INTRODUCTION This report presents the results of a Phase II Environmental Site Assessment Phase II ESA and Site Soil Characterization (Phase II ESA/SSC) investigation for the KIPP Heritage Middle School (Heritage MS). The Heritage MS will be operated by KIPP Bay Area Schools as a charter school. The Phase II ESA/SSC investigation was performed by Milani & Associates under contract to KIPP Bay Area Schools. Figures and Tables referenced in the report are included in the separate tabbed “Tables” and “Figures” sections of the report. Geotechnical information and other project background information pertaining to the project are included in Appendix A. Copies of certified analytical reports for environmental soil analyses and asbestos and lead bulk sample analyses are included in Appendix B.
CURRENT SITE DESCRIPTION AND USAGE SUMMARY The Heritage MS site consists of an approximate 1.5 acre rectangular-shaped land parcel situated in the northwest corner of the existing Los Arboles Elementary School. The Los Arboles ES is owned and operated by the Franklin-McKinley School District. The land parcel is part of larger parcel identified as Assessor Parcel Number 494-02-001 (Parcel One). The middle school and elementary school are co-located at 455 Los Arboles Street in San Jose California. The approximate lease boundary limits of the Heritage MS site are shown in relation to the adjacent Los Arboles Elementary School and the immediate surrounding vicinity on the Vicinity Map, Figure 1. The Heritage MS will be operated by KIPP Bay Area Schools as a charter school, but will be part of the Franklin-McKinley School District. The Heritage MS site is situated in a predominantly urban setting dominated by single-family residences, an elementary school and city-owned facilities. The site is bounded to the north and east by existing streets and residential development, to the south by the existing Los Arboles Elementary

School (including an existing solar panel array) and to the west by the Seven Trees Community Center and Library. The community center is owned by the city of San Jose. The site is currently being utilized to support school related sports activities, and includes a baseball field with backstop with player dug-outs and turf field. The above site elements are identified on the Site Plan, Figure 2. Based on a site plan provided by the project architect, Artik Art and Architecture1, the Heritage MS facility will consist of seven (7) single story buildings with an approximate 29,500 square foot aggregate building footprint. Building utilization by function is summarized as follows:
Classroom Buildings – Four separate classroom buildings. Each classroom building has four classrooms with a 3,300 sf building footprint.
Science Building – The Science Building will have four science classrooms with an approximate 4,000 sf building footprint.
Administration/Custodial Building – This building will be utilized for administration and custodial functions. The building has an approximate 3,525 sf building footprint including two student restrooms.
Multi-Purpose Room/Music Room/Gym Building – This building will include a multi-purpose room, gym and music room. The building will also include space for storage, food service and restrooms. The building has an approximate 6,925 sf building footprint.
The approximate building footprints are identified on the Site Plan, Figure 2. The new school buildings are anticipated to be founded on shallow spread footings or conventional slab-on-grade foundations. Underground utilities and other services are anticipated to be installed using conventional trench construction. Foundation and underground utility construction are anticipated to generate excess soil that may require offsite disposal where the excess soil cannot be reused onsite.
SITE TOPOGRAPHY AND SURFACE HYDROLOGY
A topographic survey of the site was performed by Red Plains Surveying Company2. Based on the topographic map, the site is relatively level with an elevation approximately 157 feet above sea level. The general surface gradient and/or slope in the vicinity of the property is to the north. The site and vicinity have been modified by grading and construction for the existing site improvements and the adjacent street improvements. Surface water flow is controlled by the existing interior grading and pavement systems. Storm water is primarily controlled by existing surface topography and storm water collection devices (grass swales, catch basins and area drains). Surface drainage from the existing Heritage site is by overland flow to the north perimeter of the site. No catch basins or interior drainage collection devices were observed or identified during the Phase II ESA/SSC investigation within the planned KIPP Heritage MS site.

SUMMARY OF PREVIOUS INVESTIGATIONS A previous Phase I Environmental Site Assessment (Phase I ESA) was conducted for the KIPP Heritage MS site. The Phase I ESA was conducted by Millennium Consulting Associates. The results of the Phase I ESA were presented in a report dated April 22, 20163. Two recognized environmental concerns (RECs)4 were identified in the final Phase I ESA Report. The two RECs are identified as follows:
REC #1 – Historical Agricultural Usage: The site and vicinity were identified as having been under previous agricultural use. Due to this prior usage, the site may contain residual levels of historical pesticides, herbicides and rodenticides. Residual levels of petroleum hydrocarbons may also be present since petroleum hydrocarbons were used as carrier solvents for the pesticides and herbicides.
REC #2 – Naturally Occurring Asbestos: The site is located in close proximity to a mapped Geologic Ultramafic Rock Unit (GURU). GURUs are known to contain serpentine which is mineral group classified as containing naturally occurring asbestos (NOA). The California Department of Toxic Substances Control (DTSC) requires soil sampling for NOA at school sites that are located within 10 miles of a mapped GURU5.
Based on the two identified RECs, Millennium recommended that a limited Phase II ESA be performed within the limits of the KIPP Heritage MS site. Millennium also identified two environmental conditions that do not meet the definition of a Recognized Environmental Concern, but could impact the demolition of the existing baseball backstop structure:
A suspect ACM roofing fabric that has been mechanically attached to the center portion of the wood panels on the baseball backstop was identified. Millennium recommended that the material be sampled and tested for asbestos.
The green paint coating system on the wooden backstop components was observed to be in poor condition. The paint had delaminated from the wood substrate (loose and flaky) in areas where the paint was in poor condition. Millennium recommended that the paint coating system be sampled for asbestos and for lead for initial waste characterization purposes.
Millennium recommended that the asbestos and lead sampling be coordinated with the Phase II ESA.

PHASE II ESA AND SITE SOIL CHARACTERIZATION SUMMARY
OBJECTIVE AND SCOPE The primary objectives of the Phase II ESA/SSC investigation were identified as follows:
Determine through soil sampling and analytical testing if shallow site soils contain residual concentrations of historical pesticides, herbicides, rodenticides, heavy metals, and petroleum hydrocarbon solvents at concentrations that would require more detailed investigation or remedial action,
Determine through soil sampling and analytical testing if the near surface site soils contain naturally occurring asbestos,
Determine through bulk sample collection and testing if demolition of the backstop structure will require abatement of asbestos containing materials or if the generated demolition waste streams would special handling and disposal due to lead.
Conduct soil sampling and analytical testing to develop an initial waste profile for disposal acceptance at a permitted Class II/III landfill or to enable brokering the excess soil generated from site development for reuse at other privately-owned offsite locations prior to the start site work.
Existing regulatory limits would be used to determine if more detailed investigation or remediation may be necessary6. The waste profiling would enable the contractor to directly excavate, load and transport the excavated soil to the selected landfill or offsite location and minimize the need for stockpiling of excess excavated soil. The scope of the Phase II ESA/SSC investigation was determined based on the maximum anticipated depths of excavation for foundation and underground utility construction for the planned building improvements. For underground utility construction, site grading and building foundation construction, this was estimated to include cuts and excavations up to about eight (8) feet below existing site grade. SITE SOIL CHARACTERIZATION PROGRAM Methodology The site soil characterization investigation included the following program elements:
Collection of shallow soil samples (0 – 8 feet bgs) during the geotechnical investigation conducted by Rockridge Geotechnical for the KIPP Heritage MS site.

Milani & Associates preformed co-sampling with Rockridge Geotechnical field personnel during the geotechnical investigation. Boring Layout and Utility Clearance Geotechnical Investigation Co-Sampling - The co-sampling performed as part of the Rockridge Geotechnical investigation was conducted on Monday, March 28, 2016. Boring layout and utility clearance was conducted by Rockridge Geotechnical. The co-sampling was performed at Borings B-1, B-2, B-3 and B-4. The soil boring locations are shown on Figure 2, Site and Sample Location Plan. Field Sampling Summary Following completion of underground utility mark-out and clearance of the soil boring locations, Milani & Associates conducted the site soil characterization. The field work included the following:
Surface Treatment Coring – All borings were located within existing grass turf or exposed soil within the baseball diamond area. No surface treatment coring was required.
Geotechnical Co-Sampling – Milani & Associates collected representative soil samples from Borings B-1, B-2, B-3, and B-4. Borings were completed to the following depths:
Boring B-1 – Boring was completed to a total depth 30.5 feet below ground surface (bgs). No free groundwater was encountered.
Boring B-2 – Boring was completed to a total depth 30.5 feet bgs. No free groundwater was encountered.
Boring B-3 – Boring was completed to a total depth 35.5 feet bgs. No free groundwater was encountered.
Boring B-4 – Boring was completed to a total depth 40.5 feet bgs. No free groundwater was encountered.
All borings were drilled using a truck mounted drill rig equipped with a hollow stem auger drilling system. Milani & Associates performed co-sampling of soils between depths of 0.5 feet and 8 feet bgs at each soil boring. Three shallow soil samples were retained from each boring for environmental testing. Additional soil sampling was performed by Rockridge Geotechnical at depths deeper than 8 feet bgs for geotechnical purposes. Copies of the soil boring logs are included in Appendix A.
Twelve (12) discreet soil samples were collected from the four soil borings that were co-sampled by Milani & Associates. The soil samples collected are identified in Table 1 by boring location and sample depth. All samples were recorded onto a Chain-of-Custody, and were prepared for shipment to McCampbell Analytical, Inc (MAI) for environmental analytical testing.

Analytical Testing Program Summary The soil samples were analyzed as identified in Table 1 and summarized as follows: Shallow Soils – Twelve (12) discreet soil samples were collected from the shallow soil zone (0 - 8 feet bgs), and were transported by Milani & Associates under chain of custody to MAI in Berkeley, CA. MAI is accredited by the California Department of Health Services Environmental Laboratory Accreditation Program for analysis by various EPA Methods including the following EPA Methods: 8015, 8260, 8081, 8141, 8151, 8270, 6020. For environmental testing, the shallow soil zone was broken into three (3) shallow soil zone horizons. The shallow zone soil horizons were defined as follows:
Zone 1: 0 – 2.5 feet bgs
Zone 2: 2.5 – 5 feet bgs and
Zone 3: 5 – 7.5 feet, bgs. The soil samples from the three shallow soil zones were analyzed as discrete samples for the following constituents:
Arsenic - Total by EPA Method 6020 The soil samples from the shallow soil zones Zone 1 and Zone 2 were analyzed as both composite samples (4:1 composite maximum). The 4:1 composite sample from Zone 1 and Zone 2 was analyzed for the following constituents:
Total Volatile Petroleum Hydrocarbons (Gasoline Range [TPHg]) by EPA Method 8015B,
Total Extractable Petroleum Hydrocarbons (Diesel and Motor Oil Range [TPHd and TPHmo]) by EPA Method 8015B,

Soluble metal testing was performed where the measured total metal concentrations (chromium) exceeded 10 x STLC or 20 x TCLP7. The 4:1 composite sample from Zone 3 was analyzed only for heavy metals (TTLC only).

A split sample from the composite sample for each soil zone was prepared by MAI. The split samples were transported by Milani & Associates to EMSL Analytical, Inc. (EMSL) under chain of custody for NOA analysis by CARB Method 435 (1,000-point count). EMSL is accredited by the National Institute of Standards and Technology’s National Voluntary Laboratory Accreditation Program (NVLAP) for the analysis of asbestos in bulk samples by EPA Method 600/M4-82-020 and by CARB 435. All analyses were performed at standard turnaround times (TAT - 5 days). Copies of the certified analytical reports are included in Appendix B. Details of sample analyses performed on the shallow soil samples by soil zone are presented in Table 1. The results of the TPHg, TPHd, TPHmo, VOCs are presented in Table 2. The results of the SVOC, Chlorinated Pesticides, Organophosphorus Pesticides and Chlorinated Herbicides are presented in Table 3. The results of total and soluble heavy metal analyses are presented in Table 4. The NOA results are presented in Table 5. The discrete laboratory analytical results and the calculated 90 percent confidence interval (90% CI) for arsenic are included in Table 8. All soil analyses were performed using Level II Quality Assurance/Quality Control (QA/QC) protocols. All analyses were performed at standard turnaround times (5 days). Copies of the certified analytical reports are included in Appendix B. Quality Assurance, Quality Control and Data Evaluation All soil analyses were performed by a State-certified analytical laboratory. The asbestos analyses were performed by an NVLAP-certified laboratory. All samples submitted for chemical analyses were received cold and intact. All QA/QC samples were generally found to be within the laboratory’s control limits. Where data qualifiers were identified in an analytical report, the data qualifiers were determined not to be significant. WASTE CHARACTERIZATION PROGRAM Methodology The waste characterization investigation included the following program elements:
Collection of bulk samples of the roofing fabric and paint coating systems from the baseball backstop for asbestos.
Collection of bulk samples of the paint coating systems from the baseball backstop for lead
The sampling was performed to determine if the roofing fabric backstop covering and painted wood backstop material would require special handling and disposal as part of demolition of the structure.

Field Sampling and Analytical Testing Summary The field work included the following:
Asbestos Bulk Sampling – Milani & Associates performed the asbestos bulk sample collection of the roofing fabric and paint coating system at the baseball backstop concurrently with geotechnical investigation co-sampling. Three (3) suspect ACM bulk samples were collected from baseball backstop. Two (2) samples were collected from the suspect roofing fabric covering that was mechanically attached to the surface of the wood baseball backstop. One bulk sample of the paint coating system on the painted wood baseball backstop was also collected. Bulk sampling for asbestos was conducted in accordance with modified procedures outlined in the Asbestos Hazard Emergency Response Act (40 CFR 763.86, Sampling).
Lead Bulk Sampling - Milani and Associates performed bulk sample collection of the paint coating system(s) in accordance with industry standards in existence the time of the project.
Bulk sampling activities were performed by Mr. Mark Milani, Cal/OSHA Certified Asbestos Consultant 08-4469 and CDPH Certified Lead Sampling Technician #21323. The bulk sample locations are shown on Figure 2, Site and Sample Location Plan. The asbestos and lead bulk samples were sealed in uniquely labeled bags, and were shipped by Milani & Associates under chain-of-custody procedures to EMSL Analytical Laboratories (EMSL) located in San Leandro, CA. EMSL is accredited by the National Institute of Standards and Technology’s National Voluntary Laboratory Accreditation Program (NVLAP) for the analysis of asbestos in bulk samples by EPA Method 600/M4-82-020. Asbestos analyses included analysis by standard PLM. EMSL is also accredited by the California Department of Health Services Environmental Laboratory Accreditation Program for lead analysis by various EPA Methods including EPA Methods SW846 3050B and 7000B. The results of the asbestos and lead paint analyses are tabulated in Tables 6 and 7, respectively. Quality Assurance, Quality Control and Data Evaluation The lead analyses were performed by a state-certified certified analytical laboratory. The asbestos analyses were performed by an NVLAP-certified laboratory. PHASE II ESA AND SITE SOIL CHARATERIZATION FINDINGS The following findings were developed based on review of the laboratory analytical results obtained as part of the site soil characterization: Waste Characterization – Baseball Backstop
The roofing fabric material was found not to contain asbestos.
Paint coating system was found not to contain asbestos

The paint coating system was found to contain lead at a concentration less than 100 mg/kg. This is below 1,000 mg/kg Total Threshold Limit Concentration for a classification as a California Regulated Hazardous Waste.
Environmental Site Soil Characterization - Shallow Soils
No visible staining or distressed vegetation was observed at the ground surface within the planned KIPP Heritage MS limits that would indicate spills of a corrosive material (e.g. low pH or high pH).
No visible staining was observed in the shallow soil samples collected from the three shallow depth zones (Zone 1, Zone 2 and Zone 3) in all four soil borings.
No olfactory odors were noted in the shallow soil samples collected from the three shallow depth zones in all four soil borings.
The shallow soils were observed to be primarily clay soils. The soils were generally brown in color, and were medium stiff to stiff. No free groundwater or perched groundwater was encountered within the shallow zone soils (0 to 7.5 feet bgs) or to the full depth explored at each soil boring (maximum depth 40.5 feet bgs). Copies of the soil boring logs are included in Appendix B.
No petroleum hydrocarbons characterized as gasoline (TPHg), diesel (TPHd) and motor oil (TPHmo) were detected above the specific analyte method detection limits (MDL) in the shallow Zone 1 or Zone 2 composite soil samples. The analyte MDLs are below the applicable RWQCB ESLs. No DTSC CHSSLs have been established for gasoline, diesel or motor oil.
No volatile organic compounds (VOCs) were detected above the specific analyte detection limits in the shallow Zone 1 or Zone 2 composite soil samples. The analyte MDLs are below the applicable RWQCB residential ESLs and DTSC residential CHSSLs for the reported VOCs.
No semi-volatile organic compounds (SVOCs) were detected above the specific analyte detection limits in the shallow Zone 1 or Zone 2 composite soil samples. The analyte MDLs are below the applicable RWQCB residential ESLs and DTSC residential CHSSLs for these compounds.
No PCBs were detected above the specific analyte detection limits in the shallow Zone 1 or Zone 2 soil samples. The analyte MDLs are below the applicable RWQCB ESLs and DTSC CHSSLs for these compounds.
With the exception of DDE, Organochlorine Pesticides (OCPs) were not detected above the specific analyte MDLs in the shallow Zone 1 or Zone 2 composite soil samples. The detected DDE concentration in the Zone 1 (0.0052 mg/Kg) and Zone 2 (0.00082 mg/Kg) composite samples were below the applicable RWQCB residential ESL (1.7 mg/Kg) and the DTSC residential CHHSL (1.6 mg/Kg) for DDE. In addition, the MDLs for the other OCPs are below the applicable RWQCB ESLs and DTSC CHSSLs for these compounds

Organophosphorus Pesticides were not detected above the specific analyte MDLs in the soil composite samples analyzed. No applicable RWQCB ESLs or DTSC CHHSLs have been established for these compounds.
Organochlorine Herbicides were not detected above the specific analyte MDLs in the soil composite samples analyzed. The analyte MDLs are below the applicable RWQCB ESLs and DTSC CHHSLs for these compounds.
Heavy metal concentrations in the discreet and composite soil samples from Zone 1, Zone 2 and Zone 3 did not exceed applicable Total Threshold Limit Concentrations (TTLC) for all heavy metal analytes.
Arsenic was detected at concentrations ranging from 9.2 mg/Kg up to 14 mg/Kg in both discreet and composite soil samples. The measured concentrations are above the established DTSC residential CHHSL for arsenic (0.067 mg/Kg). The detected arsenic concentration was also above the applicable RWQCB residential ESL concentration of 0.39 mg/Kg. Using statistical analytical procedures identified in EPA 846, the 90% confidence interval (CI) was determined for the following zones:
Zone 1 (0 – 2.5 ft bgs): 12.0 mg/kg
Zone 2 (2.5 – 5 ft bgs): 11.8
Zone 3 (5 – 8 ft bgs): 12.8 mg/kg
Zones 1, 2, 3 combined: 11.4 mg/kg The analytical data and statistical analytical results are presented in Table 8 (a-d). The 90% CI concentrations are below the DTSC school action level of 12 mg/kg for arsenic for Zone 1, Zone 2 and the combined Zones 1, 2 and 3. The 90% CI concentration of 12.8 mg/Kg for Zone 3 was slightly above the 12 mg/kg DTSC school action level.
Chromium was detected at or above 50 mg/kg in all shallow composite soil samples from Zone 1, Zone 2 and Zone 3 analyzed (See Table 4). The measured total chromium concentration in the composite soil samples were above the 10 X STLC (50) baseline used to determine if there is the potential to exceed the Soluble Threshold Limit Concentration (STLC) for a California regulated hazardous waste. The soil samples exhibiting the two highest total chrome concentrations (Zone 1 and Zone 2) were submitted for soluble chromium analysis using the California Waste Extraction Test (WET) method. The soluble chromium concentrations were below the STLC limit of 5.0 mg/L in composite soil samples tested from Zone 1 and Zone 2.
Naturally occurring asbestos (NOA) analysis was performed on all three soil zones. The results are summarized by zone below:
Zone 1 (0 – 2.5 ft bgs): No NOA detected
Zone 2 (2.5 – 5 ft bgs): No NOA detected
Zone 3 (5 – 8 ft bgs): NOA detected at less than 0.1% (<0.1%)

The detected concentration of asbestos is below the DTSC screening limit of 0.25%. However, soils containing asbestos at concentrations greater than 0% are regulated under CAL/OSHA.
Conclusions and recommendations developed from the above findings are presented below. CONCLUSIONS AND RECOMMENDATIONS Based on the findings, Milani & Associates has developed the following conclusions and recommendations for the asphalt concrete and foundation soil demolition waste streams: Baseball Backstop Demolition
The roofing fabric used to cover portions of the wood baseball backstop was found not to contain asbestos. The material can be handled and disposed/recycled as construction debris
The paint coating system on the wood baseball backstop was found not to contain asbestos or lead at concentration that would require special handling and disposal for the painted wood component. Prior to demolition, loose and flaky paint should be removed. Because the paint contains lead, the removal of the loose and flaky paint should be performed in conformance with Cal/OSHA lead in construction regulations8. Following removal of the loose and flaky paint, the paint wood can be handled and disposed/recycled as construction debris.
The loose and flaky paint residue should be tested for soluble lead to determine appropriate handling and disposal. If the soluble lead is greater than 5.0 mg/L Soluble Threshold Limit Concentration (STLC), the loose and flaky paint residue should be handled and disposed as a California Regulated Hazardous Waste – Lead (Waste Code 181 – Other inorganic solid waste). Additional testing to determine if the waste is a RCRA or Non-RCRA waste should be performed using the federal Toxic Characteristic Leaching Procedure (TCLP). Hazardous waste will need to be managed in conformance with California and federal regulations9.
Site Soil Characterization
The shallow soils anticipated to be excavated for grading and foundation construction for the KIPP Heritage MS Complex were found not to exhibit a toxic, reactive, ignitable or corrosive characteristic of a hazardous waste. Reactive, ignitable and corrosive characteristics were determined based on generator knowledge and visual observations. Toxic characteristics were determined based on laboratory testing. Consequently, excavated soils that are not reused onsite, and will be transported offsite for disposal or reuse do not need to be handled or disposed as a hazardous waste.

Arsenic levels in all samples exceeded both Cal EPA CHHSLS and RWQCB ESL. However, the detected concentration levels are considered to be at background concentration limits since the average arsenic concentrations for each soil zone were within 10 percent of each other.
Excess soils generated from site grading, foundation construction and underground utility construction to be appear to be acceptable for disposal to permitted Class II/III landfill.
Soils that will become disturbed by foundation construction or underground utility trenching below 5 feet bgs are anticipated to contain naturally occurring asbestos (NOA). The civil drawings and/or project specifications should incorporate the following:
Specific note on the civil demolition and utility drawings or section under the Special Conditions section of the project specifications stating that soils excavated below depths of 5 feet contain NOA. The excavated soils should be kept wet during excavation and be handled, packaged and disposed in conformance with applicable work practices requirements under the CAL/OSHA 1529(g)(1)(2) & (3) and 1529(l)(2).
Specific note on the civil demolition and utility drawings or section under the Special Conditions section of the project specifications stating that soil excavated below depths of 5 feet contain NOA. Contractors involved in excavation, handling or disposal of NOA containing soil shall have demonstrated asbestos awareness training that conforms with the specific training requirement under CAL/OSHA 1529(k)(9)(G) and CAL/OSHA 1529 (k)(9)(H) or equivalent training under the contractor’s Hazard Communication Program.
A copy of this report should be incorporated into the project bid documents so that contractors can contact preferred landfill sites and use the analytical data presented in this report to initiate the waste profiling and acceptance process. This will also enable the contractor to determine if additional waste characterization will need to be performed in order to obtain disposal acceptance.
Where excess excavated soils will be transported for reuse as fill at an offsite location that is not a permitted landfill, additional characterization may be required by the offsite location for acceptance. Excavated soil should not be allowed to be transported to an offsite location (landfill for disposal or offsite location for reuse) until written acceptance has been received and confirmed.
