    I was discriminated against by being granted loans I never had the ability to repay and was told these

    loans benefitted me because I was Hispanic. I was subjected to a bait and switch because I was

    Hispanic, and steered to a loan which caused me harm.

    I was granted a refinance loan in May of 2008 after being contacted by the same mortgage broker

    who refinanced my loan in 2007. I was contacted every month by the mortgage broker offering me a

    better deal in the future when interest rates declined- I was called approximately 1-2 times per month

    as a reminder.

    In May of 2008 I was told it was a great time to refinance to get a better rate, and since the value ofmy home increased I could also receive some cash to pay down some consumer debt. The broker said

    he would reduce my term to a 20 year, and reduce the rate so I could save about $100,000 since I

    was paying over a shorter term. I was also happy to hear I was pre-approved for the loan, and when

    he told me he was doing the same for many people in the Spanish community, to help them realize

    the American dream, and help them save money I felt very comfortable. I didnt even have to give

    my social security number to have my credit pulled. He assured me since it was a FHA loan that it was

    perfect for a refinance- in addition he said it would benefit me like the others in the Spanish

    community because the FHA loans have lower closing costs. He also said this was something theywere doing for Spanish people everywhere, not just in this neighborhood.

    An independent expert analysis showed that 77% of my income, at origination, was devoted to the

    repayment of the principal and interest payments, taxes and insurance of both of these loans. The

    analysis also revealed my property may have only been worth as much as $503k, not the $580

    according to the application. In addition the $100,000 that I was supposed to save over the life of the

    loan was proven to be misleading and false.

    I believe they allowed me to agree to a financially harmful loan I never had the ability to repaybecause of my Race: Hispanic. I feel this is also the basis of them not being willing to work on aloan modification for my situation.
