7 - B The Notary Public The Notary Public is a general job title extrapolated from our forbearing Shari’ah from the Quranic Verse 282 of Surah Al Baqarah “ . . . Let a scribe write it down in justice between you . . .” which is translated into the UAE law number (22) for the year (1991) regarding the Notary Public and its amendments. Functions of the Notary Public in Dubai: 1 Notarizing signatures on contracts and instruments; 2 Affirming dates of private instruments; 3 Attesting of marriage documents issued by authorized churches in Dubai; 4 Attesting signatures on the wills of non-Muslims, according to the condition stipulated by the Notary Public Law No. 22/1991 and its amendments. General requirements for all types of attestation: 1 Contracts, instruments and documents must be typed in Arabic; 2 Related persons or their agents or representatives must be present; 3 Original and a copy of UAE identity card must be presented for na- tionals and residents. Original and a copy of proof of identity for non- residents must be presented; Additional requirements for the following types of attestations: First: Articles of Incorporation: Initial approval by the authority regulating the relevant activity. Second: Sale contracts and their annexes: Initial approval for selling and the amendment annexes from the rel- evant authority if the sale requires approval. Originals and copies of the license and a list of partners, if the sale involves the sale of a commercial shop or license. Originals and copies of Articles of Incorporation and original annexes, if the sale involves selling company shares. Third: Attestation of minutes of meeting for companies Originals and copies of partnership contract and a list of partners. Fourth: Powers of Attorney: Personal Power of Attorney: - Originals and copies of the documents indicating capacity. Commercial Power of Attorney: - Originals and copies of the license and a list of partners; and - Originals and copies of the Articles of Incorporation and original annexes, if any. Inheritance Power of Attorney: Originals and copies of limitation of succession. If there are minors or legally incompetent individuals, present their pass- port copies and approval of the relevant authority. If the minor has reached the age of maturity/age of discretion, present a copy of the Proof of Full age application. Fifth: Judicial notice / warnings: A letter by a notifier to another person either to inform about or to warm them. If the letter is meant to inform the person of a matter, then it is considered a notice; but if the letter is intended to warm them of a behavior or stopping a behavior which makes them legally liable, it is considered a warning. For ex- ample, warning to evacuate residence or terminate partnership agreements or delivery of funds owed and so on. Requirements: - Provide the address of the notified/ warned. - Presence of the notifier in person or their representative. Sixth: Request a true copy of an attested contract or document at the Notary Public Requirements: - Copy of the application signed by one of the parties. - Presence of the applicant or their representative to receive the at- tested copy. Seventh: Declarations Originals and a copy of Personal Identification documents. Eighth: Marriage contracts issued from authorized churches in Dubai Two original copies of the Marriage document. Provide passport copies of the husband and wife. Legally approved translation of the contract. Ninth: Attesting wills of Non-Muslims Originals of documents proving testator’s ownership of willed assets. Attestation documents proving testator’s ownership of willed assets, if issued from outside the country. Arabic Translation of documents proving testator’s ownership of willed assets by a certified legal translator. Tenth: Affirming dates of private instruments Application of affirming a date in Arabic. Original and copy(s) of the private instrument. Eleventh: Attesting translation Presence of the translator. Produce translation license issued from the Ministry of Justice and a copy of it. Arabic translation of the original foreign document attested by the Ministry of Foreign Affairs in the country. General notes: Print all documents in Arabic or Arabic and a foreign language. If the documents are printed in Arabic and a foreign language, all pages of all the copies of the document must be stamped with the stamp of a certified translator. Presence of all parties involved in the transaction at the time of attesta- tion. Provide originals of documents that established the identification of the person present and their capacity to sign the document and copies of doc- uments to be reserved as a justification of attestation. Provide copy of passport or identity card for all transactions. Make at least three copies of each contract or documents. All documents submitted as justification of attestation that are issued from outside the country should be in Arabic and must be approved by the Ministry of Foreign Affairs. If the documents are in a foreign lan- guage, they must be approved by the Ministry of Foreign Affairs and then translated into Arabic and approving the translation by a legal transla- tor. Electronic Services for the Notary Public are available through Dubai Courts portal on the website (www.dc.gov.ae). All clients can make use of the registration service requests, attachment of documents, and pay- ment of fees electronically. After receiving the notification of acceptance of the transaction, the customer can make an appointment with the Notary Public branch electronically and go to the branch office with the original documents to complete the attestation.
