2015 SIBAPresident

I hope everyone enjoyed a great Parade of Homes. From what we are hearing at the SIBA office, traffic was very good – in quantity and quality. Several builders reported they sold their Parade House, or sold another house f rom the exposure the Parade provided them.

Each year the Parade of Homes gives us the exposure we need to reach buyers. This event is especially important for builders, but means a lot to subcontractors and suppliers too. As President I want to thank the Committee for its diligent work in making this year’s Parade a success.

I also want to thank all the sponsors who stepped up to support

the Parade of Homes. I know our staff and committee focused on giving much of the spotlight to the major sponsors and advertisers, but the Parade benefits all participants. And I wish everyone success in following up with the thousands of visitors we had at Parade of Homes.

But the summer is just getting started, and I need to share with you the other SIBA events - Like the Golf Outing at Rolling Hills Country Club. We are looking forward to another fun outing on Monday, July 6. Please register to come have lunch and play golf with the Builders Association! It doesn’t matter if you’re an Ace shooter, or a duffer, we have fun at the Builders Golf Outing. We have all sorts of sponsorships available that let you network with the players as they play the course.

It should be very easy to recruit memberships into the Association, just based on the benefits of membership, as well as what the Association does

for your business. It’s time to build our association back to where it needs to be, and perhaps the most important challenge we face as an organization. Our membership is around 240 and we need to be at 300. If you need help, please contact Jamie for materials and assistance.

Lastly, I think you’ll want to mark your calendars for SIBA’s “Day at the Races” scheduled for August 7. SIBA members have asked for a fun event during the summer months, and here it is! There will be live racing, and we have reserved The Sky Lounge for SIBA members at Ellis Park. This is another great opportunity for networking with SIBA members. For $30 per person, our members get entrance into the Park, reserved seating in the Clubhouse, lunch buffet, and of course - a racing form! I am already looking forward to seeing everyone there. To make your reservation, please call Jamie at the SIBA office 479-6026.

Perspective

Thank a SIBA Associate Member for

all they do!!

The recent ruling by the US Supreme Court to uphold the subsidies for the Affordable Care Act might have some scratching their heads. It never seemed like a good idea, when insurance companies frowned on the law to require everyone to buy their product. Can you imagine the builders’ delight in a law requiring Americans to build a new house? In the end, many were misled to support it, and are now facing what they feared all along – unaffordable health care coverage.

This court decision is likely to bring forward full implementation of the ACA, sooner than later. And that’s actually good news for SIBA’s

health insurance program. As more and more Americans are required to have health insurance, and such insurance is less and less affordable, programs like the Indiana Employer Trust makes more and more sense.

I remember when builders were pulling their hair out because general liability insurance was the #1 concern nationwide. SIBA eventually found a solution that worked, and made membership a no-brainer for the professional builders in our market. SIBA was the only organization that got results. Members got improved coverage, better business advice, and tens of thousands in savings.

I hope SIBA members who provide health benefits to employees consider the SIBA fully-insured program with Anthem as a viable option. Most often comments from builders and remodelers is that they are very busy. They have work to do. Enough work to hire someone, but that someone had better be qualified. The days of hiring someone, and hoping they can

be trained to do their job are long gone. But if companies are to grow, they’ll

need to grow their workforce. And means hiring. And if you’re going to hire the best workers available, you’re likely to provide their health insurance to keep them. And now, as the ACA makes its impact on the cost of health insurance, the SIBA program will provide most members with an affordable option. As the full effects of ACA drive up the cost of providing workers with coverage they need, SIBA’s program will look better and better. This benefit adds to the growing list of reasons for builders and remodelers to be member of the Association.

What’s Next for SIBA Members?

Hey there SIBA Members! First I’d like to congratulate each one of you on a highly successful Parade of Homes. Builders AND Associates reported high traffic throughout Parade Homes; and this is exactly what we strive for. Special thanks to all of the 2015 Parade Sponsors. Your support is what makes our Parade one of the BEST in the State. This is a big deal! So, thank you, thank you, thank you.

Parade is behind us; but the fun and fellowship has just begun! The Annual SIBA Golf Outing is on July 6th at Rolling Hills Country Club. This will be my second Golf Outing with SIBA and I cannot wait. I had a blast last year and I know that all of our players did too! If you have not yet

registered your foursome, I will be accepting registrations through July 3rd. Shoot me an email or give me a call and I’d be happy to get you in!

Not a golfer? You can still get involved through sponsorship! Although some sponsorships are sold out; there are still $100 Hole Sponsorships available. If you sponsor a hole you also have the option to work at the hole: play a game with the golfers, give away prizes, hand out snacks and drinks, or just park yourself there and get to know some people! See pages 14 and 15 for the registration and sponsorship forms.

Come August 7th, SIBA Members will be gathering at Ellis Park for a relaxed afternoon of live horse racing, a delicious lunch and a special blanket ceremony just for SIBA! Seats are now available for reservation . Reservations include entry, reserved seat, lunch, racing program and the opportunity to be a part of the SIBA Blanket Ceremony in the Winners Circle! Contact

me to reserve seats for you and your co-workers, family members, customers or potential customers.

As usual, there are other monthly meetings that members can get involved in. I hope you have taken advantage of the monthly “Lunch and Codes” Meetings at the SIBA office. Every 3rd Wednesday, members and city officials come together to discuss the latest building codes and trends, while they enjoy lunch. See page 17 for details on this month’s codes meeting.

The next official membership meeting will not be until September 8th. As you can tell; there are several things to do until then! Please contact me at anytime for more information on any of our SIBA Member Events, volunteer opportunites and networking opportunities. I am here to connect you with those that will help make yor business stronger!

In a victory for consumers, builders, lenders and other industry stakeholders, the Consumer Financial Protection Bureau (CFPB) has announced that new mortgage lending rules scheduled to take effect on Aug. 1 will be delayed until Oct. 1.

CFPB Director Richard Cordray said the delay will “better accommodate the interests of the many consumers and providers whose families will be busy with the transition to the new school year at that time.”

On Oct. 1, the Good Faith Estimate, the Truth in Lending and HUD-1 Settlement Statements will be replaced by the CPBP’s new integrated disclosure forms, the “Loan Estimate” and the “Closing Disclosure.”

The biggest change is that the Closing Disclosure must be provided to the consumer a full three days prior to closing, and if there are certain changes during that 72-hour period, the closing could be delayed.

Learn more about the new rules and view NAHB resources to help you comply. For more informat ion, emai l Steve Linvi l le a t NAHB or cal l h im at 800-368-5242 x8597.

Officials recently re-announced Doug Ohning is the Engineering Services Coordinator for the Evansville Water and Sewer Utility. SIBA has been working with Utility officials on several different issues, including the turn-around time for approving project proposals. Doug was hired as a

result of those discussions.

The Water and Sewer Utility is making every effort to improve the timeline for approvals for improvements to the water and sewer systems. And recently, Utility officials made it a clear point to announce that Doug Ohning is primary contact person for approvals. That means if contractors or their engineers are trying to get updates on approvals, they need to contact Doug

A recent Indiana Court of Appeals decision addressed the actions of a homeowners association against a member regarding a covenant violation.

In Bixeman v. Hunter’s Run Homeowners Association of St. John, Inc., a homeowner was alleged to have violated provisions contained in the association’s covenants. The association gave the homeowner seven days’ notice of a hearing on the violations, however, the homeowners were out of town and unable to return for the hearing. The association proceeded to impose

a financial sanction, which the homeowner did not pay, leading to the association recording a lien against the homeowner’s property.

The Court of Appeals held that the sanction was invalid because the association did not give the homeowners proper notice of the hearing as required in its covenants. Additionally, the Court found the association committed slander of title for failing to release an invalid lien.

This case highlights the n e c e s s i t y o f h o m e o w n e r associations strictly complying with the provisions of its covenants and applicable law. Failing to do so may result in a Court invalidating the association’s actions, as well as imposing damages against the association.

Interpreting and enforcing association covenants can be complicated. It is important

to closely review covenants and chart a course of action in strict compliance with those covenants, or risk invalidation and potential financial exposure.

On June 6th; Logan Lavelle Hunt Account Executive Laurie Dobbins was named the Leukemia & Lymphoma Society’s “Woman of the Year” at the Man and Woman of the Year Grand Finale at the African American Heritage Museum. Logan Lavelle Hunt is extremely proud of Laurie and her accomplishments and work with the Leukemia & Lymphoma Society (LLS).

“When Laurie first approached us and we saw how committed she was to the goal, we jumped (at the chance to sponsor her). I personally love to see the enthusiasm and dedication to the goal. We always encourage our young people to be involved and committed to building a great community,” commented Stan Logan, Jr. owner of Logan Lavelle Hunt. Laurie’s story begins eight years ago when she was diagnosed with Thyroid cancer. Although the news for devastating to her as it would be to most, to her it was not debilitating. She was scared but her survival mode and mentality took over. After surgery, hormone therapy, and radiation, Laurie is happy to report that she is 8 years cancer free.

“During that time, I had to continue to remind myself that, no matter what happened, whether the cancer grew to a worse stage or went away, I would still be the same Laurie on the inside, with the same lively personality, hopes, and dreams,” she stated. And so became her mantra and her mark on social media #alwaysbeme. Last year Laurie was approached by the LLS for a 10 week fundraising challenge. The organization chose 13 local individuals to compete. The challenge dates were March 24th to May 30th of this year. KY is the #1 Cancer prevalent state (per capita) in the US; the local LLS chapter is now serving 4,456 patients in KY, and has given just over $1,000,000 to patients and their families locally. Given those stats and Laurie’s own connection with fighting cancer she knew it was a challenge she was meant to except, and surpass.

to date, Laurie has raised just shy of $50,000, hoping to meet that goal by the time all the funds are officially due in.

“If I hit my goal of $50,000 I get to choose the LLS-funded researcher to honor my efforts to help people with blood cancers,” she stated. “And that is a really important part to me.”

Laurie would like to thank all her supporters especially her close family and friends that gave so much time and treasure. “Everyone really played a role. They weren’t afraid to ask for donations. Team work really paid off in my case,” she added.

An employee of Logan Lavelle Hunt since only last December, Laurie also saw this challenge as a way to really let her new clients know where she was and what she was all about.

“It was really great timing. I was starting a new chapter in my life with my career at Logan Lavelle Hunt and they have been so supportive of me,” she commented. “Such a great way to really let my current and prospective clients know where I was now and what was going on in my life.”

about the Leukemia & Lymphoma society's (LLs) "man & Woman of the year": Each year, in communities across the country, passionate candidates engage in an exciting competition

to earn The Leukemia & Lymphoma Society's (LLS) "Man & Woman of the Year" titles by raising funds for LLS blood cancer research. The candidates compete in honor of children who are local blood cancer

survivors, the Boy & Girl of the Year.Every dollar counts as one vote and the titles are awarded to the man and woman with the most votes at

the end of ten weeks. The top local fundraisers in the country win the national titles. To date, these dedicated leaders have helped LLS invest more than $1 billion in research to advance breakthrough therapies that are saving lives today and helping us all achieve the LLS goal of a world without blood cancers.
