STATE LAW

Government Code Section 65852.2 (Second Unit Law): Local ordinances must encourage the creation of ADUs and shall not be arbitrary, excessive, or burdensome so as to unreasonably restrict the ability of homeowners to build ADUs.

Program H-12: Revise development standards for ADUs to facilitate the development of more ADUs, including allowing units to be built over detached garages, increase maximum size, allow parking in setbacks, and reduce setbacks.
