Welcome to the 48th annual Swan Hill Bull Sale. We thank youfor showing an interest in our bulls. This year marks 56 years ofSanta Gertrudis cattle at Swan Hill. There has been manychanges during this time and we would like to take thisopportunity to thank our previous buyers for their ongoingsupport and welcome new clients.

Once again we have chosen to sell at the Blackall Sale Yardsrather than on property at Swan Hill. Although this year hasbrought more rain than previous years, our bull numbers arestill down due to the prolonged drought. We hope that thedecision to sell in Blackall again will satisfy our clients and helpthem meet their bull buying needs.

This year’s offering of 33 bulls includes 24 classified ‘S’ bulls and9 herd bulls. Swan Hill places a strong emphasis on a strong pollgenetic mix, with 22 of the bulls on offer being a poll or pollscur. We are confident you will find the bulls well grown and instrong working condition.

The bulls have been semen morphology tested and soundnessevaluated prior to the sale and have been scanned for P8, RibFat, Eye Muscle Area and IMF%. They have also been vaccinatedfor Ephemeral Fever, 3 Germ Blood and with 7 in 1.

SWAN HILL HISTORY

The Swan Hill Santa Gertrudis stud was established in 1960by Terry Russell and his wife Jacqueline, making it one ofthe few studs to have reached over 50 years of breeding. Atthis time the Blackall-Tambo district was seen as Merinowool country and the few cattle in the area werepredominantly Shorthorn or Hereford.

The decision to bring Santa Gertrudis to the area wasconsidered risky at the time however the breed quicklyproved to be a successful crossbreed and purebred in theirown right.

The first Santa Gertrudis cows arrived at Swan Hill onMelbourne Cup day in 1960. The Swan Hill Stud wasfounded on King Ranch bloodlines and developed withpredominately Yarrawonga bloodlines. In recent yearsreplacement sires have been secured from a range of studsincluding Rowanlea, Warrillee, and Cree as well as fromwithin the Swan Hill stud.

The first on property auction sale was held in June 1969with 39 bulls and 20 heifers on offer. Swan Hill has held anon property sale every year since, with the exception of2015 year when the annual sale was held at the BlackallSale Yards due to the prolonged widespread drought.

Today Swan Hill Cattle Company is run by Terry’s son Cam,along with his wife Fiona and their children, and includesthree properties in the Blackall-Tambo district. In recentyears the drought has forced a reduction in stock numberswith approximately 600 head remaining in the commercialherd, and 300 cows in the stud.

The Swan Hill breeding program places emphasis on goodmuscled, easy doing cattle. A calm temperament andfertility are also important, as well as a strong, but notdominant, poll genetic mix.

SWAN HILL SIRE NOTESn Warrillee F34 (P) SB 297483 – Sire of lots 1, 14, 19, 22, 24, 27 and 32

F34 was purchased from the Warrillee stud at the 2012 Big ‘S’ Bull Salefor $13,000. Since joining the stud herd he has produced a number ofquality calves with the majority of his first drop heifers being classified ‘S’.This year is the first his progeny are on offer and is the sire with thelargest number of lots representing him, the majority being poll.

n Drensmaine Yobbo (P) SB DRE11M151 – Sire of lots 9 and 11Yobbo was purchased at the Barcoo Breeders Sale in 2012 for $15,000. Alarge number of his first drop of heifers have been classified ‘S’ and havejoined the stud herd. This year is the first in which he is represented bybulls in the annual sale.

n Waco Winner (P) SB 279436 – Sire of lot 18Winner was purchased at the Yarrawonga 50th annual sale in 2009 for$18,000. He was part of the 2009 Yarrawonga Waco show team prior tothe sale.

n Waco Victa SB AP1.270455 – Sire of Lot 16Victa was purchased at the 2008 annual Yarrawonga Waco sale for$14,000. He is a tall growthy bull with a lot of red meat, all characteristicshe has passed onto his calves.

n Waco Biff (P) SB WAC11MG502 – Sire of lot 23Biff was purchased from the 2012 Annual Yarrawonga Waco sale for$12,000. This year marks the second sale in which his progeny representhim.

n Rowanlea Crawford (PS) SB 269381 – Sire of lot 4Crawford was purchased for $10 000 at the Rockhampton SantaGertrudis Sale in 2008. His progeny have appeared as sale bulls for anumber of years.

n Swan Hill 9374 (PS) SB 259046 – Sire of lot 39374 was retained for stud duties in 2006. Lot 3 is one of the last calveshe sired before being removed from the herd. Over the years he hasproduced a number of thick, growthy calves.

n Swan Hill Melrose 9416 SB 259053 – Sire of lot 29Melrose was also retained in 2006 for stud duties and has proven to bea very successful sire. Lot 29 is one of the last calves he produced beforefinishing stud duties early last year.

n Swan Hill Othello R0808 (PS) SB 279979 – Sire of lot 26Othello was retained as a sire in 2008 and has produced a number ofquality polled calves over the years. Lot 26 is one of his last progeny youwill see from him as injury forced him out of the herd last year.

n Swan Hill R2146 (PS) SB SWA10M2146 – Sire of lots 13 and 20R2146, the progeny of Cree Commander (AI) was kept as a sire in 2012.He has produced a number of growthy polled calves and both lotsrepresenting him in the sale are classified ‘S’.

n Swan Hill R2038 (PS) SB AP1.292871 – Sire of lots 2 and 10In 2011, R2038 was retained as a sire. He is a deep, thick set bull –qualities that he has passed onto his progeny. Both of his progeny in thisyear’s sale are classified ‘S’ and either poll or poll scur.

n Swan Hill Ollie R0125 (P) SB 279973 – Sire of lots 5, 7, 8, 21 and 33Ollie was retained for stud duties in 2009 and has sired a number of thick,meaty, polled bulls. All of his 5 progeny in this year’s sale are classified ‘S’and either poll or poll scur.

n Swan Hill R2479 SB SWA11M2479 – Sire of lots 12 and 15R2479, sired by Waco Victa was retained in 2013 for stud duties. The twolots representing him in the sale are amoung the first of his calves, bothof which are classified ‘S’.

n Swan Hill R2241 SB SWA11M2241 – Sire of lot 28R2241 was kept for stud duties in 2013 and lot 28 in this year’s sale is hisfirst calf to represent him in our annual sale.

n Swan Hill R2053 SB AP1.292895 – Sire of lot 30 R2053 was also retained for stud duties in 2011 and is one of many sonsof Rowanlea Crawford (PS).

n Swan Hill R1765 SB 292914 – Sire of lots 25 and 31Sired by Dangarfield Jasper, R1765 was retained as a sire in 2011. In thattime he has produced a number of high quality, thick set bulls.

n Swan Hill Simba R2288 SB SWA11M2288 – Sire of lot 17Simba was on the 2012 World Congress show team as a junior bullhowever he did not end up making it to Brisbane due to a minor injury.After joining the stud herd in late 2013, lot 17 is the first of his progenyto be offered for sale.

n Swan Hill Sheridan R3006 (P) SB SWA11M3006 – Sire of lot 6Sheridan was also part of the World Congress show team as a junior bulland placed first in his class as well as fourth in the progeny group classat the Brisbane Show. He commenced stud duties at the end of 2013 andlot 6 is the first of his progeny to enter a sale line up.

STANDARD STUD STOCK-AUCTIONTERMS AND CONDITIONS OF SALE

IMPORTANT NOTE: All bids shall be treated as offers made upon thefollowing Terms and Conditions of Sale and all persons present areadmitted to attend the sale on the basis that they have notice of theseTerms and Conditions.

1. The highest bidder shall, subject to Conditions 2, be the purchaserprovided that the vendor reserves the right to bid either by himself orthrough his agent or auctioneer and should any dispute arise amongthe bidders for any lot, during or immediately after sale of the lot, itshall be settled at the auctioneer’s absolute discretion who may, shouldone of the disputants advance, put the lot or lots up again. The biddingfrom time to time shall be regulated by the auctioneer and no bid shallbe retracted.

2. The sale will be conducted on a “Sale” or “No Sale” basis, whereby thelot for sale shall be knocked down to the highest bidder, but the salewill be subject to the acceptance of the highest bidder such bidder willhave the right of first refusal of the lot at the vendor’s nominated pricefor one hour after the lot has been passed out of the ring on the Termsand Conditions herein set forth in so far as they shall apply.

3. The details of the purchaser, the purchase price and the lot sold asrecorded by the Sale Clerk for and on behalf of the auctioneer shall beequally binding on both purchaser and vendor.

4. The auctioneer expressly reserves the right, without giving any reasontherefore to:-(a) Refuse to acknowledge any bid;(b) Withdraw any lot or lots before or during the sale;(c) Exclude any person from the auction venue should it think fit.

5. Each lot in all cases shall be at the risk and expense of the purchaser,upon acceptance of his bid by the vendor or upon acceptance of thehighest bidder’s offer by the vendor whichever shall be the earlier.

6. Except as expressly provided in these Terms and Conditions of Sale noguarantee or warranty shall be given in respect of any lot sold underthese conditions as made before or at the time of the sale, or from anycircumstances of the sale, but in all cases where a guarantee is intendedthe same shall attach and be enforceable only if reduced to writingbefore delivery of the lot and signed by the vendor or by the auctioneeracting as agent for the vendor, and the absence of such writing shall beconclusive evidence in case of dispute that no guarantee, warranty orcondition whatsoever was given or implied.

7. In the event of any dispute in respect to the sale of any lot:-(i) The purchaser shall nevertheless be obliged to pay to the auctioneerthe full purchase price and any other moneys or interest payable by thepurchaser in accordance with these Terms and Conditions;(ii) The vendor and the purchaser shall resolve the dispute betweenthemselves;(iii) The auctioneer shall have no liability or responsibility in regard tothe dispute; and (iv) No lot shall be returned to the auctioneer and the purchaser shallindemnify the auctioneer for all costs, expenses and damages whichthe auctioneer is put to or incurs by reason of the purchaser so doing.

8. The name of the vendor for whom the auctioneer acts is acknowledgedto have been furnished to purchasers prior to sale and furtherparticulars will in all cases be furnished to a purchaser if required. Inthe case of any dispute the remedy of the purchaser shall be againstthe vendor only and in no case or under any circumstances against theauctioneer who is to be regarded for all intents and purposes as agentfor a disclosed principal.

9. (a) PAYMENT - Unless prior credit arrangements have been made inwriting with the auctioneer the full purchase price for each lot shall bedue and payable to the auctioneer in cash upon acceptance of thehighest bid or the highest bidders’ offer by the vendor and prior todelivery. Notwithstanding that delivery is given to ar possessionobtained by the purchaser or his representative prior to the payment ofthe purchase money in full the property in any lot which is sold shall notpass to the purchaser until the full purchase price and cheques,promissory notes, bills of exchange, acceptance orders or drafts givenin connection with such payment have been paid and liquidated anduntil property shall pass, the purchaser shall hold such lot as Bailee,provided that in all cases should such payment not have been madeand liquidated within 14 days of the date of the sale the auctioneerreserves the right to:’

(i) Rescind the contract on behalf of the vendor and repossess andresell any lot;(ii) Recover from the purchaser interest upon the purchase price ata rate per annum which aggregates the AMBA Bill Rate and twopercentum. For the purposes of this condition, the expression “TheAMBA Bill Rate” is the rate published by the Australian MerchantBanker’s Association in good faith as at the date of the sale as its BillRate for 180 day Bills of Exchange expressed as a percentage perannum. If at any time the AMBA Bill Rate becomes unavailable forany reason, the auctioneer shall determine and advise the purchaserfor the interest rate to apply for the purpose of this condition.

9. (b) The auctioneer is selling as the del credere agent of the vendor andthe full purchase price of any lot sold shall be payable by the purchaserto the auctioneer and be fully recoverable by the auctioneer in its ownname.

10. If the purchaser shall neglect or fail to comply with any of the withinconditions any lot purchased by him may be immediately resold byPublic Auction or Private Contract, with or without notice, at the riskof the former purchaser, who will be held responsible for all loss andexpenses arising out of such resale, and shall not participate in anyprofit accruing therefrom.

11. Any vendor or purchaser removing the Sale Number from any lot afterit has been sold will fully indemnify all affected parties for any loss,costs or damages should the lot be wrongly delivered.

12. The purchasers, if more than one, shall be jointly and severally boundby these Terms and Conditions and shall jointly and severally carry outand perform sale.

13. Any person who advances a bid on a lot shall do so on the expressedcondition and understanding that should that person’s bid be thehighest bid and such bid is accepted by the vendor, then that personwill be held personally liable for the price so agreed upon, regardlessof the fact that that person may be acting on behalf of another party,either disclosed or undisclosed to the vendor or the auctioneer,provided however that this condition shall not in any way negate thevendor’s right to claim against any principal and in such case thebidder’s liability shall be construed to be by way of guarantee.

14.The auctioneer may, should it think fit, make arrangements on apuchaser’s behalf, for the feeding, watering, trucking, shipping of andgeneral attendance to any lot after sale but no responsibility will beaccepted by the auctioneer and all such service will be at thepurchaser’s risk and expense.

15.No lot will be delivered until the sales invoice has been checked andsigned by the purchaser or his duly authorised representative.

16.(a) Each lot in all cases shall be sold with all faults, if any, and exceptingthose conditions and warranties implied by the Trades Practices Act orany applicable State legislation which cannot be contractually theseTerms and Conditions of Sale, any express or implied condition,statement or warranty, statutory or otherwise, is hereby executed. Theauctioneer is not liable in respect of any error, misdescription oromission shall entitle the purchaser to annul the sale or reject the lotor claim any compensation, damage or abatement in price.

16. (b) Each lot will be sold subject to passing all veterinary tests requiredby the law of the State or country to which the purchaser intends totransport that particular lot such tests to be undertaken at thepurchaser’s expense and concluded immediately following the sale. Inthe event of a lot failing to pass these tests, the sale shall be null andvoid, any purchase moneys paid by the purchaser shall be refundedand property in the lot shall revert to remain with the vendor.

17. In the event of a dispute as to whether a lot is a breeder, such disputeshall be resolved by the vendor and the purchaser, and the auctioneer,while he shall use his best endeavours to assist, shall have no liability orresponsibility in that regard. In the event that a lot is alleged or provednot to be a breeder, the purchaser shall nevertheless be obliged to paythe auctioneer the full purchase price and any other moneys or interestpayable by the purchaser in accordance with these Terms andConditions.

18 (a) Each lot shall be at the risk of the vendor in respect of any damageor injury, whether by disease, accident or otherwise, for the period thatthe lot be in the custody of the auctioneer, PROVIDED THAT theauctioneer, its servants, agents and employees shall use all reasonablecare to protect and control the lot while it is in the auctioneer’s custodyAND PROVIDED THAT when a lot has been sold, it shall be at the riskof the purchaser in all respects.

18 (b) If any vendor brings to the premises any lot which is dangerous, orinfected with any disease, that vendor shall be liable for all injury,damages, costs, losses or expenses which the auctioneer may sustain,incur or be put to either directly or indirectly as a result of the vendorso doing. The auctioneer reserves the right in its absolute discretion,to exclude from the sale venue or dispose of any lot which in itsopinion shows signs of any disease, whether infectious, contagious ornot, or of any serious fault or of being dangerous.

19. DELIVERY. Except at the discretion of the auctioneer, no lot shall bedelivered to the purchaser unless payment of the purchase moneytogether with any additional charges incurred including thoseexpenses incurred by the auctioneer, pursuant to Condition 14 hereof,is first made by the purchaser to the auctioneer. Release of lots may bewithheld by the auctioneer until personal cheques are cleared.

20. In these Conditions:-(a) References to “auctioneer” shall be taken to mean as the contestso admits, the Selling Agent or any member, subsidiary or relatedcorporation or body, officer, agent or employee thereof, authorised bythe vendor to conduct the sale of the lot.(b) “Purchaser” shall have the meaning ascribed to it in Condition 1.(c) “Vendor” shall mean the person or corporation upon whoseaccount lots are offered for sale and where a stud or farm is namedshall mean the proprietor of that stud or farm.(d) “Lot” shall be taken to mean the animal offered for sale and/orsold by the auctioneer on behalf of a vendor.

21.All sale bulls have been semen morphology tested. In the event that abull is not breeding, any retesting within 60 days of the 17th October2016 will not be accepted. After that period any test results will bereviewed with the option of a second independent test on the vendor’s request.

IMPORTANT NOTICE The Vendor and the Selling Agent, its members,subsidiary or related corporations, officers, agents and employees forthemselves and for those for whom they act while exercising due careprovide all information without responsibility and give no guaranteewhatsoever as to its accuracy.All persons who attend the sale do so entirely at their risk and the Vendorand the Selling Agent, its members, subsidiary or related corporations,officers, agents, employees and its principals, for themselves and for thosefor whom they act, do not assume or accept any responsibility or liabilityof whatever nature for any injury or damage whatsoever which may occur.
