The course covered a variety of matters in relation to the PCT such as preliminary examination reports, possibilities of amending the specification and claims during the international phase, in addition to international treaties governing patents.

AGIP Participates in LESI Winter Planning Meeting 2019

AGIP India Defeats Patent Pre-grant Opposition for Anti-cancer Compound

MIAMI, FLORIDA – Abu-Ghazaleh Intellectual Property (AGIP) participated in the LESI Winter Planning Meeting that was held in Miami, Florida, from January 25 - 27, 2019. Mr. Nabil Salamé, Vice-president Marketing and Executive Director, represented the President of the LES Arab Countries, H.E. Dr. Talal Abu-Ghazaleh in this event, and participated in his capacity as LES-AC Vice President International and International Delegate.

The meeting was attended by the LESI Board and Committee Leaders, LES National Society Presidents and LESI Past Presidents.

The Winter Planning Meeting started with a seminar on global IP issues such as licensing and enforcement of patents and trade marks. The morning sessions and panels focused on two subjects: leadership and building successful membership organizations in challenging times. This year, distinguished external speakers were invited to

participate and share their own perspective on these topics. Among the speakers was Mr. Antonio Campinos, the President of the European Patent Office (EPO).

The event included a summary of Mr. Francois Painchaud’s Presidential year so far and his upcoming plans for the LESI Annual meeting in Yokohama. Ms. Fiona Nicolson, LESI President Elect, announced the plans for her year as President which will start next May in Yokohama.

NEW DELHI - While defending its client Seattle Genetics, Inc., our patent team in India office has succeeded in defeating a patent pre-grant opposition, which was filed by an Indian Pharmaceutical Alliance for anti-cancer compound.

“These are exciting times for India as its IP landscape is evolving. Sometimes the oppositions are filed just to delay the prosecution. Each opposition has to be handled with a different outlook. Using our patent resources worldwide, we always tailor a strategy to

customize our clients’ needs”, said Mr. Rohit Singh, Head of Patents Department in India office, who had represented the client before the Indian Patent Office.

In India, an opposition can be filed before or after the grant of a patent. Any person can file a pre-grant opposition, however, only a person involved in similar business as that of the applicant can file a post-grant opposition.

Significant Amendments to Spanish Trademark Law

Online Trademark Filing is Underway in Pakistan

MADRID – Spain issued the Royal Decree No. 21 of December 2018, which will modify some articles of the Trademark Law 17/2001 of December 7. The Decree has come into force in Spain on January 14, 2019.

The modifications came to homogenize the Spanish system of trademark registration managed by the Spanish Patent and Trademark Office (OEPM) with the trademark registration system of the European Union managed by the European Intellectual Property Office EUIPO.

The most significant amendments that will change the current trademark law in Spain are summarized as follows:1. In case of opposition, the trademark applicant may require

the opponent to provide proof of use of its trademark for the last five years, provided that the opposing trademark has been granted before January 2014.

2. In relation to the distinctive sign, representation will only be required, without further ado, in the Register of Marks without specifying the means used, but in a way that allows the authorities and the general public to determine the object of the protection.

3. The protection of appellations of origin and geographical indications is reinforced through the systematization of absolute prohibitions.

4. The new regulations will offer users agile administrative procedures for the declaration of nullity and expiration of registered trademarks.

The entry into force of the new regulations will be in two steps. The first phase entered into force on January 14, 2019 and the second phase will do so on January 14, 2023.

For more information in this regard, please contact AGIP Europe office at: [email protected]

KARACHI – As Pakistan has seen increasing applications for trademark registration in recent years, the Intellectual Property Organization of Pakistan (IPO) has developed a new web portal with high efficiency and transparency to file online applications for registration of trademark.

National companies and inventors seeking trademark protection in Pakistan will be able to file their trademark applications electronically, whereas foreign companies and inventors can file through their authorized representatives in Pakistan online by providing Power of attorney as usual, where they will gain strong enforcement and full protection for their IPRs.

The new system will initially cover the filing, and will be later extended for other trademark services.

The Trademark Office of Pakistan follows the 10th edition of the Nice Classification, and registration of trademarks are acceptable in classes 1 – 34 in respect of goods and classes 35 to 45 in respect of services. The Trademark Office of Pakistan accepts only single class applications.
