President’s Message
I just want to start off by saying how proud I am to be the President for this association for another year. 2016 was a great year for us with the Pa-rade of Homes, Golf Outings, Speed Networking, and Fall Tour of Homes. We have some great members that support this association and the events we put on. I know we will be able to make 2017 just as great!Our members don’t just support us they also support the community. Every year around Thanksgiving we team up with the Evansville Christian Life Center for their turkey prep night. On this night our members would volunteer time out of their busy schedule and come in and chop vegetables, bake pies, and do anything else that they needed help with.This year ECLC decided not to do the turkey prep, so we decided to do a canned food drive instead. The food that we collected went to their Food Co-Op that they started. This food Co-Op is where families can go and pick up food that they need, just like a grocery store.Our members went above and beyond with the generous donations they brought in for ECLC. See page 26 to see the stockpile that we formed in our board room before we brought it over to ECLC November 21st! ECLC really appreciates that we could still find a way to be involved with them duringthe holiday season!
Don’t forget with the craziness of the holiday season that on December 15th we have our legislative builders forum meeting at Tropicana. As you have heard me talk about this at membership meetings, this is something that I feel passionate about and I hope that you will all come out to Tropicana and hear what the State Representives have to say. You can fill out the RSVP form on page 15 or call the SIBA office and Katie will help get you signed up.

Assorted Year-End Thoughts For Your Membership
SIBA’s NEW WEBSITE… SIBA launched a new website built with software that is not ancient. Members and consumers can visit SIBA easier and access information much more effectively.ELECTION THOUGHTS…. This November, Johnson County, Wyoming caught my attention. I had never heard of this community, but it made news in a good way. They reported a 100% voter turnout!!! With a population of 8600 people, 4402 voters were registered. And 4485 actually did vote. (It was explained their laws allow you to register and vote the same day.) If you’re still reeling (good or bad) from the Presidential election, you’re not alone. Thanks to many in the media, and reports from polling firms, most people didn’t see these results coming. Some are angry. Some are basking in it. But most are just glad it’s all over. My sense is all sides should wait to judge, because… haven’t we proven we aren’t good at predicting how things will go?However things go, we should be reminded of a low voter turn-out in most jurisdictions. Vanderburgh County reported 52% of the registered voters made it to the polls. It’s hard for me to imagine 48% of the voters in our own community didn’t think
the impact of this election wasn’t worth making it to a voting center. Yikes!By the way, Johnson County is big coal country in Wyoming. Trump won with 77% of the vote, so they are probably not incurring the street protests. And in fact, NAHB is anticipating a favorable impact on regulations under the Trump administration, who spoke to NAHB in August. I recommend watching the YouTube video. Trump said he was shocked to learn 25% of the cost of a new house is due to regulations. NAHB is already working to reduce cost. If they really want to fix this “BIGLY”, my hint is – look at development requirements! Since this is the easiest section of the development pipeline to add pie-in-sky regs, that’s exactly what happened. The now the price tag proves it.
SIBA SUCCESS… Locally, SIBA BUILD PAC supported several candidates and with good success. After a few successful fundraisers, the SIBA BUILD PAC conducted interviews with candidates for key offices and made significant contributions to candidates who are pro-building. Congratulations to all the winners and thanks to everyone who ran a campaign and gave voters the choice in leadership.If you think political action is expensive, try having a building company without it. When you consider the cost of a single no-growth policy, supporting your SIBA BUILD PAC has proven to be a wise investment. I’m happy to report that 98.4% of SIBA’s PAC funds
went to winning candidates. MORE BUILDERS IN THE STATEHOUSE… Members should be aware of the work being done for their interests at the state and national levels – both in the political arena and regulatory affairs. But it’s not without huge efforts made by our state association staff, and members willing to step up to more responsibility. Did you know…. this November the sixth IBA member was elected to a seat in the General Assembly?IBA is asking all members for input on issues for the building industry. MODEL AND SPEC HOME DEDUCTION DUE DEC 31… And speaking of the value of your Builders Association, all builders are reminded that applications for the Model Home Deduction or the Residence in Inventory (Spec. Home) Deduction for 2016 must be completed and signed no later than Dec. 31 and submitted or postmarked no later than Jan. 5, 2017. Applications can be found on IBA’s website (www.buildindiana.org) under the “Codes & Laws” page on the member’s only page (password: IBAHOME).
YOUR NAHB… Have you signed up for NAHBNow yet? This is a quick and streamlined email service from the national association, that keeps you on top of federal builder issues. Get it now! You’ll see NAHB was very involved in federal races, supporting pro-development candidates this year. They have an interesting report on the election results at http://www.

nahb.org/~/media/Sites/NAHB/advocacy/2016-Election-Summary.In a victory for NAHB, a federal judge in Texas on Nov. 22 granted a preliminary injunction to delay implementation of the Department of Labor’s new overtime. The rule, which was scheduled to take effect on Dec. 1, would double the overtime salary limit from $23,660 to $47,476. Stay tuned for more details!In another NAHB victory, the Environmental Protection Agency (EPA) signed new rules for municipal separate storm sewer systems (MS4s) which preserve the ability of cities to choose from a wide range of options to tackle urban water pollution. Allowing narrative requirements (rather than numeric) for new development is especially important to builders in cities facing expensive federal mandates to upgrade their drinking water, sewer and stormwater programs all at once. “This rule signals that EPA is open to allowing cities to address pollution by carefully crafting local programs that work with development, rather than against it,” said NAHB Environmental Program Manager Eva Birk.In addition to battling all the regulations on your behalf, you’ve got to give NAHB a lot of credit. They booked Peyton Manning as the Keynote Speaker for Opening Ceremonies at the 2017 IBS, January 10-12 in Orlando.
PRICE INCREASES… Both IBA and NAHB are both considering dues increases. Membership is this organization is worth every penny, but especially so when you consider the battles being fought. SIBA will alert all members of the results of those
upcoming votes. Locally, the SIBA board approved a new rate of 4% for processing credit card payments. This is to cover SIBA’s costs from cards and associated networks.
MORE GREAT EVENTS, SERVED UP FOR MEMBERS… A couple “Don’t Miss” dates are coming up. SIBA’s Builders Legislative Forum is on December 15. All the lawmakers from SW Indiana have committed to attend and listen to SIBA members’ issues. Next, the Builders Workshop and Parade Preview are on January 17, 2017. Our Builders Workshop will have Brian Flook, who is a featured speaker on sales and marketing at the IBS in Orlando! Also Shannon Frank is presenting on new home laws and warranties for Builders & Realtors! You should register for both ASAP!
MY EARLY CHRISTMAS GIFT? I’m thankful for the Chicago Cubs championship, and for one of the best World Series ever. My grandfather taught music, and at the age of 16 won a contest where the prize was to play to organ at Wrigley Field during a Cubs game. Not sure if that’s what triggered the Cubs fandom, or was it the airwaves from WGN to South Bend. Your teams aren’t something you choose in life. And of course, my Yankee friends gladly point out if history repeats itself, New York will win 27 more titles before the Cubs win again. Hmmmm…. when do pitchers and catchers report?
BIG FINISH… The members of the Southwestern Indiana Builders Association are an incredible bunch of individuals and companies. Thank you for a successful and generous canned goods drive for the Evansville Christian Life Center! I hope Santa delivers your gifts perfectly on time and under budget. Where has the year gone? I think we blinked and we skipped right through fall. I am sure December will fly by just as fast. With the Holidays coming in the near future we don't have a lot planned so you can spend time with family and friends, but we will be having our first 2017 builders legislative forum on December 15th. This is going to be a great opportunity to listen to some people who are high up in their field and actually care what you are concerned with. Rick Wajda, IBA"s Chief Executive Officer and Lobbyist, and Carlie Hopper, IBA's Governmental Affairs Director, will discuss the basic principles of safe and affordable home building ; how to stay connected with IBA; and cover IBA's legislative agenda for the upcoming session. This program will be at Tropicana Evansville Room starting at 8:00 am with a delicious breakfast. The builder
legislative forum is only $15/person and members who have contributed to the 2016 SIBA BUILD PAC will get TWO FREE ATTENDEES! That is a pretty good deal if you ask me! As we move out of December and the holiday's we start preparing for everyone's favorite time of the year, which is the Parade of Homes. We will not be having the membership meeting on the second Tuesday. Instead we will be having it on January 17th as our Parade Preview! Everyone always loves coming to this event to see what Parade of Homes 2017 has in store. Spots are now open to all members! We have 41 slots available for purchase. Our prime booths are $380, our other booths are $220. This is a great opportunity to pitch your products to builders for the Parade. For more information on floor plan of booths visit, pages 12-13. You can also contact me at the SIBA office if you have any questions. Our license prep class that was scheduled for November has been moved to December 6,7, & 8. Tenant Forced to Vacate Leased Space Due to Failure to Provide Renewal Notice
The Indiana Court of Appeals recently granted a church’s petition to rehear a breach of contract case and reaffirmed its previous ruling against a church that had failed to carry out the terms of its lease with its landlord.
In Randy Faulker & Associates, Inc. and Randall W. Faulkner v. The Restoration Church, Inc., 41A01-1506-PL-706, the lease agreement between Randy Faulker & Associates, Inc. (“Landlord”) and The Restoration Church, Inc. (“Church”) called for the Church to give the Landlord timely notice of its intent to renew its lease each year. Despite continuing to pay rent and occupying the premises, the Church never provided the Landlord with such notice. After some time, the Landlord informed the Church that the lease was terminated due to non-renewal and that the Church would have to vacate the premises. In response, the Church filed suit against the Landlord for, amongst other things, breach of contract.
Initially, the trial court found for the Church, determining the Landlord waived its right to a timely notice of the Church’s intent to renew the lease when it accepted the Church’s untimely notices and annual rent payments. The Indiana Court of Appeals reversed that decision, however, concluding that the act of holding over and paying rent did not constitute sufficient notice to the Landlord from the Church because the lease specifically called
for written notice of intent to renew the lease in advance of the lease term ending.
The Church filed a petition for rehearing in the Court of Appeals, arguing that the court failed to take into account a provision of the lease which the Church argued imposed a duty of good faith on both parties, and the Landlord breached that duty by lulling the Church into believing that, in practice, the specific notice of renewal requirement would not be enforced. The Court of Appeals granted the Church’s request for rehearing but reaffirmed its decision in favor of the Landlord.
In reaffirming its prior decision, the Court of Appeals identified another provision in the lease that said the Landlord’s failure to enforce one term of the lease “shall not be deemed a waiver of any subsequent breach or default.” The Court held that the general lease provision pertaining to “good faith” did not supersede the more specific and express provisions found elsewhere in the lease.
This case illustrates the importance not only of careful contract drafting but also of the necessity for parties to carefully read and abide by the express terms of their contracts.

RESIDENTIALSIBA’S LICENSE EXAM PREPARATORY CLASSES
BACKGROUND: Vanderburgh County requires an individual to take and pass an open-book test before they can be issued a license to work as a Residen�al Building Contractor. The test includes 100 ques�ons, and applicants are required to score 70 or be�er. Individuals interested in taking the test may be interested in taking a class that prepares them to take the test with providing informa�on, as well as quick-reference skills to pass the test.
PROGRAM: SIBA is now providing a class for individuals preparing to take the exam for the Residen�al Contractor. The 2 hour classes will be held on 3 consecu�ve a�ernoons. The class will review basic code informa�on, quick-reference skills, and a prac�ce test – all to prepare registrants for the actual test.

New Tradition: “SIBA Food Drop”SIBA’s long-held tradition of finding our way to the Evansville Christian Life Center to help prepare hundreds of turkey dinners to start Thanksgiving week has come to an end. It wasn't the same without it this year, but our newly adopted tradition went just as well. SIBA was known for having dozens of volunteers to carve turkey, fry bacon, chop onions and prepare sides so that families in our community would have a turkey dinner on Thanksgiving. This year we collected canned and household goods at the SIBA office for the ECLC food Co-Op that they started this year. The Food Co-Op gives us an opportunity to extend, deepen, and strengthen the exciting work already being done in the GAIN Initiative. We hope that this tradition can keep going for many years to come like the turkey prep did in the past.
