As of this writing, our organization has already accomplished many things of which we can be proud of.
First, I would like to express my sincere gratitude for the outstanding job our committee chairs are doing. Susan Craig rallied 28 agents to sign up for GRI, making it one of the largest GRI classes ever held at our board. Thanks to the efforts of Susan and her committee, our members will not have to travel out of town to be qualified for such an important designation. I know the challenges the Education Committee faced in pulling this class together, and the fact that they never gave up and stayed with this project is the reason for its success.
And for those of you who missed Casino Night, it was an absolute blast and netted over $4500 for TREPAC. We enjoyed the casino games, the wonderful ambience of Forti’s Restaurant, the great food, music and even dancing. Martha Maldonado and her TREPAC Committee sure know how to throw a party. I hope to see even more of you participate in upcoming events. Also, we’ve installed an attractive TREPAC donation box in our lobby for those of you who are too busy to attend our fund-raisers. With all of the challenges REALTORS® face on the political front, your donation is of vital importance to our industry.
Speaking of politics, did you know that our Governmental Affairs Committee has scored its fourth victory in a row? Last year we effectively took on the swimming pool and the year before, the sign ordinance. This year we have already been successful
in overcoming an ordinance that would have mandated city inspections of all rental property heaters. In addition, we were very instrumental in convincing County Commissioners Court to approve the Regency project for the old Farah building. Yoli Chavez has put together a team of REALTORS® that regularly attend community meetings around town and keep us all informed of any issues coming our way. I commend Yoli Chavez for her efficient and well-organized Governmental Affairs Committee.
As expected, we had a terrific turnout for Senator Eliot Shapleigh at our Ambassador Series in February. Our members were full of questions, and we received a wealth of information about past, present and future El Paso. In March, Leon Metz told us all about the Wild West days of our historical city.
As you know, leadership isn’t about one person doing all the work or taking all the credit. Leadership is about an effective organization of people who pull together to achieve a common goal. It’s all about YOU and your commitment to our industry. To each and every one of you who volunteer your time and efforts to the Greater El Paso Association of REALTORS®, I thank you from the bottom of my heart.

I just returned from the RE/MAX International Convention last week where I had the opportunity to talk with many agents from different parts of country. Naturally, I wondered how their markets were doing and if their markets were as bad as the media portrays them to be. It was no surprise to find out everyone (with the possible exception of Texas) was suffering with markets marked by foreclosures and short sales. In many cases, MLS sales were down anywhere from 30% to over 60%.
What made the strongest impression on me was talking to agents from Canada. The Canadian real estate market continues to do extremely well, and I was curious why they seem immune to what American real estate markets are encountering. All three agents I talked to told me the same thing—“Our banks do not make sub-prime mortgage loans.” The Canadian banking system is very strong and fiscally sound. Like all industries, including our own, there are good and bad mortgage lenders.
I require a pre-approval on all my listings, which states what the buyers FICO scores and income are in conformance with the type of financing that is being applied for. And still before closing I receive a letter which denies the loan to the purchaser. In one recent situation, the letter of declination completely contradicted the pre-approval letter they had provided. Has there ever been in recent history one entity (mortgage and banking) responsible for such havoc and ruin in the American economy?
At Education Day last year, I was surprised to hear Ted Jones, economist for Stewart Title, state that 36% of all loans originated in El Paso the previous year were sub-prime loans. I would have
thought the percentage to be much lower. Recent reports show El Paso foreclosures spiking upwards, and I have to wonder how many of those sub-prime loans will become foreclosures in the next one to three years. Are we acting in the best interests of our clients if we do not explore all options for financing and alerting our clients to predatory lending practices? Have we accomplished our duties to our client when their home is foreclosed on at a later date—the consequences of which are more detrimental than not purchasing a home? It is readily apparent the affect foreclosures have on a local real estate market.
As REALTORS®, we have to be accountable to our clients when helping them buy or sell. There are plenty of lenders in our community whose knowledge and truthfulness can be counted upon. We should support those lenders for the betterment of our real estate market.

President Lyndon Johnson urged congressional approval of the Fair Housing Act just one week after the assassination of Dr. Martin Luther King, Jr. He felt it an appropriate tribute to Dr. King’s legacy, and the Fair Housing Act was signed on April 11, 1968.
Since April is Fair Housing month, it only seems appropriate to review exactly what Fair Housing means to us, as well as the rest of the nation.
THE FAIR HOUSING ACT: The Fair Housing Act prohibits discrimination in housing because of race or color, national origin, religion, sex, familial status and handicap.
WHAT HOUSING IS COVERED: The Fair Housing Act covers most housing. In some circumstances, the Act exempts owner-occupied buildings with no more than four units, single-family housing sold or rented without the use of a broker and housing operated by organizations and private clubs that limit occupancy to members.
WHAT IS PROHIBITED: In the sale and rental of housing, no one may take any of the following actions based on the Fair Housing Act: Refuse to rent or sell housing; refuse to negotiate for housing; make housing available; deny a dwelling; set different terms, conditions or privileges for sale or rental of a dwelling; provide different housing services or facilities; falsely deny that housing is
available for inspection, sale or rental; for profit, persuade owners to sell or rent (blockbusting); or deny anyone access to or membership in a facility or service (such as multiple listing service) related to the sale or rental of housing.
IN ADDITION: It is illegal for anyone to threaten, coerce, intimidate or interfere with anyone exercising a fair housing right or assisting others who exercise that right; advertise or make any statement that indicates a limitation or preference based on race, color, national origin, religion, sex, familiar status or handicap (disability). This prohibition against discriminatory advertising applies to single family and owner-occupied housing that is otherwise exempt from the Fair Housing Act. Pick up the fourth edition of the Fair Housing Handbook. This MUST HAVE is an excellent resource for fair housing guidance and includes the following:

Progressionof the Fair Housing
Act The Fair Housing Act was created to provide equal housing opportunities for all persons living in America. Since its establishment in 1968, it has served as a reminder to all REALTORS® that discrimination and the “American Dream” of home ownership cannot coexist. In celebration of Fair Housing Month, let’s observe some of the developments and achievements that have shaped the Fair Housing Act into what it is today. 1968 Enactment of the Fair Housing Act- April 11, 1968. The Fair Housing Act, contained in Title VIII of the Civil Rights Act of 1968, prohibits discrimination in the sale, financing or rental of housing because of race, color, religion, and national origin.1973 Enactment of Section 504 of the Rehabilitation Act of 1973, which prohibits discrimination on the basis of disability in programs and activities conducted by HUD or those receiving financial assistance from HUD.1974 Sex is added as a protected class under the Fair Housing Act.1976 Congress amended the Equal Credit Opportunity Act to prohibit discrimination on the basis of race, color, religion, national origin, age, or receipt of public assistance.1977 Congress enacted the Community Reinvestment Act (“CRA”). This act encourages banks to meet the credit needs of the local communities in which the banks operate. This includes addressing the needs of low-to moderate-income neighborhoods. The CRA responded to the often underdeveloped and inadequate flow of capital funds
into low-income neighborhoods to aid in the fostering of neighborhood development, economic growth, and wealth building.1978 A federal district court in Ohio held, for the first time, that the 1968 Fair Housing Act prohibited insurance red lining.1983 Housing and Urban-Rural Recovery Act of 1983 created the housing voucher program as an alternative to Section 8 rent certificates. These vouchers may afford families wider housing choices.1987 Section 561 of the Housing and Community Development Act of 1987, 42 U.S.C. 3616, established the Fair Housing Initiatives Program (FHIP) to strengthen the Department’s enforcement of the Fair Housing Act and to further fair housing. FHIP funds fair housing organizations and other non-profit groups to provide vital services to their communities. These services include providing education and outreach activities so that community members are aware of their rights. FHIPs also conduct investigatory and enforcement activities, offering an outlet for community members who may have fair housing related complaints. There are approximately 100 fair housing organizations nationwide. In FY 2007, FHIP is funded at $18,100,000.1988 The Fair Housing Amendments Act (FHAA) added disability and familial status (the presence or anticipated presence of children under 18 in a household) to the Fair Housing Act’s list of protected classes. The FHAA made major changes to the enforcement actions under the

Act, giving more authority to the Department of Housing and Urban Development to enforce the fair housing law. The FHAA extended the statute of limitations for federal lawsuits from 180 days to two years and removes a $1,000 cap on punitive damages. The FHAA also opened up new avenues for enforcement of the rights of people with disabilities to live in the housing of their choice. For the first time, private-party transactions, where disability discrimination takes place, were subject to scrutiny in federal court.1990 The Americans with Disabilities Act (ADA) was enacted on July 2, 1990. ADA prohibits private employers, state and local governments, employment agencies and labor unions from discriminating against qualified individuals with disabilities in job application procedures, hiring, firing, advancement, compensation, job training, and other terms, conditions and privileges of employment.1993 Empowerment Zone and Enterprise Community Programs were created under the Federal Omnibus Budget Reconciliation Act of 1993 as a strategy to promote revitalization efforts in economically distressed urban and rural areas.1994 Executive Order 12892, as amended, requires federal agencies to affirmatively further fair housing in their programs and activities, and provides that the Secretary of HUD will be responsible for coordinating this effort. The Executive Order also established the President’s Fair Housing Council, to be chaired by the Secretary of HUD.1995 Housing for Older Persons Act of 1995, 42 U.S.C. § 3607(b)(2)(C), amended the Fair Housing Act to permit a development’s occupancy by at least one person 55 years or older in 80 percent or more of the housing units without the provision of significant
facilities and services specifically designed to meet the physical or social needs of older persons. The provision also allows for a good faith defense in civil money damages when an individual reasonably relies on the “housing for older persons” exemption and has no actual knowledge that the facility is ineligible for the exemption and the facility has not stated formally in writing that the facility complies with the requirements for exemption.1999 Executive Order 13166, Improving Access for Limited English Proficiency (LEPs), requires that federal agencies take reasonable steps to provide meaningful access to federally conducted and assisted programs and activities for limited English proficient individuals. This involves determining language needs and providing appropriate language assistance to LEP individuals.2001 Olmstead Executive Order 13217 was signed by President Bush implementing the Olmstead decision, which provides that the federal government should ensure placement of individuals with disabilities,
