PRE-APPLICATION PUBLIC PARTICIPATION PROCESS: UNAUTHORISED CLEARING OF NATURAL VEGETATION FOR CULTIVATION PURPOSES ON REMAINDER OF

PORTION 70 OF FARM BRANDWAGT NO 187, WORCESTER This letter serves to notify you of the unlawful commencement of listed activities in terms of the National Environmental Management Act, 1998 (Act No. 107 of 1998), as amended. This Section 24G Rectification Process will be conducted in terms of the National Environmental Management Act, 1998 (Act No. 107 of 1998) (NEMA), as amended, the Environmental Impact Assessment Regulations 2014, as amended and the Section 24G Fine Regulations, 2017. Enclosed, please find one hard copy of the Pre-Application Section 24G Report for the above-mentioned proposal, for your comment. The commenting period is from 18 July to 19 August 2019. Applicant: Babirwa Breeding (Pty) Ltd [Postal Address: PO Box 3990, Rivonia, 2128] Proposal and Location: The property is Farm Brandwagt located in Brandwacht, Worcester. The applicant embarked upon a ploughing programme where his intention was to clear the majority of the proposed site for the establishment of vineyards and orchards in order to expand the existing agricultural crops on the farm. The applicant commenced with this programme and cleared a 39ha portion of his property for the establishment of 33.21ha of table grapes. The initial clearing activities commenced in 2016 (approximately 24ha), followed by an additional clearing of 15ha in 2017. This area was then planted in 2017 and in 2018, shade netting was erected over some of the crops. The intention, should it be approved, is to complete the ploughing programme and cultivate an additional 18.85 ha of which 11.85ha will require the clearing of natural vegetation and to construct a low-water bridge crossing the Waterkloof River on the property. Application for Environmental Authorisation, to undertake the following activities in terms of the National Environmental Management, 1998 (Act 107 of 1998) as amended and the EIA Regulations 2014, as amended: LN 1 (GN No. 327) – 12, 19; LN 2 (GN No. 325) – 15; LN 3 (GN No. R 324) – 4 . The procedures for a Section 24G Rectification Process will be followed since some of the activities have commenced illegally and the applicant wishes to apply for ex post facto approval. Application for a Water Use License: A Water Use License Application (WULA) will be submitted to the Department of Water & Sanitation in terms of the National Water Act (Act 36 of 1998) (NWA). The following water use activities may trigger relevant sections of the NWA: taking water from a watercourse (Section 21a); impeding or diverting the flow of
