MOTION TO SUBMIT SUPPLEMENTAL AUTHORITY

Come now Plaintiffs and move this Court for leave to submit supplemental a

opposition to Intervenor State of Missouris motion for judgment on thepleadings.

Plaintiffs state:

1. In this case, Plaintiffs allege that Missouris laws excluding same-sex co

marriageMo. Rev. Stat. 451.022, Mo. Const. art. I, 33, and any oth

of Missouri statutory or common law barring same-sex couples from ma

violate the Due Process Clause and the Equal Protection Clause of the Fo

Amendment to the United States Constitution.

2. Plaintiffs filed this case against Robert Kelly, in his official capacity as D

the Jackson County Recorder of Deeds. The State of Missouri intervened

4. On the same date, Intervenors Governor, Attorney General, and Directo

Department of Health and Senior Services, in their official capacities, fil

identical motion and suggestions inBarrier v. Vasterling, No. 1416-CV0

in the Circuit Court of Jackson County.

5. On October 3, 2014, the Circuit Court of Jackson County entered an Ord

Judgment disposing of the motion for judgment on the pleadings. A copy

attached hereto.

6. Because the decision of the Circuit Court of Jackson County dealt with t

arguments advanced by the same party in a closely related context, this C

consider the courts reasoning and may find it persuasive.

7. No party will be prejudiced by the grant of this motion.

Wherefore, Plaintiffs respectfully request this Court grant their motion to submit sup

authority in opposition to Intervenors motion for judgment on the pleadings and co

October 3, 2014, order and judgment of the Circuit Court inBarrier v. Vasterling, N

CV03892 (Mo. Cir. Ct.).
