Homestead application lowers homeowners’ taxes. The benefit for homestead for taxation purposes is that homestead lowers the assessed value by up to $50,000.00 (for properties assessed at $75,000+) for ad valorem county taxes and up to $25,000.00 for school board taxes. So a house assessed at $100,000.00 will be taxed at $50,000.00 for ad valorem taxes and $75,000.00 for school board, saving the homeowner thousands of dollars in taxes.

There are also additional exemptions available (blind, widow, disability, disabled veteran) that you may be eligible for.
